PURPOSE: The purpose of this agenda item is to approve and authorize recordation of the Maharaj Place re-plat. The property comprises the existing 5.382 acre Lot No.7 of Block E of Orlando Ranches, Section 1. It is proposed to be divided into 2 lots of nearly equal proportions (one of2.6908 acres and one of2.6909 acres), pursuant to the provisions of Section 9-3 of the City Code. Both proposed lots have anlple frontage on Hayes Road and meet the dimensional requirements of Section 20-145 of the City Code, Since no new roads, utility lines, or stormwater management facilities are needed, no final engineering is needed or required. Approval of final plat. Code Section 9-78. Recording/distribution of the final plat. Chapter 177, Florida Statutes. Chapter 197, Florida Statutes (Section 197.333 When taxes due; delinquent). CONSIDERATIONS: The applicants own one 5.382 acre lot 7 in Block E of the Ranchlands, Section 1., located at the northeast comer of Hayes Road and Panama Road. The property abuts a paved public road (Panama Road - Hayes Road is not paved), has a Rural Residential Future Land Use designation and is within the RC-I zoning district (1 acre minimum lot size). The applicants wish to divide the property into 2 lots of nearly equal proportions (2.6908 and 2.6909 acres), pursuant to the provisions of Section 9-3 of the City Code (which allows a previously platted lot to be divided into no more than 2 lots - provided both lots meet all September 13,2004 Regular Agenda Item 502 Page 2 of the applicable zoning requirements. Section 9-4 allows the City Commission to waive the engineering requirements of the Code for this type of simple division of property where no new infrastructure needs to be provided (e.g. roads, sewer or water mains, or drainage structures), although a plat is required. The proposed Maharaj re-plat meets the dimensional requirements of the RC-I zoning district and does not need any engineering plans. A site inspection was made by Environmental Management & Design, Inc., who reported that there are no known wetlands on this site. FINDINGS: 1. The plat is consistent with the Comprehensive Plan and City Code. 2. The City's surveying consultant has reviewed the plat and has certified that it meets the platting requirements of Chapter 177, Florida Statutes. 3. The DRC finds no reason to require engineering plans for this simple division of property where no new roads, utility mains, or stormwater facilities are required. 4. The DRC has reviewed the plat and recommends approval, subject to the City Attorney's review and approval of the plat and title certification - applicant to make any changes or provide any additional information required by the City Attorney, prior to execution and recordation. The applicant pays for recordation and the City's copies of the plat. RECOMMENDATION: Staff recommends that the City Commission (1) waive the engineering plans, as provided in Section 9-4 and (2) approve and record the Maharaj Place re-plat , subject to the City Attorney's review and comments.
