HomeMy WebLinkAbout2010 10 11 Consent 204 Ladybird Academy Substantial Completion COMMISSION AGENDA CONSENT X INFORMATIONAL ITEM 204 PUBLIC HEARING REGULAR October 11, 2010 MGR /DEPT /?'-'-- Meeting Authorization REQUEST: Public Works Department Requesting the City Commission validate the Staff recommendation finding the Ladybird Academy site to be built in substantial accordance with the Final Engineering plans and to accept the potable water and sanitary sewer infrastructure for ownership and maintenance. SYNOPSIS: Sitework for the Ladybird Academy at 282 West S.R. 434 is substantially complete and has been approved by all applicable City Departments. This agenda item provides the site acceptance necessary before a certificate of occupancy can be issued by the building official. CONSIDERATIONS: • APPLICABLE CODE: Section 9 -178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. • Final Engineering for the Ladybird Academy project was approved by the City Commission at the August 10, 2009 City Commission meeting. The project consists of an 8,464 square foot daycare / pre - school building located on a 1.76 -acre site abutting a church to the west, Barrington Estates to the north, and an undeveloped 20 -foot wide City right -of -way to the east. '' * J October 11, 2010 Consent 204 Page 3 of 3 • The site has been constructed in substantial accordance with the Final Engineering plans approved by the City Commission on August 10, 2009. • All City agencies have found the work to be acceptable, with the exception of the following punchlist items: a. Final completion of site landscaping b. Passing the final irrigation inspection c. Recording of all easements at Seminole County • The engineer -of- record has certified the sitework and provided a signed and sealed set of record drawings. • The owner has provided a Bill of Sale and two -year letter of credit for the water and sewer utilities being turned over to the City for ownership and maintenance. • The project requires dedication of utility, landscape, and cross - access easements. The owner has provided signed utility easement agreements and the sketches and legal descriptions for all easements. The easements must be recorded at Seminole County before a Certificate of Occupancy can be issued. • The potable water and sanitary sewer systems have been cleared by FDEP. • FDOT has accepted the improvements constructed in the S.R. 434 right -of -way. FISCAL IMPACT: All applicable fees associated with the development of the Ladybird Academy project have been paid by the owner. COMMUNICATION EFFORTS: Copies or access to this Agenda Item have been provided to the Mayor and City Commission, City Manager, City Attorney, and Department Directors; placed in Press Packets, placed in the Lobby Binder; and are available on the City's website, LaserFiche, and the City's Server. RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Ladybird Academy site to be built in substantial accordance with the Final Engineering plans and to accept the potable water and sanitary sewer infrastructure for ownership and maintenance, subject to satisfactory completion of all site punchlist items listed herein.
