PURPOSE: The City Commission is requested to consider information requested by the City Commission, in relation to the City Clerk's Annual Evaluation. FUNDING: To possibly be discussed,. CURRENT CONSIDERATIONS: I, Andrea Lorenzo-Luaces was appointed as Interim City Clerk at the Febmary 22, 1999 Regular City Commission Meeting. It is and has been a distinct honor to serve our Mayor and City Commission - and this Meeting of September 27, 2004 is my actual five (5) year Anniversary that I have served as your City Clerk. As noted below, the City Commission has requested that "at least one (1) month" prior. .. notice be given as to when my Evaluation was due. Thus, an Agenda Item was included on the August 23, 2004 City Commission Agenda related to this issue. During this san-ie Agenda Item discussion, the following Motion was made: "I \VOULD LIKE TO MAKE A MOTION WE DIRECT THE CITY CLERK TO BRING BACK TO US THE SAME TYPE OF APPRAISAL METHOD THAT SHE USED IN THE PREVIOUS YEAR." MOTION BY COMMISSIONER BLAKE. SECONDED BY COMMISSIONER McGINNIS. DISCUSSION. VOTE: COMMISSIONER GILMORE: AYE DEPUTY MAYOR MILLER: AYE COMMISSIONER McGINNIS: AYE COMMISSIONER BLAKE: AYE COMMISSIONER McLEOD: AYE MOTION CARRIED. As requested, a new current Salary Survey was completed by Deputy City Clerk Debbie Franklin and is attached as Attachment "A". During the August 25, 2003 Regular City Commission Meeting, the following was discussed during the Agenda Item pertaining to my Evaluation for September 2003: "I WOULD APPRECIATE IT IF THE CLERK WOULD PROCEED AS SHE HAS THE LAST COUPLE OF YEARS AND PROVIDE US WITH A REPORT - WE CAN ACT UPON IT, ONCE WE REVIEW THAT." MOTION BY COMMISSIONER BLAKE. SECONDED BY DEPUTY MAYOR MILLER. COMMISSIONER BLAKE ADDED, "FEWER THAN 100 PAGES THIS TIME PLEASE." DISCUSSION. COMMISSIONER McLEOD SAID, "WE WOULD PROBABL Y LIKE YOUR INPUT, BUT OVERALL, WE WILL MAKE THE FINAL DECISION." COMMISSIONER BLAKE ADDED, "YES, THAT IS FINE." MAYOR BUSH SAID TO CITY CLERK, ANDREA LORENZO- LUACES' - "YOU WILL GET WITH THE MANAGER." CITY CLERK LORENZO-LUACES STATED, "SURE." As requ~sted by the City Commission, I did answer the City Manager's four (4) standard Review Questions and submitted them on December 2, .2003 to Manager McLemore along with a Copy to Mayor Bush and each of the City Commissioners. The date of my submittal although later than I would have preferred, was due to a couple of reasons, including my focusing on handling the many responsibilities entrusted to me, over improvements to my personal financial well-being. A copy of the first few pages oflast year's submitted Memorandum related to my 2003 Evaluation is included as Attachment "B." From the August 25, 2003 date on, this issue was not further addressed until December 8, 2003, when under "Reports", Commissioner Michael S. Blake explained to the City Commission as an "ADD-ON" Agenda Item that he had asked that a Salary Survey be done of area City Clerks, and he provided a spreadsheet for the Mayor and City Commission reflecting research done for the Commission's review. This spreadsheet is included with this Agenda Item as Attachment "C". Attachment "D" is a transcript excerpt from the December 8, 2003 Regular City Commission Meeting. (Note: Portions of the transcript were not included in the official December 8, 2003 Regular Meeting Minutes). CITY OF WINTER SPRINGS CITY COMMISSION REGULAR MEETING - SEPTEMBER 27, 2004 REGULAR AGENDA ITEM 502 PAGE 4 OF 5 PREVIOUS CONSIDERATIONS: As a reminder of related information: The following comments were made during the April 23, 2001 Regular Meeting of the City Commission: "Regarding noticing the City Commission as to when future reviews are due, Deputy Mayor McLeod stated, "I would prefer - that the City Clerk would let us know." Commissioner Blake stated, "One of my pet peeves over the last few years has been this problem of the mmual reviews with all the employees and the timeliness or lack of timeliness." Commissioner Blake further said "I would like to think that we can do a better job starting today, on that issue." Mayor Partyka stated that salaries are a priority, and they have to be discussed on a timely fashion. Mayor Partyka further stated, "If this subject is up for discussion in October it should be to this Commission at least a month before the salaryis due. It's a burden on any employee to wait six (6) months to see if they get a salary or not. That is just good business practice. So, I urge the City' Manager for any future salary increases including his own, that this come up at least one (1), month - prior to when it supposed to be effective." Commissioner Blake agreed and stated, "Hopefully, you are not just talking about the Clerk, or the Manager, but for every employee that we have." The following comments were made during the July 24, 2001 'Workshop of the City Commission: "Members of the Commission asked if this could be put on an Agenda, ahead of the City Clerk's Anniversary date. Manager McLemore said, "Sure." Mayor Partyka added, "Similar to the Manager's salary - a month ahead of time of his contract." The anniversary date for City Clerk, Andrea Lorenzo-Luaces is September 27th. MEMORANDUM TO: Ronald W. McLemore, City,anager Andrea Lorenzo-Luaces, C~ty Clerk Annual Review Questions FROM: SUBJECT: DATE: December 2, 2003 As you requested, the attached information pertains to the "Annual Review Questions" that were provided to me on October 8, 2003 and which should correspond to my overall Annual Performance Evaluation for the period from September 28, 2002 through September 27, 2003. Please note that due to my