L Monday, April 14, 2003 To: City Commissioners, City Manager, and Mayor Subject: Cheoy Lee Circle Status Update & Pending Issues We greatly appreciate the brick wall that the developer has built as a buffer. We also are grateful to the Commissioners for agreeing to pay $16,000 to Attorney Bernie Martin for legal and replat expenses. Following is a replat status report and a list of pending issues: Replat Update: I talked with Michelle Corn, Bernie's assistant, on 4/11/03. She said she has received everything she needs from the homeowners and is hoping to send the legal papers next week to the various mortgage companies for their approval. This will probably take 4-6 weeks before they are all returned. Then Bernie will submit the papers to the city to replat. There are still a few questions Bernie's office is checking into, but Michelle anticipates that the paper work will be ready to be mailed to the mortgage companies this week. Issues Still Pending: 1. Wall -making it a minimum of 6 feet high on both sides (especially from 636 Cheoy Lee Circle to the west end of the wall on TOP's side). 2. Wall -extending the partial wall behind Enon Winkler's house (646), so that it runs completely behind his property. Enon has been talking with Sandy Bierly about possible solutions. 3. Trees -Last Saturday, oak trees were planted on TOP's side of the wall as well as three trees on our side of the wall on the east end. • Except for one location (Tackaberry's 634), they were planted every 45 feet as instructed by the Commission. Tackaberry's (634) have arranged with Sandy Bierly to be compensated for the cost of one tree. • Other owners have concerns as well, noting that some of the trees are too close to the wall, while others are too close to existing trees. • Now that TOP has been graded and elevated, it is evident that there is a greater need for more trees or hedges to help buffer the view, the noise, and the light. This is especially true for the eastern half of the wall near Tuskawilla Road. (See Item 9 below) • Also, it should be verified that the dumpster on the west end is properly buffered with vegetation, as was recently requested by Hudtwalcker's (638) and agreed upon at one of the Commissioners meetings. (See Item 7 below) 4. Lights - We would like to see the light plan, as we are concerned about the height, brightness, and effectiveness of the light shielding. 5. Drainage - We are greatly concerned about the drainage situation on our side of the wall. Whenever we have a hard rain, we have a river running all along the length of the wall (E-W) on our side. We also have several standing lakes, which we did not have before. On the west end there was severe erosion along the wall. We need to have some advise as to what can be done and who is responsible for doing it and paying for it. 6. Wall -There is a hole in the wall behind 634 Cheoy Lee Circle (Tackabenry's) which was constructed as a "bridge" over a tree's roots. Unfortunately, the tree still died and was removed by the developer. Now there remains a hole, which should be filled in with something more substantial than the dirt and the sod that was placed there. 7. Dumpsters -The dumpster on the east end has been moved to the north near the entrance. At one of the Commissioners meetings, it was agreed that the dumpster on the west end in the turn-around (behind Hans r H. house) was to be shielded substantially by trees and vegetation so that it will not be visible from Hans' house. (More than one tree every 45 feet) This is just a reminder. 8. Handicap signs - If possible, could they be lowered 1-2 feet, as they are very visible above our walls. 9. Buffer -Because it seems that the elevation of the buildings has been greatly raised, there is a need for more buffering than originally required, especially on the eastern end of the wall. Ideally, the wall should be raised 3-4 feet. If that is not possible, we would like to have more hedges or trees to fill in the void areas. 10. We also are concerned about the strength of the wall. Who will be responsible for the upkeep and maintenance of the wall? Will TOP have a mandatory business owners association responsible for the wall's maintenance and the trinuning of their oak trees?
