Jff /Dept. /ff REQUEST: Community Development Department requesting the City Commission consider and approve a final engineering/site plan with its associated aesthetic review for a 4,800 square foot transmission shop on a 1.589 acre tract along U.S. 17 - 92, north of Boat Lake and south of Shepard Road (more specifically, just north of Cycle Riders and a group of small businesses, including Brucato's Window Tinting, Kids Furniture Gallery, Boxes to Go, and a print shop - the site is immediately south of Five Points Motors), PURPOSE: The purpose of this Agenda Item is to request that the City Commission approve a final engineering/site plan and aesthetic review for Apex Transmission on this 1.589-acre site. The site has an Industrial Future Land Use designation and is within the C-2 Commercial zoning district. APPLICABLE REGULATIONS: Chapter 5, City Code. Chapter 9, City Code. Chapter 16, City Code. Chapter 20, City Code. Ordinance No. 2003-43 CONSIDERATIONS: Site - The presently vacant wooded site along the east side of US 17-92 is located within a corridor consisting largely of highway commercial type uses, although there is also a church within close proximity - on the opposite side of 17-92. The P & Z Board and City Commission have considered this general area of the City for inclusion into the newly adopted C-3 "Highway 17-92 Commercial" District (adopted 7/12/04). Actual rezoning has not yet occurred. There are no wetland, floodplain, specimen tree, or listed species issues associated with this site. The survey depicts 2 invasive Chinaberry trees, which must be removed or exterminated during site development. The tree protection barricade detail in the plans must be revised before the pre- construction conference and the subsequent commencement of site work. October 25, 2004 Regular Item 500 Page 2 of3 No traffic study was required for this use at this site due to the relatively low volume of traffic associated with a transmission repair shop (Trip Generation. ih Ed.. Washington, D.C., Institute of Traffic Engineers, 2003, Volume 3 of3, pages1781-1786). A 20 foot wide cross access-easement (as required by the Comprehensive Plan) is proposed to allow eventual connection ofthe properties to the north and south as they redevelop. The cross-access easement must be recorded before a certificate of occupancy is issued for the building. A monument sign is depicted in the cross-access easement. The applicant should consider that when the property to the north redevelops, this sign must be relocated at the owner's expense (perhaps another sign location should be considered). Aesthetic Review - The applicant's submittal includes a black and white rendering of how the shop will look from 17-92 and the adjacent property to the south. The shop is proposed to be a 4,800 square foot type IV construction metal and concrete building, which will include a 400 square foot office, 4 bays, and a 1,200 square foot storage area. The building will be sprinkled for fire protection, A color pallet for the building and awning are also provided. The proposed building and site appear to fit in harmony with the established character of surrounding buildings in this segment ofthe 17-92. The site is not within either of the SR 434 overlay districts or within the Town Center. A dumpster pad enclosure is depicted on the site plan, at the eastern end of the vehicle accommodation area. The enclosure must meet the requirements set forth in Section 9-281 of the City Code. Signage was not provided and therefore must be approved separately, before a sign permit may be issued, FINDINGS: 1. The proposed final engineering/site plan is consistent with the City's Comprehensive Plan and Code of Ordinances, except as noted below: A. before being permitted for construction, the plan must be revised to require the proper tree protection barricades (e.g. no rope) and B. trees listed in Chapter 5 of the City Code as "Undesirable Trees" (see Appendix A of Chapter 5) must be removed during site work, pursuant to Subsection 5-9 (d) (2) thru (4) ofthe City Code. 2. A cross-access easement, as depicted on the site plan, must be recorded prior to a certificate of occupancy being issued for the building. PLANNING & ZONING BOARD ACTION: At its regularly scheduled meeting of October 6, 2004, the Planning and Zoning Board recommended approval of the site plan. RECOMMENDATION: Staff and the Planning and Zoning Board recommend that the City Commission approve the attached final engineering/site development plan subject to the conditions set forth in the "Findings" section, above.
