HomeMy WebLinkAbout2004 04 12 Regular 508 COMMISSION AGENDA ITEM 508 CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X April 12,2004 Meeting MGRr- IDEPT )~ Authorization REQUEST: Public Works Department Requesting the City Commission Consider the Request of the Arbor Glen BOA Relative to Landscaping and Irrigation Damage Incurred During the Construction of Tuslkawilla Road PURPOSE: The purpose of this Board item is for the City Commission to Provide Staff Direction relative to the Request ofthe Arbor Glen HOA for Reimbursement of $11,655 which represents the total cost of repairs for irrigation, relandscaping, and electrical work at the entrance to Arbor Glen. CONSIDJEJRA TIONS: The entrance to Arbor Glen had landscaping, irrigation, and electrical lines which were partly located in the public right of way. During the construction of TuskawiUa Road, the contractor working for the County, cleared the right of way limits including those landscaping, irrigation, and electrical lines located in the right of way. The standard and approved practice for the County's contractors is to cut and cap electrical and irrigation lines at the right of way. This occurred at the Arbor Glen entrance in approximately early 2001. A representative of the Arbor Glen HOA verbally notified the County or their representative ofthe damages in early 2001 but apparently the County declined any remedial action due to their policy. The HOA subsequently needed to redo the entrance including landscaping, irrigation, and electrical work which cost them a total of$II,655.00. Mr. Donald 1. Rumberg, Vice President of the Arbor Glen HOA, contacted the City in late 2003 to elicit support. The County project support staff is of the same position that the County is not responsible to correct or make whole amenities that are located within the right of way. The HOA is .. Arbor Glen Entrance FUNDING: No funding is required at this time unless the City Commission wants to financially participate in the relief requested by the Arbor Glen HOA. RECOMMENDATION: It is recommended that the City Commission direct the City Manager to forward to the County Manager a letter conveying the support the Mayor and City Commission have in seeing that the Arbor Glen receive some financial relief for the expenses they incurred due to the construction of TuskawilJa Road. McLemore, City Manager 1126 East S.R. 434 Winter Springs, FI 32708 Dear Mr. McLemore: Thank you for taking the time to pursue our issue of reimbursement for damage done to our front entrance during the construction on Tuskawilla Road. We are very pleased that our local government is so interested in its residents. During the expansion of Tuskawilla Road our irrigation and electric were damaged resulting in the loss of plants. The total cost of repairs due to the loss of and repairs to the irrigation, electric and landscaping was $11,655. We are requesting that you bring this issue up at the next City Commission meeting for resolution. Attached are copies of re-Iandscaping, irrigation and electric repair bills inCUrred as a direct result of irrigation and electric lines being cut during construction. We have also attached our water bill indicating th~ lines were cut in January of 2001, and not repaired until two months later, when we realiZed there was a problem, We have also discussed this situation with Steve Krug of Seminole County. During cOnversations with Mr. Krug he indicated they were responsible for the damage but advised we take this matter up with the City of Winter Springs since the County was a contractor of Winter Springs and the County had no way of reimbursing us. Your concern of these issues is very much appreciated. We are a relatively small community and attention in this matter makes us feel like an integral part of Tuscawilla.
