REQUEST: The Community Development Department requests the City Commission
validate the staff recommendation finding the Barrington Estates subdivision
built in substantial accordance with the Final Engineering and to accept the
potable water and sanitary sewer infrastructure for ownership and
maintenance.
PURPOSE: The purpose of this Agenda Item is to request the City Commission validate
the staff recommendation finding the Barrington Estates subdivision built in
substantial accordance with the Final Engineering per Section 9-178 and to
accept the potable water and sanitary sewer infrastructure for ownership and
maintenance in order for Certificates of Occupancy to be issued.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building oil'
lots; exceptions.
( c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans, such as withholding
occupancy, the building official may issue building permits upon advising the developer
that all or partial occupancy will be restricted until satisfactory completion of the
improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are accepted by
the city commission.

FINDINGS:
1) All City Departments have found the work to be acceptable with the Arborist's
approval being conditioned on the City Commission adoption of the landscape
plan.
2) The potable water and sanitary sewer improvements are to be dedicated to the City
for ownership and maintenance. The 2-year maintenance bond has been received.
The developer will be entitled to reimbursements from other property owners
connecting to the water and sewer extensions pursuant to the Developer
Agreement The methodology for calculating the reimbursement will be brought
to the Commission for approval at a later date.

RECOMMENDATION:
Staff recommends that the City Commission validate the staff recommendation
finding the Barrington Estates subdivision built in substantial accordance with the Final
Engineering per Section 9-178 and to accept the potable water and sanitary sewer
infrastructure for ownership and maintenance.
IMPLEMENTATION:
Certificates of Occupancy will be issued for the units ready for CO's.

Barrimrton Estates
I have received the "as-built" engineering, engineer's certification of completion
and the two-year maintenance bond for the water and sewer for the subject project. I
have reviewed the submittals and performed an "as-built" inspection and re-inspection of
the site. I found them in general conformance to the approved engineering plans and
applicable code with the exception of the landscaping requirements of the site to be
addressed by the City Commission.
I recommend this project be forwarded to the City Commission for final
acceptance.
