HomeMy WebLinkAbout2003 09 08 Regular A Specimen Tree Removal COMMISSION AGENDA ITEM A CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X September 8, 2003 Meeting Mgr J?--I/~t Authorization REQUEST: The Community Development Department Arborist recommends the City Commission consider the request of Jackie Melley to remove 1 specimen long-leaf pine tree, approximately 26 inches in diameter, from the east side of the lot, in order to protect the home structure. PURPOSE: The purpose of this agenda item is for the City Commission to consider Ms. Melley's request to remove a specimen (approximately 26 inch diameter) long-leaf pine tree. The specimen tree is located on the east side of the lot. The applicant states that the tree roots are damaged by the brick wall and is a danger in high wind conditions. APPLICABLE LAW AND PUBLIC POLICY: On April 8, 2002, Chapter 5 of the City Code was repealed and replaced with Ordinance No. 2002-08 (pertinent sections enclosed as attachments). Sec. 5-2. Intent and Purpose. Sec. 5-3. Definitions. Sec. 5-4. Permit Required for Tree Removal and Land Clearing; Separate Violations Criteria. Sec. 5-8. Specimen or Historic Trees. Sec. 5-16. Waivers and Appeals. September 8, 2003 REGULAR AGENDA ITEM A Page 2 CONSIDERATIONS: Ms. Melley's requests to remove one specimen pine tree from her lot, as defined in the amended (Ordinance No. 2002 - 08) Chapter 5 of the City Code. The applicant has stated that she wishes to remove the tree in order to protect the house. The specimen tree in question is located adjacent to the brick wall. The amended arbor code requires the specimen tree to be removed only under "extraordinary circumstances and hardships and only by final permit approved by the City Commission." Staff finds that the applicant's desire to remove the hazardous tree does constitute "extraordinary circumstances and hardships." STAFF RECOMMENDATION: Staff recommends that the City Commission approve the request to remove the specimen tree from 969 Troon Trace (Greenbriar) on the grounds that the necessary "extraordinary circumstances and hardships" have been demonstrated.
