Authorization REQUEST: The Community Development Department recommends that the City Commission find that the existing subdivision entrance features at the northeast and northwest comers of the intersection of Charles Street and SR 434 are in the public right-of-way, that they are a nuisance, and authorize their removal for public safety issues. PURPOSE: The purpose of this agenda item is for the City Commission to find that the two entrance features obstruct visibility at the comer of Charles Street and SR 434 and authorize their removal. This would allow the City to authorize the Kinder Kampus daycare center to relocate the existing sign to a more appropriate location. APPLICABLE LAW AND PUBLIC POLICY: Sec. 17-30 Obstruction to vision at street intersection. CONSIDERATIONS: At the regular City Commission meeting of December 8,2003, the City Commission voted to table the Kinder Kampus sign variance request. The City Manager stated that staff would address this issue at the first meeting in January 2004. The subject site is converted residence on a comer lot in the SR 434 Redevelopment District. The combination of the existing maple tree, lot configuration, and the presence of the two subdivision entrance features at the intersection of Charles Street and SR 434 made determining the most appropriate place to relocate a new monument sign difficult. The Public Works Director has determined that the features are in the public right-of-way and he cannot determine who has been maintaining them through the years. After the City Manager and staff inspected the site, it became obvious that removing the existing entrance features from the pubic right-of-way would make the intersection safer and make determining an appropriate sign location much easier. January 12, 2004 REGULAR ITEM 514 Page 2 STAFF RECOMMENDATION: Staff recommends the City Commission find the two subdivision entrance features in the public right-of-way at the intersection of Charles Street and SR 434 (northeast and northwest corners) are a nuisance and authorize their removal.
