HomeMy WebLinkAbout2005 11 28 Regular 500 COMMISSION AGENDA ITEM 500 CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X November 28, 2005 Meeting REQUEST: The Community Development Department, City Arborist, recommends the City Commission consider the request of Mr. Jason Rush, of 101 St. Johns Landing, to remove (4) specimen trees located on his residential lot. PURPOSE: The purpose of this agenda item is to request the City Commission consider a request from Mr. Jason Rush to remove (4) specimen trees from his lot. CONSIDERATION: The specimen trees are located on the new building lot and are within the building pad area for the new home. Specimen tree sizes for removal are as follows: (1) Live oak tree (31 "), (1) Live oak tree (32"), (1) Live oak tree (38"), and (1) Live oak tree (39"). A few of these trees have sustained damages from the recent hurricanes and one is located within a few feet of a large sabal palm. APPLICABLE LAW AND PUBLIC POLICY On October 13,2003, Chapter 5 of the City Code was repealed and replaced with Ordinance No. 2003-22 (pertinent sections enclosed as attachments). Sec. 5-2. FINDINGS: 1) Section 5-8.b of the Arbor Ordinance provides that a specimen tree shall not be removed except for extraordinary circumstances and hardships and only by final permit approval by the City Commission. 2) Upon a visit to the site by the City Arborist, the proximity of two of the specimen trees was noted to be within 5' of the new home. 3) Without removal, there will be severe damage to the root systems of these trees during construction of the new home location. 4) An interview with the owner / builder discussing different layouts of the home yielded no other reasonable alternatives with the existing property set-backs and easements. STAFF RECOMMENDATION: Staff recommends that the City Commission approve Mr. Jason Rush's request to remove (4) specimen trees located on his residential property for the construction of the new home. It shall be the responsibility of Jdov-oJ.opel' or applicant property owner and their agents to ensure that any Tree shown on the Tree inventory for which a Tree Removal permit has not been obtained is to be'protect~d. The property owner shall guarantee survival (If retained trees and Rep laceme~t Trees for one (l) year from completion of pennitted construction, unless a greater time period is required by development agreement. If a retained or replaoement Tree dies during that time period, the property owner shall replace the Tree in aocordanoe with a remedial aotion apprqved under ~ 5-17 of this Chapter. .
