Centex Settlement Agreement
I want to make a proposal tonight to end the dispute with Centex over Heritage Park.
I am recommending that we split the difference between the $100,000 recommended by
staff and the $158,000 recommended by the Commission and settle this matter as follows:

1) Payment for destruction of

2) Installation of the enhanced
landscape plan (replacement of

Total $185,000 $243,000 $214,000
As you know, this project will probably be ready for building permits before our next meeting
in January. Once we reject issuance of building permits then the city and the taxpayers are
at risk to the cost of litigation. I do not see the wisdom of exposing the city and taxpayers to
this risk for the additional money involved here. If we are going to expose the city and
taxpayers of the city to potential losses of many thousands of dollars, let's do it for an issue
that is more important than a $29,000 difference between our offer and Centex's offer.
