HomeMy WebLinkAbout2004 02 09 Regular 502 COMMISSION AGENDA ITEM[ 502 Consent Informational Public Hearine Regular X February 9, 2004 Meeting Mg[. r / Authorization Dept. )/7 REQUEST: The Community Development Department- Planning Division and Building Inspection Division requests that the City Commission adopt by Resolution (as referenced in Ordinance 2003-40), revised engineering drawings which adhere to the Florida Building Code and which will be supplied by the City to those entities requesting them and who have an existing dumpster that must come into compliance with Section 9-281 of the Code. PURPOSE: Adoption of the attached revised engineering drawings (which allow steel as a alternative to aluminum and allow an existing asphalt slab as a substitute for a concrete slab) allow the City to supply engineering drawings which have been approved by the Commission as acceptable alternatives for meeting the dumpster screening requirements for those with existing dumpsters that must come into comp:liance with the Code. APPLICABLE LAW AND PUBLIC POLICY: Florida Municipal Home, Rule Powers Act City of Winter Springs' Code, Section 9-281. CHRONOLOGY: May 13,2002- 2nd Reading/Adoption of Ordinance 2002-13 which established dumpster screening standards Aug. 11, 2003- 2nd Reading/Adoption of Ordinance 2003-26 which amended the compliance date for existing dumpsters Nov. 11,2003- 2nd Reading/Adoption of Ordinance 2003-39 which allows existing masonry enclosures less than 6' in height to be grandfathered as long as they meet the. @) 020904 Regular Agenda Item 502 other Code requirements and fully screen the enclosed dumpster Jan. 26, 2004- 2nd Reading of Ordinance 2003-40 which allows vinyl as an acceptable screening material; which exempts existing dumpsters from compliance with setback regulations generally applied to accessory buildings and structures; and which references City-adopted engineering drawings which meet the minimum screening requirements. CONSIDERATIONS: . Standard engineering drawings provided by the City will help to alleviate some of the expense to comply with the new regulations. · As directed by the City Commission on January 26, 2004, revisions have been made on the drawings to clarify the issues discussed. . In particular, the two alternatives previously approved by the Commission have been revised to allow steel as a alternative to aluminum and allow an existing asphalt slab as a substitute for a concrete slab . The City Engineer has provided the following explanation: ./ The live load requirement on the gate does not change with different materials. The dead load and material strength does change with the type of material used. The gate fabricator will take the live load requirement, the strength of the material used and the dead load ofthe gate and will design/build the gate in accordance with the loads specified and the strength of the material that he is using. ./ The slab is not part of the wind load requirement and any base stabilization can be used that is acceptable to the City. The drawing has been modified to make this clear. Also there is so little uplift generated on a fence that it is negligible. The force that must be resisted by a fence during wind loading is an overturning moment. The forces are almost completely horizontal on the footing/embedment STAFF RECOMMENDATION: Staff recommends that the City Commission adopt by Resolution (as referenced in Ordinance 2003-40), revised engineering drawings which adhere to the Florida Building Code and which will be made available to parties whose dumpsters must be brought into compliance with Section 9-281 of the Code. ATTACHMENTS: A- Resolution 2004-06, Adopting Engineering Drawings B- Revised Engineering Drawings COMMISSION AClLION: 020904 Regular Agenda Item 502 ATTACHMENT A Resolution 2004-06 o RESOLUTION NO. 2004-06 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, APPROVING A SET OF PRE-APPROVED DUMPSTER ENCLOSURE PLANS AND SPECIFICATIONS PURSUANT TO SECTION 9-281(7) OF THE WINTER SPRINGS CODE; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City retained CPH Engineering to prepare a standard set of engineering plans for a dumpster that will satisfy the City's requirements under Section 9-281 of the Winter Springs Code; and WHEREAS, Section 9-281(7) ofthe Winter Springs Code authorizes the City Commission to adopt pre-approved plans and specifications for a dumpster enclosure that can be used by the public to satisfy the City's Code requirements; and WHEREAS, it is the intent and purpose of this Resolution to pre-approve one standard set of engineering plans for a dumpster enclosure for use by the public in the City of Winter Springs; and WHEREAS, other engineering plans for a dumpster enclosure may be approved by the City on a case-by-case basis; and WHEREAS, the Ci~y Commission deems it to be in the best interests ofthe health, safety, and welfare of the citizens of Winter Springs to approve one standard set of engineering plans for a dumpster enclosure for use by the public. NOW, THEREFOR.E, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this reference and are deemed a material part of this Resolution. Section 2. Approved Dumpster Enclosure Plans. The City Commission hereby adopts the dumpster enclosure engineering plans prepared by CPH Engineering and elated February 9,2004. Said plans are attached hereto as Exhibit "A," and fully incorporated herein by this reference. Said plans may be used by the public to satisfy the requirements of Section 9-281 of the Winter Springs Code. City of Winter Springs Resolution No. 2004-06 Page 1 of 2 Section 3. Repeal of ))rior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity ofthe remaining portion hereto. Section S. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
