REQUEST:
The Police Department requests the Commission to authorize the City Manager to enter into a
month -to -month contract with ATS (American Traffic Solutions) for the automated Red Light
Running Camera Enforcement System.
SYNOPSIS:
On July 1, 2010 HSB 325 the Mark Wandall Traffic Safety Program became state law
authorizing municipalities to use traffic infraction detectors to identify a motor vehicle that fails
to stop at a traffic control signal steady red light.
Since that enactment of legislature, the current contract with ATS and the City must be amended
to be consistent with state law and the provisions provided for there in. Subsequently, at the
regular City Commission meeting on June 28, 2010 the Commission authorized the City
Manager to enter into a short -term Contract with ATS through the Commission meeting of
August 9, 2010.
CONSIDERATIONS:
At the July 14, 2008 regular City Commission meeting the City approved to enter into a five year
contract with ATS that provided that ATS would provide to the City a comprehensive and fully
integrated red light traffic safety management services including collections of fines, training,
public safety announcements, easements, maintenance, operation and equipment. This service
did not require any expenditure from general fund or other cost to the City and was consistent

with the City Codes governing red light traffic enforcement. Under that contract the City received
pricing for services which included the below listed option;
• A fee per paid citation, and no charge to the City per camera of $4750. The contractor
would then retain a fee of $40.00 taken from each paid citation and the City would
receive $85.00 per citation.
Additionally and more specifically the new law amended F.S.S. 318.18 to read; providing that an
individual may not receive a commission or per- ticket fee from any revenue collected from
violations detected through the use of a traffic infraction detector and a manufacturer or vendor
may not receive a fee or remuneration based upon the number of violations detected through the
use of a traffic infraction detector.
With this amendment ATS is no longer provided the opportunity to offer a per citation pricing
option and must be compensated on a flat fee for service. We have experienced a very good
relationship with ATS thus far and feel that we can achieve a long term contract that is both
beneficial to the City and with ATS. The approval of this short term contract will allow us to
continue in negotiations towards a new contract and using the Red Light Safety cameras.
FISCAL IMPACT:
The new flat fee services that would be provided by ATS is the same fee offered to all of their
current clients in the State of Florida. Fees are based on per camera and are as follows;
Flat Fee per Camera per month is $4,750, plus certified mail processing surcharge of $4.00 per
piece metered for mailing Uniform Traffic Citations (no return receipt).

The City Commissions regular agenda being advertized prior to the meeting at various locations
throughout the city.
RECOMMENDATIONS:
Options
1. The City Commission to approve the City Manager to execute and sign the
agreement authorizing a short term month -to -month contract with ATS not
to extend beyond October 31, 2010. Continue dialogue with ATS to either
reach a new long term contract or other options that are favorable to the
City.
2. Take no action until an acceptable contract can negotiated between both
entities which would cause a temporary loss of the program.

3. End the services with ATS and issue a new RFP and go out to bid for this
service.
