REQUEST: The Public Works Department requests the City Commission validate the staff recommendation finding Colonial Bank to be built in substantial accordance with the Final Engineering plans PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding Colonial Bank to be built in substantial accordance with the Final Engineering plans per Section 9-178 in order for Certificates of Occupancy to be issued. The site is located at the southwest corner of S.R. 434 and Vistawilla Drive. APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. ( c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city comnussIOn. FINDINGS: 1) The site has been constructed in substantial accordance with the final engineering plans approved by the City Commission at the March 13,2006 City Commission meeting. 2) All City agencies have found the work to be acceptable, except as noted below in the recommended condition of approval. 092506_ COMM _ Consent_ 400_ Colonial_Bank _Acceptance September 25, 2006 Consent Agenda Item 400 Page 2 3) The sitework complies with the applicable conditions of the Developer's Agreement approved by the City Commission at the June 12, 2006 Commission meeting. 4) Colonial Bank has conveyed to the City the land along the S.R. 434 frontage necessary for a future right-turn deceleration lane, per the terms of the Developer's Agreement. RECOMMENDED CONDITION OF APPROVAL: 1) All landscaping and ground cover shall be complete and accepted by the City prior to issuance of a Certificate of Occupancy RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding Colonial Bank to be built in substantial accordance with the Final Engineering plans, subject to the one condition listed above. IMPLEMENTATION: The Certificate of Occupancy can be issued after Commission approval. ATTACHMENTS: None CITY COMMISSION ACTION:
