ITEM 400 Authorization PUBLICLY ANNOUNCE THE REQUEST REQUEST: The City Manager is requesting that the City Commission hold a Public Hearing relative to the approval of Resolution No. 2005-36, which establishes the Tentative Operating Milla e Rate for Fiscal Year 2005-2006 for the City of Winter Springs at mills which is % above the rolled-back rate of 3.9214 mills and the Tentative Voted Debt Service Millage Rate for Fiscal Year 2005-2006 for the City of Winter Springs at .1374 mills. PURPOSE: The purpose of this agenda item is to have the Commission approve the first reading of Resolution No. 2005-36, otherwise known as the Tentative Millage Rates for Fiscal Year 2005-2006. CONSIDERATIONS: Resolution No. 2005-36 - Tentative Millage . The operating millage for FY 2004-2005 is 4.3000 mills. The tentative operating millage for FY 2005-2006 is set at mills. . The voted debt service millage for FY 2004-2005 is .2500 mills. The tentative voted debt service millage rate for FY 2005-2006 is set at .1374 mills. . The rolled-back rate is 3.9214 mills. The tentative operating millage rate is above the rolled-back rate. . Any changes or deletions to the tentative millage rates and the tentative budget requested by the City Commission at this meeting will be reflected in the second reading (Final Millage and Budget Hearing) scheduled for September 26, 2005 at 6:30 PM. . IMPLEMENTATION SCHEDULE: Upon approval and adoption of Resolution No. 2005-36, at the second reading, the millage rates for fiscal year 2005 - 2006 would be implemented and become effective on October 1, 2005. McLemore, City Manager ~ FROM: DATE: September 12, 2005 SUBJ: FY06 Budget Request - Public Hearing Agenda Item 400-401 At the September 8, 2005 Budget Workshop you directed me to provide you with a list of budget items that could be cut from the budget to fund additional police officers. Since that meeting some of you have requested that I provide you with two options as follows: 1. One option demonstrating the tax increases needed to fund additional police officers if no other service reduction cuts were made. You also asked that it be demonstrated in order of the lowest cost option to the highest cost option. 2. The other option showing budget reductions that could be made to fund additional police officers. In regards to the budget cut options, I want to make these important observations. 1. The budget reduction option is harmful to other programs and departments that contribute to the public safety and the quality of life we enjoy in Winter Springs. 2. The request in the police study represents a 1.7 million dollar increase in the police department budget equal to 1.0657 mills in additional expenses in the General Fund without any consideration for the future needs of other departments. Those 1.0657 mills would change the status of the City of Winter Springs from being one of the lowest taxed to the highest taxed cities in the area. 091 lOS-Budget Options Page 1 of6 The request before you for six officers represents only $387,000 of$1.7 million in police department requests included in the Police Department's Study. How do you plan to fund the additional $1,313,0007 The point here is that the idea of funding increases in law enforcement by gutting other departments that make important contributions to public safety and the quality of life our citizens enjoy is not only unwise, it is simply not possible. 3. Although I agree that we will need additional officers to create a new town center zone, there is no compelling need to increase police officers this year. 4. The Police Department Study has not stood the test of peer or independent review and should not be viewed either as a credible or in-credible basis for decision- making until a prudent process of scrutiny is completed. 5. As part of the process of prudent review the Commission should have a clear understanding of how these needs compare to the needs of other departments over the same planning horizon, and the revenue growth that will occur during this planning horizon in order to have a clear understanding of how increased expenditures can best be timed within the growth of existing revenue, prior to the levy of additional taxes. 6. In FY 06 the city will be faced with extraordinary expenses related to upgrading the city's pay plan. Failure to fund merit increases this year will serve only to exasperate that problem. 7. WHEREAS, the City Commission of the City of Winter Springs has held a public hearing on the tentative millage rate pursuant to Florida Statute 200.065, Subparagraph (c); WHEREAS, the City Commission of Winter Springs desires to adopt the tentative operating millage rate and publicly announce their percentage change by which the tentative proposed operating millage rate exceeds the rolled-back rate, and adopt the tentative voted debt service rate; and WHEREAS, the City Commission of the City of Winter Springs deems that this Resolution is in the best interest of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. The City Commission adopts its tentative operating millage rate of mills and its tentative voted debt service millage rate of .1374 mills for the fiscal year commencing October 1, 2005 and ending September 30, 2006. Section 3. The tentative 0 erating millage rate of rolled-back rate of3.9214 by Yt>. mills is more than the computed Section 4. Within fifteen (15) days of the date of this Resolution, the City Clerk shall advertise in a newspaper of general circulation its intent to finally adopt the millage rates and budget and shall hold a public hearing to finalize the budget and adopt the millage rates not less than two (2) days or more than five (5) days after the date the advertisement is first published. 091205_COMM_ Public_Hearing_ 400_Resolution_2005-36 Section 5. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 7. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
