The Community Development Department is requesting the City Commission " delay additional planning for the installation of canopy trees in the SR 434 medians between Central Winds Park and the Central Florida Greenway until the City Commission identifies a funding source for the project. PURPOSE: This Agenda Item is needed to request the City Commission to delay additional Staff action, which includes contracting with CPH Engineers for professional services required to provide plans and submittals to the Florida Department of Transportation (FDOT) regarding the installation of curb, gutter, and canopy trees in the SR 434 medians until a funding source is available. CONSIDERATIONS: On February 14,2005, Staff presented Agenda Item 500 to the City Commission regarding Florida Department of Transportation (FDOT) requirements for installing trees in the SR 434 medians between Central Winds Park and the Central Florida Greenway. The Commission requested Staff to return with plans for installation of median trees from the entrance of Central Winds Park to the Cross Seminole Trail Bridge, with curb and gutter installed completely throughout these areas; an FDOT requirement. Additionally, Staff was requested to include 'Oasis' areas in 200' segments from the Cross Seminole Trail Bridge to the Central Florida Greenway; totaling 1600' in length. The Commission agreed the project should cost approximately $670,000 to complete, could be budgeted over several years and may utilize a potential special funding source. Since the installation of canopy trees on SR434 will require significant modification to the medians and storm water collection systems to meet FDOT standards, it is necessary that Staff obtain the assistance of an engineering firm. CPH Engineers has kindly provided an agreement for the professional services necessary for project design and plans submittal to FDOT and for a potential grant. Staff has contacted FDOT regarding alternatives for implementing this project and found that portions of the project would potentially be eligible for Grant Funding under the FDOT Highway Beautification Grant Program; up to $300,000 (a grant match would be required). Current estimated costs for this project are as follows: 6,700 Linear Feet @ $110.00 per Linear Foot Curbing and Gutter Package Fill, Preparation, and Sod Relocation of Existing Trees 10% Contingency Total Survey, Design, and Plans Irrigation System New Tree Installation $ 737.000 Options: 1. Do no additional work on the project until a funding source is identified. 2. Authorize Staff to contract with CPH Engineering in the amount of $32,850 for the engineering and design work necessary for submittal to FDOT, authorize Staff to pursue Grant Reimbursement Funding under the FDOT Highway Beautification Grant Program, and determine a funding source if the grant is approved in FY '07. FUNDING: Funding for this project has not been determined as the Commission chose not to allocate funds in the FY '06 budget. Up to $300,000 in grant reimbursement funding could potentially be available from the 2007 FDOT Highway Beautification Grant Program. RECOMMENDATION: Staff recommends the City Commission approve Option 1, delaying execution of Attachment # 2, Amendment 84 to the agreement dated November 27, 1984, SR434 Median Landscape between the City of Winter Springs and CPH Engineers, postponing the expenditure of $32,850 for engineering and design services as outlined in Section 3 (Scope of Services) and delaying additional action by Staffuntil the Commission identifies a funding source for this project. 112805_ COMM _Regular _504 _SR434_ Median_ Tree_Planting IMPLEMENT A TION SCHEDULE: hnplementation of this project would be determined at a future date based upon available funding. The median area from the entrance of the CWP to the Cross Seminole Trail bridge crossing be reconfigured with curb and gutter on the inside lanes and the medians will be regarded to a crown configuration. The area from the Cross Seminole Trail to the Greeneway will be reconfigured with six "Oasis" areas of approximately 200 feet in length per each Oasis. Currently some of the medians work as a part of the overall stormwater collection system for the highway . We will be required to modifY these areas in accordance with FDOT criteria. We understand that FDOT has designed this roadway for future six lanes of traffic and that their stormwater basins are of sufficient size to accommodate the additional stormwater flow generated by the additional lanes. Initial discussions with FDOT indicate that trees in the medians can be designed and installed provided that the proper curb and gutters are in place to prevent vehicles from mnning directly into the trees. All FDOT criteria must be followed and sight distances will have to be shown to verifY that the new landscaping does not hinder the sight of incoming motorists. FDOT has also indicated that if traffic conditions cause the need for six -laning of the