Authorization REQUEST: The City Manager is requesting that the City Commission to determine if it desires to grant an exception to the city policy for a water leak for Howard H. Warfield of 51 North Edgemon Avenue. PURPOSE: The purpose of this Agenda Item is for the Commission to decide if it desires to grant an exception to the policy for water leaks and grant a second month's adjustment in the same year for the resident, Howard H. Warfield, at 51 North Edgemon Avenue. CONSIDERATIONS: The water leak policy provides a reduction in water charges for one billing cycle a year or two billing cycles within a ten year period for excessive use. Howard H. Warfield had a leak at his residence of 51 North Edgemon Avenue between August and October, 2003. The consumption due to a leak in September 2003 was 334,220 gallons resulting in a water charge of $9l8.64. The consumption in October 2003 was 253,980 gallons resulting in a water charge of $689.95. A leak adjustment was issued in November 2003 on the September consumption in the amount of$645.26. During the period of the leak Mr. Warfield was hospitalized and out of the residence. The water charges incurred as a result of the leak has caused an economic hardship on Mr. Warfield, and CITY OF WINTER SPRINGS CITY COMMISSION REGULAR MEETING - CONSENT AGENDA ITEM "', PAGE 2 OF 2 Mr. Warfield is requesting relief above the water leak policy for both billing cycles. The city has documentation that the leak was repaired. FUNDING: N/ A RECOMMENDA TION: The City Manager recommends that the City Commission decide if it desires to make an exception to the water leak policy due to economic hardship for Howard H. Warfield, and that he was incapacitated during the two billing cycles, and that he has had the leak repaired. A TT ACHMENTS: l. COMMISSION ACTION: December 23,2003 Mr. Ron McLemore City Manager Winter Springs, FI Dear Mr. McLemore: I am writing on behalf of my tenant, Mr. Howard Warfield, residing at 51 North Edgemon Ave. Over the past several months the water bill at that address has reached very high numbers through no fault of Mr. Warfield. Mr. Warfield was admitted to the hospital and circumstances dictated that one of his legs be amputated below the knee due to diabetes. Mr. Warfield was in the hospital and a nursing home in excess of two months. During his stay his mail finally caught up with him and the first water bill which was in excess of $1000 arrived. He contacted me and I immediately contacted Herrell Plumbing and they came to the property and determined that there was a leak in the slab of the home. I authorized a complete repiping of the home and forwarded a copy of the invoice to your water department who did make an adjustment to the original bill. However, after the first bill was received and before the repiping, the water continued to leak and the charges mounted up. When the next bill arrived it was for in excess of $1400 and did include the adjustment for the first month. In speaking with your representative in the water department, I was informed that they could only make one adjustment and further adjustment would need to come from your office. McLemore City Manager April 22, 2004 Mr. Howard Harding Warfield 51 North Edgemon Avenue Winter Springs, FD2708 Dear Mr. Warfield, I am in receipt of your request for review of your utility consumption for September and October of last year. I apologize that it has taken awhile to get back to you. I understand you had a leak at your residence for this time period and also during this time you were hospitalized unaware of the situation. When a leak occurs at a residence city policy only allows me to provide relief for one of the months in which the leak occurred. A leak adjustment was issued for the September billing in the amount of $645.26. Under city ordinance I am not able to provide additional relief for the October billing. However, under the extraordinary circumstances in which you were experiencing, being hospitalized, you may possibly seek an exception by appealing to the city comrilission. If you wish to appeal my decision to the commission please provide a letter requesting your matter be placed on the city agenda. Once I have received your request and have a date I will contact you with that information. I wish I could have been of more assistance within my own authority. Warfield, I am requesting an exception to the city policy that allows the City Manager to provide relief for one month only in case of a water leak. I have attached both my letter, which outlines the circumstances, and the City Manager's response for this request. I have provided to the water department a copy of the invoice for $3200 for the complete repiping of the home. It is requested that the amount for the leakage be removed from the monthly bill and Mr. Warfield be charged the average monthly amount for those two months.
