REQUEST: Commissioner Sally McGinnis requesting the Commission to discuss implementation of the Due Diligence Period for the Affordable Housing Project with Davis Heritage Properties G.P. Holdings, LLC. PURPOSE: The purpose of this Agenda Item is for the Commission to discuss alternative ways for carrying out the due diligence activities related to the Davis Heritage Properties Affordable Housing Project. CONSIDERA TIONS: On May 27, 2003 the City Commission approved an agreement with Davis Heritage Properties G.P. Holdings, LLC to construct an affordable housing project on State Road 434 adjacent to Golf Terrace Apartments contingent upon the results of a 30-day due diligence period. Commissioner McGinnis would like to involve local residents in the process and desires to discuss with the Commission how this could be accomplished. Staff would not have a problem in having a small contingent of local citizens involved in the field trip to the various sites. The Commission could consider appomtmg two or three merchants who would be benefited by the additional retail business that would be generated from the residents of the project, members of the Highlands Homeowners Association Board of Directors, and two or three members of City Boards such as the Planning Commission and Board of Adjustment who live in the area. 060903 _Regular _ F _Due_Diligence_Request Page 2 of2 FUNDING: No additional funding is required for this agenda item. RECOMMENDATIONS: Commissioner McGinnis is recommending the Commission to discuss alternatives for involving local residents in the due diligence process related to the proposed Davis Heritage Properties adjacent to Golf Terrace Apartments. Authorization REQUEST: Community Development Department requesting the City Commission to approve a Master Development Agreement between the City and Davis Heritage Properties G.P. Holdings, LLC. PURPOSE: This agenda item is needed to memorialize the conditions under which the City is willing to participate in two proposed developments in Winter Springs. CONSIDERA TIONS: On March 24 and March 31, 2003 the Commission discussed proposals of Davis Heritage to possibly construct one affordable housing, and one market rate housing project in Winter Springs. Each project will have separate development agreements which will be consistent with the provisions of the Master Development Agreement. FUNDING: Implementation of either project would result in a $100,000 donation to the City. RECOMMENDATIONS: It is recommended that the Commission approve the Master Development Agreement with Davis Heritage G.P. REQUEST: Community Development Department requesting Commission approve a development agreement for a multi-family development on an approximately l5-acre tract located on the north side ofSR 434, between the Winter Springs Golf Club and the Golf Terrace Apartments. PURPOSE: The purpose of this Agenda Item is to request that the Commission approve a development agreement addressing issues and concerns pertinent to developing approximately I5-acres of treed uplands and wetlands, located on the north side of SR 434, into as many as 120 affordable housing apartments. APPLICABLE LAW: Section 166.021, Florida Statutes. (1) As provided in s. 2(b), Art. vrn of the State Constitution, municipalities shall have the government, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal services, and may exercise any power for municipal purposes, except when expressly prohibited by law. (2) "Municipal purpose" means any activity or power which may be exercised by the state or its political subdivisions. 1 May 27, 2003 Regular Item B Page 2 of2 FINDINGS: 1. The development agreement is authorized pursuant to the Municipal Home Rule Powers Act, as provided in s 2(b), Article VIII of the Florida Constitution and Chapter 166, Section 166.021, Florida Statutes. 2. The development agreement is consistent with the City's Comprehensive Plan and Code of Ordinances. 3. The development agreement provides for reasonable use of the subject property, while addressing issues and concerns pertinent to the proposed use of the site. 4. On March 24,2003, the City Commission granted a conditional use for multi-family development of as many as 8.0 dwelling units per acre on the approximately 15 acre site. 5. On March 31, 2003, the City Commission and Davis Heritage agreed to a mutually beneficial financing agreement. CONSIDERA TIONS: On March 24,2003, the City Commission granted a conditional use to allow multi-family development on this site in the C-l zoning district (within the SR 434 Redevelopment District) at a density of as many as 8.0 dwelling units to the acre (120 maximum units). At a special City Commission meeting, March 31,2003, the City Commission and Davis Heritage agreed on a mutually beneficial financing program. The City Attorney stated that a number of issues associated with the proposed development should be addressed formally in a development agreement. A conceptual site plan has been provided, but no site plan review (preliminary or final) has been requested, applied/paid for, or provided. RECOMMENDATION: Staff recommends that the City Commission approve the attached development agreement, subject to payment of the $300 fee.
