Mgr. / Attor / Authorization REQUEST: The Community Development Department requests the City Commission consider and adopt the updated future land use map (FLUM) and official zoning map. PURPOSE: The purpose of this request is to present the updated FLUM and official zoning map for consideration and adoption by the City Commission, as required annually by Section 20-1 02( c) of the Code of Ordinances. APPLICABLE LAW AND PUBLIC POLICY: Section 20-1 02( c), Official Zoning Map Update, of the Code of Ordinances states, "The official zoning map shall be updated in a permanent fashion each year by changing the color of the rezoned areas and by placing thereon an identification number, and an identical number placed on a sheet of paper to be permanently affixed in the lower right-hand comer of the official zoning map. Beside the identifying number shall be placed the ordinance number resulting in the rezoning, and the date of adoption. The updated zoning map shall be approved by the Planning and Zoning Board by May 31 of each year and shall be presented to the City Commissi<;m for their approval at the first regularly scheduled rneeting thereafter." CONSIDERATIONS: 1. The City Code requires the annual update of the official zoning map in a permanent fashion. COD/June 13.200213:30 PM June 24, 2002 REGULAR AGENDA ITEM E Page 2 2. The City Code requires the updated zoning map to be presented to the Planning and Zoning Board for consideration and recommendation by May 31 of each year, prior to approval by the City Commission at the first regularly scheduled meeting thereafter. 3. While not required by Code, the approval of a concurrent FLUM update would provide consistency between the future land use and zoning maps by ensuring that map amendments affecting both future land use and zoning designations are properly documented. 4. At its February 6,2002 regular meeting, the Planning and Zoning Board directed staff to prepare an updated zoning map for its consideration and recommendation, prior to May 31,2002. 6. Following the Planning and Zoning Board's recommendation, the City Comrnission adopted Ordinance 2002-11 and Ordinance 2002-12 on June 10,2002, which respectively changed future land use and zoning designations for properties as presented under FINDINGS. It is also recommended that these map amendments be considered in this request. FINDINGS: Staff has completed its review and preliminary update of the FLUM and official zoning map by incorporating all map amendments approved by the City Commission from May 31, 2002 to the present, as shown below and graphically depicted in Attachments A and B: Future Land Use Map Amendments: · Ordinance 2001-40; Changed future land use designation of property from (Seminole County) "Office" to (Winter Springs) "Town Center"; June 25, 2001 adoption date by City Commission. . Ordinance 2001-45; Changed future land use designation of property from (Seminole County) "Planned Unit Development/Conservation Overlay" to (Winter Springs) "Mixed Use"; August 13,2001 adoption date by City Commission. . Ordinance 2002-11; Changed future land use designation of properties from (Seminole County) "Medium Density Residential" to (Winter Springs) "Low Density Residential"; June 10, 2002 adoption date by City Commission. PLANNING AND ZONING BOARD RECOMMENDATION: At its May 1, 2002 regular meeting, the Planning and Zoning Board recommended adoption of the updated FLUM and official zoning map by the City Commission, which includes map amendments adopted by the following ordinances: · Ordinance 2001-40 . Ordinance 2001-45 · Ordinance 2001-46 · Ordinance 2001-48 · Ordinance 2001-58 STAFF RECOMMENDATION: Staff recommends the City Commission consider and approve the attached updated FLUM and official zoning map, including those map amendments that' were adopted by the City Commission subsequent to the Planning and Zoning's Board's May 1, 2002 recommendation. IMPLEMENTATION: Following the adoption ofthe updated FLUM and official zoning map by the City Commission, COD/June 13. 200V3:30 PM June 24, 2002 REGULAR AGENDA ITEM E Page 4 staff will make a final update of both maps as outlined in Section 20-102 of the City Code. CALL TO ORDER The Planning And Zoning Board/Local Planning Agency Regular Meeting was called to order Wednesday, May 1, 2002, at 7:04 p.m. by Chairman Bill Fernandez in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairman Bill Fernandez, present Vice Chairman Tom Brown, absent Board Mernber Rosanne Karr, present Board Mernber Joanne Krebs, present Board Member Sally McGinnis, present The Pledge of Allegiance followed. II. CONSENT CONSENT A. Approval Of The April 3, 2002 Regular Meeting Minutes. MOTION BY BOARD MEMBER KREBS. "I MOVE TO APPROVE." SECONDED BY BOARD MEMBER KARR. DISCUSSION. WITH CONSENSUS OF THE BOARD, THE MOTION WAS APPROVED. MOTION CARRIED. III. REGULAR REGULAR A. Preliminary Site Plan For The State Road 434 R~tail. Mr. John Baker, AICP, Current Planning Coordinator, Community Development Department