Krebs - Seat Five CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION SPECIAL MEETING - JUNE 3, 2010 PAGE 2 OF 4 CALL TO ORDER The Special Meeting of Thursday, June 3, 2010 of the City Commission was called to Order by Mayor John F. Bush at 5:00 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Mayor John F. Bush, present Deputy Mayor Rick Brown, absent Commissioner Jean Hovey, present Commissioner Gary Bonner, present Commissioner Sally McGinnis, present Commissioner Joanne M. Krebs, present City Manager Kevin L. Smith, present City Attorney Anthony A. Garganese, present ATTORNEY -CLIENT SESSION Pursuant To Section 286.011(8), Florida Statutes, The City Attorney Will Be Seeking The Advice Of The City Commission Regarding Consideration Of A Settlement Agreement With Grubbs Services In The Case Grubbs Services v. Winter Springs, Seminole County Circuit Court. The Persons Scheduled To Be In Attendance Are Mayor John F. Bush, Deputy Mayor Rick Brown, Commissioner Jean Hovey, Commissioner Gary Bonner, Commissioner Sally McGinnis, Commissioner Joanne M. Krebs, City Manager Kevin L. Smith, City Attorney Anthony A. Garganese, And A Court Reporter. City Attorney Anthony A. Garganese briefly spoke on this Attorney -Client Session and stated, "I estimate that the Attorney -Client Session will last approximately thirty (30) minutes and the purpose of the session would be to discuss a proposed Settlement Offer being made to the City and to discuss that offer in the context of litigation expenditures." Mayor Bush also noted that the Attorney -Client Session would last "Approximately thirty (30) minutes and the people attending will be Anthony Garganese, the City Attorney; Kevin Smith, City Manager; Jean Hovey, Commissioner; myself, John Bush, Mayor Bush; Gary Bonner, Commissioner, Sally McGinnis, Commissioner; Joanne Krebs, Commissioner — and the Court Reporter." This portion of the Attorney -Client Session was then closed Those attending this Attorney -Client Session left the Commission Chambers at 5: 03 p. m. At 5: 25 p. m., Mayor Bush, Commissioner Hovey, Commissioner Bonney; Commissioner McGinnis, Commissioner Krebs, Manager Smith, and Attorney Garganese returned to the Commission Chambers. Mayor Bush called the Attorney -Client Session back to Order CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION SPECIAL MEETING -JUNE 3, 2010 PAGE 3 OF 4 REGULAR AGENDA REGULAR 600. Office Of The City Attorney And Office Of The City Manager Requesting The Commission To Consider A Settlement Agreement With Grubbs Services. "I WOULD LIKE TO MAKE A MOTION THAT WE ACCEPT THE SETTLEMENT AGREEMENT." MOTION BY COMMISSIONER KREBS. SECONDED BY COMMISSIONER McGINNIS. DISCUSSION. ATTORNEY GARGANESE NOTED, "FOR THE RECORD, THAT THAT IS ACCEPTANCE OF THE OFFER OF JUDGEMENT." VOTE: COMMISSIONER KREBS: AYE COMMISSIONER BONNER: AYE COMMISSIONER HOVEY: AYE COMMISSIONER McGINNIS: AYE MOTION CARRIED. In other City business, Manager Smith commented, "I trust everyone saw the copy of the letter from the County Manager regarding Jetta Point in response to my previous letter. We disseminated that to — everyone that has either spoken to the City or provided an email, we've created a list and again distributed that letter to them including the President of each HOA (Homeowner's Association) that is affected; Mr. Cannon who has spoken to this Commission. I was wondering if the Commission thought it would be a good idea if I did a couple things: on our Website - posted both those letters, and also post the link to the County's Website that gives information about Jetta Point Park; just in an effort to communicate thoughts?" Commissioner McGinnis stated, "Yes. Do it." Mayor Bush remarked, "I think it is fine." Commissioner Bonner nodded in agreement. No objections were voiced. Mayor Bush added, "Can't give them enough information." Continuing, Mayor Bush mentioned that Seminole County Commissioner Carlton Henley approached him earlier today at an event and commented that Seminole County bad received a three million dollar ($3,000,000.00) Grant from the State to do Jetta Point Park. Mayor Bush added, "I have asked Kevin (Smith) to see — could that Grant be moved to us?" Mr. Kip Lockcuff, P.E., Director, Public Works Department noted, "The design was over a million." Further comments.
