HomeMy WebLinkAbout2004 12 13 Consent Item 206 COMMISSION AGENDA ITEM 206 Consent X Information Public Hearing Regular December 13, 2004 Meeting MGR. t2-- /Dept. /~ REQUEST: The Community Development Department requests the City Commission validate the staff recommendation finding Dr. Courtney's office site is built in substantial accordance with the Final Engineering and to accept the pertinent portion of the potable water and sanitary sewer infrastructure for ownership and maintenance. PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding that Dr. Courtney's office site is built in substantial accordance with the Final Engineering per Section 9-178 and to accept the pertinent portion of the potable water and sanitary sewer infrastructure for ownership and maintenance in order for Certificates of Occupancy to be issued. This site is located on the north side of SR 434, on the west side of City Hall. APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. December 13,2004 Consent Agenda Item 206 Page 2 FINDINGS: 1) All City agencies have found the work to be acceptable. 2) The cross access easements and utility easements have been dedicated, as required by the site plan approval conditions. 3) The pertinent portions of the potable water and sanitary sewer improvements are to be dedicated to the City for ownership and maintenance and separate 2-year maintenance bond. RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding that the Dr. Courtney office site is built in substantial accordance with the Final Engineering pursuant to Section 9-178 and accept the pertinent portions of the potable water and sanitary sewer infrastructure for ownership and maintenance, subject to the City Attorney's review of the maintenance bond. ATTACHMENTS: None IMPLEMENTATION: Certificate of Occupancies may be issued after Commission approval. CITY COMMISSION ACTION:
