HomeMy WebLinkAbout2011 02 14 Consent 212 Adoption on Resolution 2011-06 Regarding Reimbursement Related to Development and Construction of Seminole Science and Simulation Center COMMISSION AGENDA Informational ITEM 212 Consent X Public Hearings Regular February 14, 2011 Regular Meeting M / � t. / P Authorization REQUEST: The City Manager and the Community Development Department requests that the City Commission Adopt Resolution 2011 -06 regarding reimbursement of certain costs related to the development and construction of the Seminole Science and Simulation Center. SYNOPSIS: The City may incur various costs associated with the development and construction of the Seminole Science and Simulation Center. If the City incurs such costs, any grant funding awarded may be available to reimburse the City for such costs, provided this Resolution is in place. CONSIDERATIONS: Some future grants associated with the development and construction of the Seminole Science and Simulation Center (SSSC) may allow for grant funds to be used for reimbursement of certain costs incurred by the City for the development and construction of the SSSC. Resolution 2011- 06 allows for the use of these grant funds to reimburse these eligible costs. FISCAL IMPACT: There is no fiscal impact associated with the adoption o0f this resolution. Future positive impacts may be realized from the reimbursement of certain development and construction costs associated with SCCC. COMMUNICATION EFFORTS: This Agenda Item has been forwarded to the Mayor and City Commission; City Manager; City Attorney /Staff; placed in Press Packets; placed in the City Hall (Lobby) City Commission Meeting binder; and is available on the City's Website, LaserFiche, and the City's Server. Additionally, information related to this Agenda Item has been sent to media/press representatives who have requested Agendas /Agenda Item information, all Homeowner's Associations on file with the City, all individuals who have requested Agendas /Agenda Item February 14, 2011 CONSENT AGENDA ITEM 212 PAGE 2 OF 2 information, Department Directors; and also posted outside City Hall; posted inside City Hall with additional copies available for the general public; and posted at five (5) different locations around the City. RECOMMENDATION: Staff recommends that the City Commission Adopt Resolution 2011 -06 outlining the possible reimbursement for certain costs related to the development and construction of the Seminole Science and Simulation Center. Resolution 2011 -06 RESOLUTION NO. 2011-06 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, REGARDING THE POTENTIAL REIMBURSEMENT OF CERTAIN POTENTIAL COSTS RELATED TO THE DEVELOPMENT AND CONSTRUCTION OF INFRASTRUCTURE FOR THE SEMINOLE SCIENCE AND SIMULATION CENTER; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City may incur various costs in relation to the development and construction of a new Seminole Science and Simulation Center; and WHERAS, the City may determine in the future that it may be in its best interest to reimburse such costs from the proceeds of future federal/state grants and/or other sources should those sources of funding become available to the City; and WHEREAS, the City deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, TAE , REFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA THAT: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by reference. Section 2. Support and Authorization. The City Commission of the City of Winter Springs desires to demonstrate its continuing support of the improvements associated with the potential development of the Seminole Science and Simulation Center. Section 3. Future City Costs and Expenditures. Upon or in conjunction with the future permitting of the new Seminole Science and Simulation Center, the City may incur various costs and expenditures relating to the installation of infrastructure for the { Seminole Science and Simulation Center. The City may pay for, and/or reasonably anticipate that it may pay for, such costs and expenditures from various sources of City Funds including the General Fund. If state and/or federal grant funding is available, the City reasonably expects to seek state and federal grants to reimburse the City for such costs and expenditures by City funds. The costs and expenditures to be reimbursed shall City of Winter Springs Resolution 2011 -06 Page 2 of 2 be consistent with the City's budgetary and financial policy related to the payment for the construction of long term infrastructure improvements. Section 4. Public Records Law. The City shall comply with all applicable laws in regard to public availability of records of official entities, such as the City, including making this Resolution available for public inspection. Section 5. Intent. It is the intent and purpose of this Resolution to anticipate satisfying the applicable requirements of federal and/or state grant award programs. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. • Section 7. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolution in conflict herewith are hereby repealed to the extent of the conflict. Section 8. Effective Date. This Resolution shall become effective immediately upon its adoption by the City Commission of the City of Winter Springs, Florida.
