I Dept. Authorization REQUEST: City Manager requesting the City Commission acting as the D.R.C. to approve a sidewalk design change for Morrison Homes at Avery Park. PURPOSE: This agenda item is needed for eonsideration of a sidewalk design change for Morrison Homes at Avery Park. CONSIDERATIONS: Currently the sidewalk is designed with a two-foot grass strip between the sidewalk and the back of the curb. This design is causing a problem for two reasons: 1. This design allows only three feet for landscaping in the front yard of the homes and no opportunity for landscaping on the two-foot grass strip. 2. The first step of the steps to the house is directly adjacent to the edge of the sidewalk causing a safety problem since there is not enough room for a landing area. Celebration solved this problem by doing away with the grass strip and pushing the sidewalk to the edge of the curb. This allows six feet for landscaping and a landing area between the front steps and the edge of the sidewalk. Morrison Homes is requesting this same approach. FUNDING: Not applicable. RECOMMENDATION: Staff has reviewed this request and has no problem with the request and change. Therefore, staff is recommending the Commission approve Morrison Homes request to amend the sidewalk design for A very Park to permit elimination of the two-foot grass strip between the curb and the sidewalk, and the sidewalks to be constructed against the curb with the following conditions: 1. No part of the building including steps will encroach within two feet of the right of way. Landscape material would be allowed in the right of way up to the edge of the sidewalk on the building side of the sidewalk provided that they do not block access to public facilities such as meter boxes.and fire hydrants. 051302 Regular J Avery Park Sidewalks Page 2 of2 2. Fire hydrants, meter boxes, and streetlights shall be installed in the right of way between the right of way and the building side of the sidewalk. 3. Morrison Homes will attach a letter to each contract for sale stating to the satisfaction of the city that each buyer will not erect a fence within two feet of the right of way, and that each buyer understands that the city by necessity and by law has the right to remove any landscape material, fences, artifacts, buildings, or building components from the right of way which serve to block the city's access to meter boxes, fire hydrants, streetlights or any other city facility at the cost of the homeowner.
