HomeMy WebLinkAbout2010 09 27 Consent 204 Final Engineering Plans for Michael Blake Boulevard COMMISSION AGENDA CONSENT X INFORMATIONAL ITEM 204 PUBLIC HEARING REGU AR September 27, 2010 MGR /DEPT Meeting Authorization REQUEST: Public Works Department Requesting City Commission approval of the Final Engineering Plans for Michael Blake Boulevard, and to authorize payment to Winter Springs Holdings, Inc. in the amount of $247,561.80 at the closing for conveyance of the Michael Blake Boulevard right -of -way to the City. SYNOPSIS: Final Engineering Plans for Michael Blake Boulevard (Spine Road) are complete and recommended for approval by Staff. Michael Blake Boulevard is an important collector road located in the Winter Springs Town Center that will relieve traffic on Tuskawilla Road and provide access to multiple development projects on the east side of Tuskawilla Road. Under the terms of the City's Agreement with Winter Springs Holdings approved at the April 26, 2010 City Commission meeting, the final engineering plans are required to be approved by the City Commission and at closing of the right -of -way the City is required to reimburse Winter Springs Holdings in the amount of $247,561.80 for design, permitting, and wetland mitigation for Michael Blake Boulevard. CONSIDERATIONS: • Michael Blake Boulevard (formerly referred to as "Spine Road ") is a future City collector road in the Winter Springs Town Center that runs from S.R. 434 to Tuskawilla Road (see Exhibit 1). MBB has two primary segments planned at this time, with Segment 1 from S.R. 434 north to the Cross - Seminole Trail crossing, and Segment 2 from the trail to Tuskawilla Road. Segment 1 is the subject of this agenda item and is located on the Town Center Phase II property owned by Winter Springs Holdings, Inc. Segment 2 is on property owned primarily by Meritage Homes and is planned to be constructed and conveyed to the City as part of the Sonesta Pointe residential project. The time frame for construction of Segment 1 from S.R. 434 to the Cross - Seminole Trail depends on the progression of the Meritage Homes project and other surrounding developments in the Town Center. • At the April 26, 2010 City Commission meeting, under Regular Agenda Item #606 the Commission approved an agreement with Winter Springs Holdings, Inc. to terminate the Town Center Phase II Implementation Agreement under the terms and conditions set forth in a new agreement. The new agreement was fully executed on August 23, 2010. September 27, 2010 Consent 204 Page 2 of 3 • Under the terms of the new agreement with Winter Springs Holdings (WSH), WSH was required to submit to the City the Final Engineering Plans for Michael Blake Boulevard. The final plans were received on September 9, 2010. Staff reviewed the plans, provided written comments, and the plans have been updated to Staff's satisfaction and are enclosed for the Commission's review and approval. The plans were previously submitted and reviewed by Staff in 2007 as part of the Town Center Phase II project, but the plans were not finalized until September 2010. • The design for Michael Blake Boulevard (Segment 1 from S.R. 434 to the Cross - Seminole Trail) consists of a two -lane collector road, a roundabout at the future intersection with Tree Swallow Drive, stormwater facilities, and water and sewer facilities serving planned and future development. The design is planned for future on- street parallel parking and sidewalks along both sides that would likely be installed concurrent with development of the surrounding property. The typical section has a 60 -foot wide right -of -way conforming to the "Town Center Street" design in Section 20 -325 of the Town Center Code. • At S.R. 434, Michael Blake Boulevard is designed as a full- access median opening, which will allow left-in, left -out, right -in, and right -out turning movements. The intersection location has been approved by FDOT and the intersection has been approved by FDOT for future signalization when it is warranted. The southbound approach to S.R. 434 on MBB splits into left and right turn lanes, with the left turn lane likely to become a left - through lane when MBB is continued on the south side of S.R. 434. The Michael Blake Boulevard right - of -way to be conveyed to the City includes the land that would be necessary to install a S.R. 434 westbound deceleration lane if it was determined to be required. • Under the terms of the City's Agreement with Winter Springs Holdings (WSH), the City shall reimburse WSH in the amount of $247,561.80 for design, permitting, and wetland mitigation for Michael Blake Boulevard (MBB). The $247,561.80 is due at the closing for the Michael Blake Boulevard right -of -way and consists of $156,548.80 for design, permitting, and surveying; $83,738 for wetland mitigation; and $7,275 for the right -of -way survey and sketch of description. • The agreement between the City and Winter Springs Holdings (WSH) includes a number of items related to the former Town Center Phase II property, summarized as follows: Item Status Execute Agreement Complete 8/23/10 WSH Submits Final Engineering Plans for MBB Complete 9/17/10 City Commission Approval of MBB Final Engineering Plans Planned 9/27/10 WSH submits 5 sets of certified MBB plans to Required within 7 -days after Commission approval of City Final Engineering WSH submits 5 sets of certified boundary survey Required within 7 -days after Commission approval of and sketch of MBB right -of -way Final Engineering WSH conveys MBB right -of -way to City by Required within 30 days of City receiving certified plans warranty deed and boundary survey September 27, 2010 Consent 204 Page 3 of 3 City reimbursement of $247,561.80 Due at closing for the MBB right -of -way WSH conveys temporary public parking easement along Tuskawilla Road to City Due at closing for the MBB right -of -way Execution of a special events agreement to allow the City to use undeveloped portions of the WSH property for future Town Center events Due at closing for the MBB right -of -way Execution of a future development obligations agreement (for small neighborhood squares and a master stormwater plan) Due at closing for the MBB right -of -way Conveyance of a utility easement along S.R. 434 from MBB to east property line Due at closing for the MBB right -of -way FISCAL IMPACT: The required reimbursement in the amount of $247,561.80 due at right -of -way closing is budgeted in the Road Improvement Fund (One -Cent Sales Tax). COMMUNICATION EFFORTS: Staff regularly communicates with Winter Springs Holdings and other affected parties regarding the status of Michael Blake Boulevard. Additional communications, such as website postings, e- Alerts, etc., will be necessary when the project is under construction. RECOMMENDATION: Staff recommends the City Commission approve the Final Engineering Plans for Michael Blake Boulevard and authorize payment to Winter Springs Holdings, Inc. in the amount of $247,561.80 at the closing for conveyance of the Michael Blake Boulevard right - of -way to the City.
