Regular X November 10, 2003 Meeting Mgr. / Authorization Dept. //Y REQUEST: The Community Development Department- Planning Division requests that the City Commission consider 1) Amending the Code to allow for Vinyl as an acceptable screening material for existing businesses which need to come into compliance with Section 9-281 by March 1, 2004, 2) Making available standard engineered dumpster enclosure details for existing businesses (the attached details include a CMU enclosure and an alternative Vinyl enclosure) and, 3) Exempting existing businesses from compliance with the zoning setback requirements. PURPOSE: Staff is requesting that the Commission consider three separate items which if approved, would enable existing businesses to more easily come into compliance with the dumpster enclosure ordinance. APPLICABLE LAW AND PUBLIC POLICY: Florida Municipal Home Rule Powers Act City of Winter Springs' Code, Section 9-281. (a) Both sides and the rear of the Dumpster shall be screened by an opaque wall made of concrete, brick, stone, or other similar durable material, provided the material used is compatible with the architectural design of the principal structure. The wall shall be at least six (6) feet in height or the height of the Dumpster, whichever is greater. ... CHRONOLOGY: May 13, 2002- 2nd Reading/Adoption of Ordinance 2002-13 which established dumpster screening standards Aug. 11, 2003- 2nd Reading/Adoption of Ordinance 2003-26 which amended the compliance date for existing dumpsters Nov. 10,2003- 2nd Reading of Ordinance 2003-39 which grandfathered existing dumpster enclosures that fully meet code except for the 6' minimum height requirement CONSIDERATIONS: . The current Code indicates that dumpster enclosures must be a masonry wall constructed of concrete, brick, or stone. Other similar material may be used if it is compatible with the architectural design of the principal structure. ~ ~ 111003 Regular Agenda Item 502 . Construction of a masonry wall enclosure requires a substantial expense (both in engineering and in construction) for small businesses that are required to become compliant by March 1, 2003. . Standard details provided by the City to existing busine~ses would help to alleviate some of the expense. . Additionally, consideration of a vinyl enclosure as an appropriate alternative would further decrease the expense while providing an effective means of screening the dumpster. (The specifications identify the quality of material that is to be utilized and include a sampling of vendors supplying this material.) · Many existing businesses do not have flexibility in the location of the enclosure and can not comply with the 6' rear setback requirement for structures as included in the zoning regulations. STAFF RECOMMENDATION: Staff recommends that the City Commission provide directive to the City Attorney to amend the code to 1) allow Vinyl as an acceptable screening material for existing businesses which need to come into compliance with Section 9-281 by March 1. 2004, and 2) Exempt existing businesses from compliance with the zoning setback requirements related to the location of their dumpster enclosure. Additionally Staff recommends that the City Commission adopt the Details as standard details to be made available to existing businesses which must be brought into compliance by March 1, 2004. Both designs meet the windload requirements of the City of Winter Springs. The first design is based on concrete and/or brick masonry units with a concrete footer and support system. This could be built around an existing slab or with a new concrete slab. The walls do not rely on the slab for support. If a completely new unit is constructed, this option would cost between $4800 and $10,000 depending on the size and degree of ornamentation on the gate and the walls. Brick walls would be the most expensive option for the walls. For a cost example: Assume 10 foot by 10 foot enclosure for a 4 foot by 6 foot dumpster. Walls 30 LF @ $75/LF $2250 Architectural block or standard CMU with stucco Gate $1500 Assumes architectural gate Bollards $ 500 Slab. 1.85 CY @$300/CY ~ 555 Total $4805 The second design is based on the use of a commercial grade vinyl fence with posts set in concrete surrounding an existing or new concrete slab. The vinyl fence is a commercial grade unit that will last for many years and also provide the necessary structural capability. Again the slab does not provide any support to the walls. For a cost example: Assume 10 foot by 10 foot enclosure for a 4 foot by 6 foot du mpster. Walls 30 LF @ $30/LF $ 900 Gate (al. frame/vinyl slats) $ 750 This design could also use the metal gates of option 1 above at a slightly higher cost.
