HomeMy WebLinkAbout2003 09 08 Public Hearings A Resolution 2003-33 Tentative Operating Millage Rate for FY 2003-2004 FIRST ITEM OF THE EVENING COMMISSION AGENDA ITEM A CONSENT INFORMATIONAL PUBLIC HEARING XX REGULAR MGR jJ !IlEPT.~ Authorization September 8, 2003 Meeting PUBLICLY ANNOUNCE THE REQUEST REQUEST: The City Manager is requesting that the City Commission hold a Public Hearing relative to the approval of Resolution No. 2003-33, which establishes the Tentative Operating Millage Rate for Fiscal Year 2003-2004 for the City of Winter Springs at 4.4196 mills which is 12.28% above the rolled-back rate of 3.9362 and the Tentative Voted Debt Service Millage Rate for Fiscal Year 2003-2004 for the City of Winter Springs at .2500. PURPOSE: The purpose of this agenda item is to have the Commission approve the first reading of Resolution No. 2003-33, otherwise known as the Tentative Millage Rates for Fiscal Year 2003-2004. CONSIDERA TIONS: Resolution No. 2003-33 - Tentative Millage · Millage Increase. The Current Operating Millage for FY 2002-2003 is 4.1658. The Tentative Operating Millage Rate for FY 2003-2004 is proposed at 4.4196, an increase of .2538 mills. · The Tentative Voted Debt Service Millage Rate for FY 2003-2004 is set at .2500. · The Rolled-Back rate is 3.9362. The Tentative Operating Millage Rate is 12.28% above the Rolled-Back rate. · The increase in the Tentative Operating Millage rate to 4.4196 over the current operating millage rate will result in an increase in Ad Valorem Revenues to the City in the approximate amount of $293,000. · Any changes or deletions to the Tentative Budget (and the Tentative Millage Rates) requested by the City Commission at this meeting will be reflected in the second reading (Final Millage and Budget Hearing) scheduled for September 22, 2003. · The Commission can further amend the millage rates and the budget at the second reading. · If the City Commission elected to fund the net capital expenditures in the amount of $591,299 out of fund balance (per the General Fund Recap Sheet at page B-1), then the City could decrease the operating mill rate to 4.1056. This would result in a 4.30% increase above the rolled-back rate of 3 .9362. RECOMMENDATION: Tentative Millage Rates · The Commission adopt Resolution No. 2003-33 establishing the Tentative Operating Millage Rate at 4.4196 for Fiscal Year 2003-2004 and the Tentative Voted Debt Service Millage rate at .2500 for Fiscal Year 2003-2004. IMPLEMENTATION SCHEDULE: Upon approval and adoption of Resolution No. 2003-33 at the second reading the Millage Rates for Fiscal Year 2003 - 2004 would be implemented and become effective on October 1,2003. ATT ACHMENTS: · Resolution No. 2003-33 COMMISSION ACTION: RESOLUTION NO. 2003-33 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, ADOPTING THE TENTATIVE OPERATING MILLAGE RATE FOR THE CITY OF WINTER SPRINGS FOR THE FISCAL YEAR COMMENCING ON OCTOBER 1, 2003 AND ENDING ON SEPTEMBER 30, 2004; ANNOUNCING THE PERCENTAGE BY WHICH THE TENTATIVE OPERATING MILLAGE RATE EXCEEDS THE . ROLLED-BACK RATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of Winter Springs has held a public hearing on the tentative millage rate pursuant to Florida Statute 200.065, Subparagraph (c); and WHEREAS, the City Commission of Winter Springs desires to adopt the tentative operating millage rate and publicly announce their percentage change by which the tentative proposed operating millage rate exceeds the rolled-back rate, and adopt the tentative voted debt service rate. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, AS FOLLOWS: Section 1. The City Commission adopts its tentative operating millage rate of 4.4196 mills and its tentative voted debt service millage rate of .2500 mills for the fiscal year commencing October 1, 2003 and ending September 30, 2004. Section 2. The tentative millage rate of 4.4196 mills is more than the computed rolled-back rate of 3.9362 by 12.28%. Section 3. Within fifteen (15) days of the date of this Resolution, the City Clerk shall advertise in a newspaper of general circulation its intent to finally adopt the millage rates and budget and shall hold a public hearing to finalize the budget and adopt the millage rates not less than two (2) days or more than five (5) days after the date of the advertisement is first published. Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or portion of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 6. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida. ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regularly scheduled Public Hearing assembled on this 8th day of September 2003. John F.