roadway, then the trees and the curb and gutter will be removed by FDOT without compensation to the City. Any permit issued for this project by FDOT will most likely contain this condition. Other conditions to be expected include the hours of work. According to FDOT lane closures are prohibited during certain parts of daylight hours. From the school to Tuscawilla, there are no closures allowed between 6 A.M. and 8 P.M. From Tuscawilla to Tuscora there are no closures allowed between 6 A.M. and 9 A.M; and there are no closures allowed between 2 P.M. to 7 P.M. (eastbound); and there are no closures allowed between 4 P.M. to 7 P.M. no closures westbound; From Tuscora to the Greeneway there are no closures allowed between 7 A.M. and 9 A.M; and there are no closures allowed between 3 P.M. to 6 P.M. ~6.t~rt\e,J~ A:t'1- AMENDMENT 84 TO AGREEMENT DATED NOVEMBER 27,1984 FOR SR 434 MEDIAN LANDSCAPE BETWEEN THE CITY OF WINTER SPRINGS AND CPH ENGINEERS, INC. This Amendment dated , 2005, by and between the City of Winter Springs (hereinafter called the OWNER) and CPH Engineers, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Amendment to an Agreement dated November 27, 1984, between the parties, herein setting forth the scope, terms and conditions of the services herein authorized. The appropriate provisions of the Agreement apply as fully as if repeated herein. SECTION 1 GENERAL 1.1 The purpose of this Amendment is to provide for Civil Engineering and Landscape Design Services, more specifically itemized herein, in the preparation of construction documents for the installation of canopy trees in the median area of SR 434. SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated in accordance with FOOT criteria for landscaping within the FOOT Right of Way. 2.1.2 The ENGINEER will serve as the OWNER'S professional engineering representative in those phases of the project to which this Amendment applies, and will give consultation and advice to the OWNER during the performance of his services. The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager and Community Development Director and will submit interim reports/plans to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the preparation of the plans required to perform construction. 3.2 The City desires that the medians within SR 434 be landscaped with canopy trees from the Central Winds Park (CWP) entrance to the Greeneway (SR 417). The area from the entrance of the CWP to the bridge crossing of the Cross Seminole Trail will be reconfigured with curb and gutter on the inside lanes and the medians will be regarded to a crown configuration. The area from the Cross Seminole Trail to the Greeneway will be reconfigured with six "Oasis" Areas approximately 200 feet in length each. Only the areas required by FOOT to provide protection of vehicles will be equipped with curb and gutter and only these areas will be shown on the drawings. 3.3 We believe that a permit may be required from the St. Johns River Water Management District for the project. We recommend that a permit determination letter be sent to SJRWMD. If a permit is required, then the scope needs to be modified. 3.5 The stormwater collection system will have to be evaluated and some re-design will be required. There are low points in the existing medians and roadway section that will have to be modified with new curb and gutter inlets. For the most part, the median does not provide a drainage function and the medians can be revised for the landscaping. 3.7 Our design includes landscape and irrigation design services. We assume that the irrigation system will have to be replaced because the construction and new tree plantings will cause damage to the existing system. 3.8 No soils investigations will be provided. The general notes will include provisions for stripping the organics from the surface. Clean fill will be required to bring the grade to the required elevations to crown the median such that stormwater will be directed to the proposed roadway gutters. 3.9 At the direction of the Owner, the ENGINEER will use existing survey and topographical data from FOOT plans to design the project. We anticipate the scanning of existing drawings and using these as the base drawings for the design. A new survey will not be provided. If a new survey is required, it can be provided as an extra service by our in-house survey team. 3.10 Prepare final plans and specifications for bidding purposes. All materials specifications necessary for the construction of the project will be shown and or described on the General Notes sheet. Separate specifications sections will not be provided for this project. The drawings will be at the same scale as the original FOOT drawings (1" = 20' scale) and no profile will be shown. The drawings will be in a double plan format. The following drawings will be provided: 1 ) Cover Sheet 2) General Notes Sheet 3) Key/lndex Sheet 4) Double Plan View Sheets (5 sheets Central Winds Park to Bridge) 5) Double Plan View Sheets (3 sheets - six "Oasis" areas; one "Oasis" per view) 6) Details and Typical Sections 3.11 The review process with will consist of the following: 1) Kick-off meeting 2) 30% design review (no formal meetinglreview comments by staff). The 30% design will be considered as a conceptual design and submitted to FDOT for initial review and comment. The conceptual plan will also be submitted to FDOT for funding under their beautification grants program. If the response is OK, we can then proceed with the design. 