(J---( Dept. ~ Authorization REQUEST: The Community Development Department- Planning Division requests that the City Commission consider revising the October 1, 2003 compliance date for dumpsters in place prior to the adoption of Ordinance 2002-13 which established minimum standards for the screening of dumpsters. PURPOSE: This agenda item updates the Commission on the status of notification and subsequent compliance related to Ordinance 2002-13. APPLICABLE LAW AND PUBLIC POLICY: ORDINANCE 2002-13: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA ESTABLISHING MINIMUM STANDARDS FOR SCREENING FROM PUBLIC VIEW NEW AND EXISTING DUMPSTERS; REPEALING WINTER SPRINGS CODE SECTIONS 20-473 (C) AND 20-489 (C) GENERALLY RELATING TO DUMPSTERS ALONG SR 434; PROVISIDING AN IMPLEMENTATION SCHEDULE FOR EXISTING DUMPSTERS; PROVIDING FOR SEVERABILITY; INCORPORATION INTO THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. Section 9-281. (g) All new Dumpsters shall comply with the minimum requirements set forth herein upon the effective date of this Division. All Dumpsters existing on the effective date of this Division shall comply with the minimum requirements set forth herein by October 1, 2003. CHRONOLOGY: May 6, 2002- Initial listing of dumpsters obtained from Florida Recycling Services by Jimette Cook. This listing included business entities but did not include any addresses. 2nd Reading/Adoption of Ordinance 2002-13 Commission discussion re: amending Ordinance 2002-13 Jimette Cook (Code Enforcement) left City of Winter Springs Charles Carrington (Community Dev. Director) left City of Winter Springs Draft letter to property owners prepared (by E. McDonald?) but never sent. Ernest McDonald (Long Range Planner) left City of Winter Springs New expanded listing promised by Jim Brewer of Florida Recycling Services to Michele Kelly (Community Development Dept. Secretary) but never received. May 13, 2002- July 8, 2002- July 19, 2002- July 31, 2002- Aug. 12,2002- Sept. 3, 2002- October 2002- @J 071403 _Regular_D _Dumpster_Compliance Aug.-Dec.2002- January 2003- May 1, 2003- May 2003- Community Development Department staff shortage Eloise Sahlstrom (Senior Planner) began with the City of Winter Springs Florida Recycling Services (FRS) created new position of Commercial Accounts Executive (Linda Glass) who has provided the City with an expanded listing to include addresses. K.ip Lockcuff (Interim Community Development Director) obtained expanded listing from Florida Recycling Services and asked Eloise SaWstrom, Senior Planner to verify non-compliance. Eloise Sahlstrom visually surveyed dumpsters located at the addresses included on the expanded listing for compliance and prepared data base for notification of business & property owners June 2003- CONSIDERATIONS: . Community Development Department has been asked to follow up with this Ordinance. . Due to Staff shortages and transition of new staff, the Community Development Department has not previously had time to properly follow up with notification. . To date, no letters have been mailed to affected pre-existing businesses/property owners notifying them of the ordinance or the upcoming compliance date. . Having an accurate data base to confum location and non-compliance of existing dumpsters with the Ordinance was necessary prior to being able to send letters to affected businesses and property owners. . To date, approximately 140 businesses have been inventoried into the data base. Approximately 85% of those have been photographed and reviewed for compliance. . Additional data is required beyond the current data which includes the dumpster location. Business mailing addresses must be obtained and confumed. Staff will then prepare and send certified letters to the affected entities. Staff expects to complete these tasks during July. . There is not adequate time before the October 1, 2003 deadline for businesses to have time to comply. Businesses need amply time to budget for this expense, time to obtain engineering drawings and permit, and time to secure the services of a contractor. RECOMMENDATION: The Community Development Dept. recommends that the Commission extend the effective date of compliance for existing dumpsters from October 1, 2003 to October 1, 2004, and to direct the City Attorney to amend Ordinance 2002-13 accordingly. Because of the volume of businesses involved and cost for a business to become compliant with Ordinance 2002-13, the Community Development Dept. recommends that the Commission waive the Permit Fee generally collected by the City for construction of a dumpster enclosure in cases where there is an existing dumpster being brought into compliance with the Code prior to the amended effective date.
