HomeMy WebLinkAbout2002 06 24 Regular A Screen Porch Reconstruction COMMISSION AGENDA ITEM A * CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X 06/24/02 Meeting MGR, /DEPT Authorization REQUEST: The Community Development Department recommends denial of a request for a variance by Ms. Irene Clark from Section 6-2 and Section 20-103 of the City Code of Ordinances, to encroach as much as 7 feet into the 25 foot rear building setback, to replace and expand a screened porch at the rear of her house. PURPOSE: The purpose of this agenda item is to consider a request of Ms. Irene Clark for a variance from the requirements of Section 6-2 and Section 20-123 of the City Code of Ordinances to allow demolition, reconstruction and expansion of a screen porch as much as 7 feet into the 25-foof rear building setback. The existing screen room extends 5 feet into the rear building setback. APPLICABLE CODE: Sec. 6-2. Compliance with Chapter. Sec. 20-82. Duties and powers; general. Sec. 20-103. Restrictions upon lands, buildings and structures. Highlands Deed RestrictionslRestrictive Covenants CHRONOLOGY: April 11, 2002 - Variance application received by City May 2, 2002 - Board of Adjustment heard the request and recommended Approval. June 10, 2002 - The City Commission deferred the item to allow the City Attorney to review the Highlands PUD deed restrictions/restrictive covenants. June 24, 2002 Regular Item A * Page 2 FINDINGS: 1) Lot No.4, of The Highlands, Section Four, is zoned PUD and has a Low Density Residential Future Land Use designation. 2) The required rear yard building setback is 25 feet for single family development within the Highlands PUD. 3) Plat book 19, page 44 depicts an approximately 20' wide utility Tract "B" behind Lot No.4, separating this lot from the lots from Gretna Ct., which otherwise abut the rear of Lot 4 (please see attachment). 4) The applicant has requested a variance to encroach 7 feet into the 25-foot rear building setback, to within 18 feet of the rear property line. The existing porch structure extends 5 feet into the rear building setback. 5) A variance requires compliance with all six (6) criteria outlined in Code Section 20-82. 6) The Highlands Homeowner's Association Architectural Review Board has approved the encroachment into the rear building setback (Attachment F). BOARD OF ADJUSTMENT: At its regularly scheduled meeting of May 2,2002, the City of Winter Springs Board of Adjustment heard Ms. Clark's request for a variance and voted to recommend approval of the variance to allow the 7-foot encroachment into the 25-foot rear building setback, subject to Ms. Clark receiving approval of the Highlands Homeowners' Association Architectural Review Board. RECOMMENDATION: Staff did not find the request to be consistent with all six (6) criteria necessary for granting a variance and recommends denial ofthe request. There is already an encroachment on the property. Maintaining an encroachment is like accepting a nonconforming use. However, to request extending an existing encroachment goes against every principle of planning and would be the same as allowing the expansion of a nonconforming use.