3) 60% design review (meeting at City Hall with staff) 4) 90% design review (meeting at City Hall with staff) 5) Final design presentation to City Commission and submission to FDOT for approval. SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4.1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER may furnish or obtain under subcontracts, supplementary services of the following types which will be paid for by the OWNER. 4.1.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as described herein. 4.1.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Amendment. 4.1.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. 4.1.4 Additional engineering services required by revisions to regulations (after the date of this Amendment) as applicable to the Florida Department of Environmental Protection, the St. Johns River Water Management District, or other regulatory agency requirements. 4.1.5 Provide surveying services if required or requested by the OWNER. 4.1.6 Provide, through a subconsultant, soils investigation and geohydrological services if required or requested by the OWNER, or if required by the SJRWMD, recommended by the ENGINEER and authorized by the OWNER. 5.1 5.1.1 5.1.2 5.1.3 5.1.4 5.1.5 5.1.6 5.1.7 5.1.8 5.1.9 5.1.10 SECTION 5 THE OWNER'S RESPONSIBILITIES The OWNER will: Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER'S representative with respect to the work to be performed under this Amendment, and such person shall have complete authority to transmit instructions, receive information, interpret and define the OWNER'S policies and decisions pertinent to the work covered by this Amendment. Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Amendment. Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information. Provide personnel to locate facilities and mow, trim, or otherwise make them accessible for inspection. Examine all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as not to delay the work of the ENGINEER. Obtain approval of all governmental authorities having jurisdiction over the project, and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, soils investigations if advised in writing by the ENGINEER that they are necessary or advisable. Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, necessary additional services as stipulated in Section 4 of this Amendment, or other services as required. Provide such legal, accounting, and insurance counseling services as may be required for the project, and such auditing services as the OWNER may require. Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT 6.1 PAYMENT Payments for services and expenses of the ENGINEER to be as set forth below: 6.1.1 The fee for the engineering design scope of services described herein will be provided for a not to exceed fee of $32,850.00. Additional Services for bidding services and construction administration to be billed hourly, if required. Bidding and construction administration services can be provided upon request of the OWNER. 6.1.2 The OWNER will make prompt monthly payments in response to ENGINEER'S monthly statements without retention for all categories of services rendered under this Amendment and for reimbursable expenses incurred. 6.1.3 Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.1.3 will be computed at a rate of $650.00 per day or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed on an hourly rate). 6.1.4 If this Amendment is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1 on account of that and all prior work under this Amendment shall be due and payable, and shall constitute total payment for services rendered. In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. 6.1.5 The ENGINEER shall promptly begin work on the services authorized by this Amendment upon receipt of notice to proceed from the OWNER. SECTION 7 GENERAL CONDITIONS 7.1 Since the ENGINEER has no control over the cost of labor, materials, or equipment, or over any construction contractor's method of determining prices, any opinions of probable construction cost which may be provided in the services of this Amendment are made on the basis of his experience and qualifications and represent his best judgement as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Amendment and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Amendment. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. SECTION 8 8.1 The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed.
