Authorization PUBLICLY ANNOUNCE THE REQUEST REQUEST: The City Manager is requesting that the City Commission hold a Public Hearing relative to the approval of Resolution No. 2004-39, which establishes the Tentative Operating Millage Rate for Fiscal Year 2004-2005 for the City of Winter Springs at 5.3000 mills which is 30.0167% above the rolled-back rate of 4.0764 mills and the Tentative Voted Debt Service Millage Rate for Fiscal Year 2004-2005 for the City of Winter Springs at .2500 mills. PURPOSE: The purpose of this agenda item is to have the Commission approve the first reading of Resolution No. 2004-39, otherwise known as the Tentative Millage Rates for Fiscal Year 2004-2005. CONSIDERATIONS: Resolution No. 2004-39 - Tentative Millage · The current operating millage for FY 2003-2004 is 4.3000 mills. The tentative operating millage for FY 2004-2005 is set at 5.3000 mills. · The tentative voted debt service millage rate for FY 2004-2005 is set at .2500 mills. · The rolled-back rate is 4.0764 mills. The tentative operating millage rate is 30.0167% above the rolled-back rate. · Any changes or deletions to the tentative budget and the tentative millage rates requested by the City Commission at this meeting will be reflected in the second reading (Final Millage and Budget Hearing) scheduled for September 27, 2004 at 6:30 pm, · The Commission can further amend the millage rates and the budget at the second reading. . 091304_ COMM _ Publie _ Hearing_ 400_ Tentative_Millage RECOMMENDATION: Tentative Millage Rates · The Commission adopt Resolution No. 2004-39 establishing the tentative operating millage rate at 5.3000 mills for fiscal year 2004-2005 and the tentative voted debt service millage rate at .2500 mills for fiscal year 2004-2005. IMPLEMENTATION SCHEDULE: Upon approval and adoption of Resolution No. 2004-39 at the second reading the millage rates for fiscal year 2004 - 2005 would be implemented and become effective on October 1,2004. WHEREAS, the City Commission of the City of Winter Springs has held a public hearing on the tentative millage rate pursuant to Florida Statute 200.065, Subparagraph (c); WHEREAS, the City Commission of Winter Springs desires to adopt the tentative operating millage rate and publicly announce their percentage change by which the tentative proposed operating millage rate exceeds the rolled-back rate, and adopt the tentative voted debt service rate; and WHEREAS, the City Commission of the City of Winter Springs deems that this Resolution is in the best interest of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. The City Commission adopts its tentative operating millage rate of 5.3000 mills and its tentative voted debt service millage rate of .2500 mills for the fiscal year commencing October 1,2004 and ending September 30, 2005. Section 3. The tentative operating millage rate of 5.3000 mills is more than the computed rolled-back rate of 4.0764 by 30.0167%. Section 4. Within fifteen (15) days of the date of this Resolution, the City Clerk shall advertise in a newspaper of general circulation its intent to finally adopt the millage rates and budget and shall hold a public hearing to finalize the budget and adopt the millage rates not less than two (2) days or more than five (5) days after the date the advertisement is first published. 091304_COMM_ Public_Hearing_ 400_ATTACHMENT_1 Section 5. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repe'aled to the extent of the conflict. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 7. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
