REQUEST: The City Attorney requests the City Commission consider a Resolution related to the recently designated Travel Reimbursements. PURPOSE: The purpose of this Agenda Item is to ask the City Commission to review and consider approval of the attached Resolution. CONSIDERATIONS: At the September 20, 2004 City Commission Meeting, the City Commission approved new Travel Reimbursement figures. The following is an (Unapproved) Excerpt from the September 20, 2004 City Commission Meeting Mini-Minutes, as it relates to this topic: REGULAR 506. Office Of The Mayor Requests The City Commission Consider Travel Reimbursements. With discussion, Commissioner Blake said, "On the Mileage, that it ought to be at a number that works and why not just adopt what the Federal Government sets on an annual basis." CITY OF WINTER SPRINGS CITY COMMISSION REGULAR MEETING - NOVEMBER 22, 2004 CONSENT AGENDA ITEM 200 PAGE 2 OF 2 Commissioner Blake was asked about the Government's rate and he responded by saying, "37 and a half this year." "I WOULD LIKE TO MAKE A MOTION THAT WE ACCEPT- THE PROPOSED $5.00, $10.00, $15.00 PER DIEM WITH - WHATEVER THE FEDERAL GOVERNMENT'S RATE IS, WHICH I THINK THIS YEAR, ACCORDING TO COMMISSIONER BLAKE IS 37 AND A HALF CENTS AND WHATEVER IT WILL BE IN FUTURE YEARS." MOTION BY DEPUTY MAYOR MILLER. SECONDED BY COMMISSIONER BLAKE. DISCUSSION. COMMISSIONER BLAKE SAID, "THIS WILL BE EFFECTIVE OCTOBER 1sT, 2004?" MAYOR BUSH STATED, "IT WILL BE EFFECTIVE TOMORROW." VOTE: COMMISSIONER BLAKE: AYE DEPUTYMAYORMILLER: AYE COMMISSIONER McGINNIS: AYE COMMISSIONER GILMORE: AYE COMMISSIONER McLEOD: AYE MOTION CARRIED. COMMISSION ACTION: ._):i ,; RESOLUTION NO. 2004-48 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS FLORIDA, ESTABLISHING A PER DIEM TRA VEL RATE FOR MEAL AND MILEAGE REIMBURSEMENTS; PROVIDING FOR SEVERABILITY, REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, CONFORMING AMENDMENTS TO CITY POLICY MANUALS AND AN EFFECTIVE DATE. WHEREAS, pursuant to Section 166.021(1O)(b), Florida Statutes, municipalities are authorized to establish travel and per diem policies contrary to Section 112.061, Florida Statutes; and WHEREAS, the City Commission of the City of Winter Springs. Florida deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. Travel Reimbursements. The City of Winter Springs travel rate for per diem meals and mileage reimbursement will be as follows: A. Meals 1. $ 5.00 Breakfast per diem 2. $10.00 Lunch per diem 3. $15.00 Dinner per diem $30.00 Per day, per diem or actual receipts. B. Mileage. As established by the Internal Revenue Service. Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Conforming Policy Manual Amendments. The City Manager is hereby authorized to amend or supplement any and all City policy manuals to incorporate the travel rates for per diem meals and mileage reimbursement adopted in accordance with this Resolution. Section 6. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida. Ms. Joanne Krebs, 1002 Taproot Drive, Winter Springs, Florida: commented on the results of the recent Oak Forest Straw Ballot. Discussion. Mr. Marshall Allen, 1065 Winter Springs Boulevard, Winter Springs, Florida: spoke in favor of the proposed Assessment. Discussion. Commissioner McLeod spoke for the record that he was in favor of this proposed Assessment. Further discussion. "I WOULD LIKE TO MAKE A MOTION THAT WE ADOPT ITEM '507' WITH THE RECOMMENDED ITEM 'e'."