department's staffing deficiencies (I have been without one staff member since July, and have had to do numerous additional tasks that I previously had my Staff assist with) and the intense workload that I have on a day-to-day basis, my responses to your questions are being turned in approximately seven weeks after receipt of your questions. Additionally, in consideration of the numerous responsibilities that I have on a daily basis, up until now, I could not just set aside the City's business to take care of my personal interests. The attached supporting documentation included with this Memorandum (which in most of the documents is just the first page) should be a reminder of just some of the many contributions that I have made over this past year as I continue to serve the City Commission and the City of Winter Springs. Again, t wanted to remind you that the Office of the City Clerk is the one Department in the City that is in demand by every other Department, almost every day - in that my Staff and I maintain numerous types of documents needed by all: Agenda Items, Bids, Contracts, Minutes, Ordinances, Resolutions - just to name a few. Thus the constant demands on my time, and my Staff's time is significantly greater than what other departments experience. Attachments COPY: Mayor And City Commission Give me a brief assessment of your accomplishments for the past year. The following information covers the period from September 28, 2002 through September 27,2003: ACCOMPLISHMENTS: 1) Noticing Of City Commission Meetings: Numerous City Commission AgendaS (including Amended, Revised, and Cancelled) were posted for City Commission Meetings, including the numerous actions involved with the noticing/posting of each individual City Comniission Meeting Agenda. 2) Coordination Of City Commission Meetings: The City Clerk and Staff were responsible for the coordination of City Commission Meetings held from. October 2002 through September 2003, including Regular City Commission Meetings, Special City Commission Meetings, City Commission Workshops and others. (please remember that numerous details need to be done in preparation for each City Commission Meeting, inciuding the compilation and distribution of City Commission Agenda Packets.) 3) Noticing Of Advisory Board And Committee Meetings: Numerous Advisory Board and Committee Meeting Agendas (including Amended, Revised, Postponed, and Cancelled) were posted for Advisory Board and Committee Meetings, including the numerous actions involved with the noticing/posting of each individual Advisory Boards and Committee Meeting Agenda. . 4) Election/Inauguration Ceremonies: Through early November 2002 numerous details related to the November 2002 General . Election were handled in coordination with the Supervisor of Elections Office, including full compliance with the Florida Statutes; and the publishing of numerous newspaper advertisements to meet legal requirements. In December' 2002, I coordinated numerous details involved with the City's latest successful Inauguration Ceremonies for Mayor John F. Bush, Commissioner Michael S. Blake, and Commissioner Sally McGinnis. 5) Public Records Requests: Numerous Public Records Requests have been filed with my Department and completed during this past year. SEPTEMBER 28, 2002 - SEPTEMBER 27, 2003 PAGE20F3 6) Code Of Ordinances: In June 2003, the City of Winter Springs received the third supplement to the City's new Code of Ordinances. This supplement was provided to all individuals who hold a copy of the Code of Ordinances. In August of 2003, the documents related to the fourth supplement to the City of Winter Springs' Code of Ordinances was submitted to the Municipal Code Corporation for codification. The fourth supplement is expected later in 2003. 7) Records Management Program: This year, 900+ Boxes/Reports of "Approved" City documents were picked up by "Accurate Paper Recycling, Inc." for official Disposition. As Records Management Liaison Officer (RMLO), I have also assisted with a number of questions from other Departments dealing with Records. 8). Employee Recognition Program: The City's Enip10yee Recognition Program is continuing to work well, and awards continue to be given to employees. The Office of the City Clerk worked with City Manager Ronald W. McLemore on providing a letter to every employee being presented with an Employee Recognition Award at City Commission Meeting(s) and coordinated the participation of the Mayor and the City Commission. This program continues to show City employees that their service is of great importance to the City. I have been and continue to work with the Vendor on keeping this program on track. 9) Advisory Board And Committee Appreciation Dinner: A very successful Advisory Board and Committee Appreciation Dinner was organized and held in August 2003 at the Winter Springs Golf Club, complete with a "You're a Star" theme. All of the Advisory Board and Committee Members were presented with a (3rd in a series) commemorative marble gift. This gift depicted a Town Square currently under construction in the City's new Town Center. As you know, this type of a gift allows us to showcase portions of the Town Center as it grows - for events and years to come. ANDREA LORENZO-LUACES, CMC CITY CLERK "GIVE ME A BRIEF ASSESSMENT..." At the request of the City Commission, I put together a matrix - entitled City Commission Masterlist and update it with information from City Commission Meetings. Also at the request. of the City Commission, I handle Advisory Board/Committee Attendance statistics. Commissioner Blake stated, 