introduced Ms. Neisha Hacker, University of Central Florida Graduate Student and explained that that she will be doing her summer internship with the City of Winter Springs' Comrnunity Development Department. UNAPPROVED CITY OF WINTER SPRINGS_ MINUTES PLANNING AND ZONING BOARDfLOCAL PLANNING AGENCY REGULAR MEETING - MA Y 1,2002 PAGE20F8 Mr. Baker then introduced the Agenda Item to the Board and explained that the applicant may request that this issue be delayed Mr. Howell Cantor, Lowndes, Drosdick, Doster, Kantor, & Reed, P.A., 215 North Ecola Drive, Orlando, Florida: explained why he, as the applicant's representative was requesting a continuance. Mr. Thomas Kearney, 159 Stone Gable Circle, Winter Springs, Florida: as President of the Stone Gable Homeowners Association, Mr. Kearney spoke of "What our Community is all about" while referring to a handout he distributed; and that residential and commercial vehicles sharing an entranceway was a "Dangerous scenario". The Board and Mr. Kearney discussed area entrances and the Stone Gable entrance; and a letter regarding the applicant purchasing a land parcel (Tract B) frorn Cambridge Homes. Chairman Fernandez asked Mr. Baker whether the second entrance is "Meeting Code by using just one entrance." Mr. Baker required, "Yes." Mr. Kearney stated that the Stone Gable Homeowners Association is asking that the City protect them from the "Smell. and noise with the dumpsters" and asked for modifications such as a thirty foot (30') tree buffer. Discussion. Mr. John Neubauer, 102 Stone Gable Circle, Winter Springs, Florida: addressed the issue of tree replacement within the City. Discussion. Mr. Robert Keith, 106 Stone Gable Circle, Winter Springs, Florida: asked if a platted and recorded landscape easernent (Tract B) can only be released by City Ordinance; said that the median cut placement was to support Stone Gable and only half of the applicant's commercial property; and that other commercial property along the south side of State Road 434 should be using the left hand turn lane at the Seminole County School Bus Barn. Tape I/Side B Mr. Kearney addressed the Board regarding recorded Covenants and the City of Winter Springs' Code of Ordinances concerning the State Road 434 Corridor. Discussion. Accessory Buildings Amendment Mr. McDonald introduced the Agenda Item and highlighted the Considerations, and the Staffs Findings. Discussion ensued between Board Members and Staff regarding what prompted Staff to request the changes to the Code; and the number of accessory buildings that would be allowed. It's incorporated into the Code. Why can't the City Attorney or shouldn't the Commissioners, to alleviate the fears of lay people and others, put a recitation in the 'Wherefore' clause or somewhere else in this Ordinance that says 'Existing properties that have previously been allowed, permitted to build structures are not effected'. Whoever makes the Motion, I would like to see as a part of that Motion a recommendation so it's in the Minutes." Mr. Charles Carrington, AICP, Community Development Departrnent Director replied, "That is a basic principle in Zoning and that's understood throughout the Ordinance. When an Ordinance is changed certain things are made non-conforming but they can exist in perpetuity." MOTION BY BOARD MEMBER KARR. Chairman Fernandez stated, "When we make a Motion, I want whoever the Motion maker is to recommend that the City Commission reconsider Section 20-59. and have the City Attorney address it so that we can eliminate - that should not be the job of the Planning and Zoning Board or the Local Planning Agency. We haven't done it, we've never done it. If we are not going to do it and if we are going to ignore it then this ought to come out of the Code. But we can't have it in here and ignore it, we're not doing our job. I have been told by the City Manager, Mr. Carrington and others that if there is something this Board needs that hasn't been presented, we are to ask for it and Table the matter. FUTURE AGENDA ITEMS · Policy Changes · Election Of Officers Suggesting that the Board holds Election of Officers in the future Chairman Fernandez said, "We are still looking for an Attorney's opinion as to - since P&Z has it's own adopted By-Laws and rules, are we under the general Ordinance and do we need to immediately hold an Election, or do we continue to operate under our own By-Laws and those rules. Do you know the status of that from the City Attorney, where it is?" Mr. McDonald replied, "I don't know the status of that application but I would assurne that the Ordinance, the requirements of the Ordinance would supercede the By-Laws." Chairman Fernandez stated, "Normally it would but I think there is a provision in that Ordinance that says unless they have their own," Mr. Carrington said, "If in fact that language is in there then in all probability your By- Laws would prevail but normally - as Earnest has stated, the Code would prevail and you would have to amend your By-Laws to comply.
