Authorization REQUEST: The Parks and Recreation Department is requesting that The City Commission approve Resolution No. 2003-43, establishing fees to be paid by individuals or groups for the exclusive use of the Civic Center. PURPOSE: The purpose ofthis item is to receive approval from the Commission for Resolution 2003-43, which establishes fee and charges for the Civic Center. CONSIDERATION: . Parks and Recreation Department for the past 14 years has used a departmental fee schedule as follows: $35.00 per hour, $ 200.00 maximum fee per day/night and a $ 50.00 Security Deposit. . Some organizations use the facility free of charge because of departmental community based organization criteria. . The city's expense continues to increase for utilities, maintenance and supervision of the center. . Parks and Recreation recommends a fee of$ 60.00 per hour or $ 350.00 for an 8 hour rental. The rental fee also applies to setup and cleanup time. Also recommended is a $ 200.00 deposit of which only $100.00 is refundable if cancelled. . The rental fees apply to all uses except those organizations that have entered into Recreation Program Agreements with the City. Those agreements provide for financial compensation to the City. . The proposed scheduling and fees are in line with other Local Government Agencies. . The facility is more in demand each year. 1 FUNDING: None required. RECOMMENDATION: The Parks and Recreation Department recommends the approval of Resolution 2003-04. IMPLEMENTATION SCHEDULE: October 28, 2003 New fees and charges in place, except for already scheduled Civic Center usage. ATTACHMENTS: Attachment # 1 Attachment #2 Resolution No. 2003-04. COMMISSION ACTION: 2 ATTACHMENT # 1 RESOLUTION NO. 2003-43 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, ESTABLISHING THE FEES TO BE PAID BY INDIVIDUALS OR ORGANIZATIONS FOR THE USE OF THE CIVIC CENTER LOCATED AT SUNSmNE PARK; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida, has found it necessary to periodically review and establish fee schedules pertaining to activities and use of facilities within the City; and WHEREAS, the City Commission deems it to be in the best interests of the health, safety, and welfare of the citizens of Winter Springs to implement a fee schedule for use of the Civic Center located at Sunshine Park. " NOW, THEREFORE, BE n' RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. RecltJlls. The foregoing recitals are hereby fully incorporated herein by this reference and are deemed a material part of this Resolution. Section 2. Fee Schedule. Any person or entity that desires to use the Civic Center at Sunshine Park shall be required to pay a rental charge and deposit as follows: (a) Civic Center Rental Charges and Deposits: (1) $60.00 per hour or $350.00 per 8-hour rental period, including set-uplbreak- down time. (2) All rentals shall be subject to a 2-hour minimum rental period and $200.00 deposit. The deposit shall be paid prior to the rental period. (3) If a rental reservation is cancelled at least 48 hours in advance of the rental period, half of the deposit ($1 00.00) shall be refunded. (b) The rental charges and deposits required by this Resolution do not apply to those organizations that have cmtered into Recreational Program Agreements with the City. Those agreements already provide for :financial compensation to the City for use of the Civic Center at Sunshine Park. City of Winter Springs Resolution No. 2003-43 Page 1 of 2 SecrUon 3. Repeal of PrIor Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 4. Severabmty. If any section, subsection, sentence, clause, phrase, word, or portion of this :resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction. such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective Date. This Resolution shall become effective immediate1yup>n adoption by the City Commission of the City of Winter Springs, Florida.