'As everyone will recall, Andrea's Anniversary Date was, I believe, September - 2ih, the 28th would start the new year; and as of yet, we have not had' her review, that is more than two' (2) month past that about 18 percent of the year, and there are a variety of reasons why that hasn't happened. I understand - everybody should have received a copy of her responses to the Manager's standard questions. I. know she sent an email early in the week. I had asked Andrea to have her staff contact cities here in the county and others that are of the same population band that we are and that is what I have passed oll;t to you - this. document was prepared by the Deputy City Clerks and you can see the questions that were asked for each one of them. Also, reviewing the last Cody Study, for the City Clerks, there was a study done in October of '01 and October of '02. There was not a study done in October of '03. As you can see that the salary ranges for the Clerk's position at the '02 study levei were $42,000.00 based, and about $61,000.00 on the top end. Now the Cody Study is done I think somewhat differently than the data that you have before. I think if you go across that we can see that there are a variety of cities nearby that - some that have Clerk's that I am familiar with and there may be Clerks that you are familiar with too; and some Clerk's that you may know what their level of service is, what their level of expertise is - you can see what' their degrees are, what their professional designations are, and come to some conclusion over what we should do with Andrea this year for her Review." With discussion, Commissioner Edward Martinez, Jr. remarked that "The City Clerk is appointed by the. City Commission and can only be fired by the City Commission; that the City Clerk is a unique position, similar to that. of the City Manager and the City Attorney and that the City Clerk .should be considered Management, even though she is under the direct supervision of the City Manager, she is responsible for this Commi$sion, and only this Commission can fire her with four (4) votes, and I said then and I feel I am of the belief that she should be considered Management and not the same of an average . . employee and be given raises similar to those the City Manager receives, and not similar to those that the support staffreceives. And I think we have to bring this to a head sooner than later and decide if that is what we want or if we want to continue along what has been established up to now.',' Mayor Bush stated, "I agree with Commissioner Martinez in the position - her position is created by Charter, just as the Manager's is and the Attorney's; but yet she is not looked upon in that same vein - I think - in light of what our Charter said, I think that we should be treating - the position differently, the way we look at it. I agree with you in terms of the salary. I think the salary is the purview of the Commission - but more so - like we , do for the Manager and like we do with the Attorney." , Commissioner Martinez added, "Mayor, we have never have had, and I don't think we - will ever hav~ a City Clerk of the quality of Andrea Lorenzo-Luaces." Mayor Bush noted, "She has done a great job, there is no question about that." Commissioner Blake then 'stated, "In some of my activities with the League of Cities, with the Tri-County League of Cities, I have had an opportunity to work with not just several, I think, but many of the City Clerks here in the Tri-County area that being Seminole, Orange and Osceola County; and also of course, I have had an opportunity to interact with their Commissioners or Council as well" and even some of the City Manager's and have been able to have some level of first-hand experience as well as input with the Jobs that they are doing as well, and as I look across this study here and the salary, I thin of a few individuals who really, stick out. One is probably the Clerk in Winter Park, Cindy Bonham who does an excellent job 'with them. I have worked with them on a few other different types of issues, not City related as well, and found her to be quite professional. As good as she is, I will tell you that I don't think she has the level of expertise or dedication that Andrea has. Andrea also is serving as a Chairmanship position on the State Clerk's Board and I have had an opportunity to work with the - sort of the Executive Director if you will, of that organization and they have been very impressed with Andrea's abilities there. She has a degree - most other Clerk's do not have a degi'ee. She is not a Secretary. Her department is a department and she runs a department that is clearly liable for many of the legal issues that we have in terms of records, adverting requirements, keeping us informed, - they are the "Go-To" team in the City in terms of the administration that we see and I think that we need to look at it as such.'" , Discussion, "I WOULD LIKE TO MAKE A PROPOSAL THAT WE SET HER SALARY AT $57,000.00" AND \VHATEVER THAT COMES OUT TO BE, THAT WOULD COME OUT TO BE - THAT WOULD PUT HER STILL BELOW MOST OF THE CITIES AROUND US - WE HAVE ALREADY AGREED I THINK, THAT THEIR PEOPLE ARE NOT AS COI\fPETENT AS ANDREA IS." MOTION BY DEPUTY MAYOR MILLER. MOTION DIED FOR LACK OF A SECOND. With further discussion, Commissioner Blake said, "Taking this another step farther then, I have looked at the Cody figures from the previous two (2) years, and looked at other pay raises - I have an entire sheet here for the city that - and of the departments, looked at other department heads - where everybody sort of fits in.
