PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding Phase II of Tuskawilla Trials to be built in substantial accordance with the Final Engineering per Section 9-178 and to accept the potable water and sanitary sewer infrastructure for ownership and maintenance in order for Certificates of Occupancy to be issued. This site is located on the west side of Tuskawilla Road, between S.R. 434 and Natures Way. APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. ( c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. April 12,2004 Consent Agenda Item 205 Page 2 FINDINGS: 1) All City agencies have found the work to be acceptable. 2) The conditions of the Developer Agreement have been met. The City agreed to contribute $55,057.00 towards the water and sewer construction costs which benefit off site undeveloped properties. The final quantities increased this cost by $632.00 to $55,689.00. This amount would be conveyed to the developer within 15 days of receipt of the bill of sale and easements. 3) The potable water and sanitary sewer improvements are to be dedicated to the City for ownership and maintenance and separate 2-year maintenance bond. 4) During construction, it was alleged by a resident of Nature's Way, Ms. Armiger, that the contractor removed trees in the fifteen foot buffer. Mr. Mingea has verified that this was not the case. However, the roadway portion of Nature's Way was actually encroaching upon the Tuskawilla Trails property. When it was realigned, the 15' buffer that formally contained the road lacked any vegetation. Mr. Mingea worked with the developer to provide additional landscaping that will provide a buffer when they mature in a few years. RECOMMENDA TION: Staff recommends that the City Commission validate the staff recommendation finding Tuskawilla Trails Phase II built in substantial accordance with the Final Engineering per Section 9-178, accept the potable water and sanitary sewer infrastructure for ownership and maintenance contingent upon receipt of the easements, and approve a $632 increase in the utility reimbursement to $55,689.
