REQUEST: The Public Works Department requests the City Commission validate the staff recommendation finding Tuscawilla Square to be built in substantial accordance with the Final Engineering plans and authorize reimbursement in the amount of $165,613.50 for Gary Hillery Drive improvements. PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding Tuscawilla Square to be built in substantial accordance with the Final Engineering plans per Section 9-178 in order for Certificates of Occupancy to be issued, and authorize reimbursement in the amount of$165,613.50 for Gary Hillery Drive improvements. This site is located on the northeast corner of Winter Springs Boulevard and Northern Way. APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city comrmSSlOn. FINDINGS: 1) The site has been constructed in substantial accordance with the final engineering plans approved by the City Commission at the February 28,2005 City Commission meeting. 091106_ COMM _Regular _300_ Tuscawilla Square_Acceptance September 11, 2006 Regular Agenda Item 300 Page 2 2) All City agencies have found the work to be acceptable, except as noted below in the recommended conditions of approval. 3) The sitework complies with the applicable conditions of the Developer's Agreement approved by the City Commission at the December 13, 2004 Commission meeting. 4) Under the terms of the Developer's Agreement, the City agreed to reimburse Bryce Foster for the reasonable costs to design and construct Gary Hillery Drive. At the June 13, 2005 Commission meeting, the Commission approved funding in the amount of$174,454 for this reimbursement. At the March 27, 2006 Commission meeting, the Commission approved a cost sharing arrangement for burying the overhead power lines in the immediate project vicinity. The cost sharing arrangement reduces Bryce Foster's reimbursement by $8,840.50, for a revised total reimbursement of$165,613.50. 5) Bryce Foster has provided a two-year, 10% maintenance letter of credit to the City for the Gary Hillery drive improvements. 6) Screen wall enclosures are planned to hide the two electrical meter banks on the buildings facing Winter Springs Boulevard and Gary Hillery Drive. These screen enclosures are recommended to be in place and approved by the City prior to issuance of any Certificates of Completion for the buildings. RECOMMENDED CONDITIONS OF APPROVAL: 1) The irrigation system shall be successfully tested and inspected in the presence of the City's irrigation inspector. 2) The two screen wall enclosures described in item #6 above shall be constructed and accepted by the City prior to issuance of any Certificates of Completion for the buildings. RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding Tuscawilla Square to be built in substantial accordance with the Final Engineering plans, subject to the two conditions listed above, and authorize reimbursement to Bryce Foster Corporation in the amount of$165,613.50 for Gary Hillery Drive improvements. IMPLEMENTATION: Certificate of Occupancies for those units eligible can be issued after Commission approval. ATTACHMENTS: None CITY COMMISSION ACTION:
