REQUEST:
The Community Development Department requests the City Commission conduct a public hearing
for the second reading and adoption of Ordinance 2002-12, which would change the zoning
designation of two (2) tracts located west of Tuskawilla Road, between Milky Way and Trotwood
Boulevard, from (Seminole County) A-I Agricultural to (City of Winter Springs) PUD.
PURPOSE:
The purpose of this request is to adopt City-initiated zoning map amendments for two (2) tracts
totaling 1.24 acres.
APPLICABLE LAW AND PUBLIC POLICY:
Section 15-34 of the City Code states, "The city may approve proposed small scale
amendments to the comprehensive plan without regard to statutory limits on the
frequency of consideration of amendments to the comprehensive plan...."
Section 20-57 of the City Code states, "The planning and zoning board shall serve as the
planning and zoning commission....to recommend to the city commission the boundaries
of the various original zoning districts. . . . and any proposed amendments thereto. . . .and act
on measures affecting the present and future movement of traffic, the segregation of
residential and business districts and the convenience and safety of persons and property
in any way dependent on city planning and zoning,...it shall serve as the local land
planning agency pursuant to the comprehensive planning act of the state...."

Section 20-359 of the City Code states, "Any request for an alteration, revision, addition
or deletion to the final development plan shall be submitted to the city clerk for review by
the planning and zoning board... .the board shall review the proposal and the staff
recommendations to determine whether or not the proposed change is substantially
consistent with the approved final development plan. If the proposal is determined to be
consistent, the planning and zoning board may approve or approve with modifications the
proposed change."
Section 20-351 of the City Code states, "The intent and purpose of the Planned Unit
Development District (Part A) is to provide for planned residential communities
containing a variety of dwelling unit types and arrangements, with complimentary and
compatible commercial centers with supportive residential and/or complimentary and
compatible industrial land uses.. ..all designed to promote the public health, safety and
general welfare...."
CONSIDERATIONS:
1. The subject properties are comprised of a 0.81 acre tract that directly abuts Lots 729
through 741 of Oak Forest Unit 7 to the north and a 0.43 acre vacated right-of-way
which directly abuts the 0.81 acre tract to the north.
2. The subject properties are currently vacant with a zoning designation of (Seminole
County) A-I Agriculture. Existing land use, zoning and FLUM designations are
shown in the table below:

3. Both tracts were annexed into the City in August 2000 but were never assigned City
zoning designations.
4. Following the vacation of the 0.43 acre right-of-way in April 2001, half of it reverted
to the owner of the property north of its location (Tuscawilla Office Park) and the
other half reverted to the owners of the 0.81 acre tract, which abuts Tuscawilla Unit 7.

5. Both tracts were acquired in May 2001 by the abutting property owners of Tuscawilla
Unit 7 and recorded by deed in the Seminole County Registry.
6. Following annexation into the City and acquisition by the Oak Forest Unit 7 property
owners, the subject properties were never officially subdivided or recombined with
Lots 729 through 741.
7. The Seminole County Property Appraiser's Office has assigned individual property
identification numbers for each portion of the 0.81 acre tract that has been partitioned
by deed, as shown in Exhibit G.
8. The rezoning of the subject properties would be pursuant to the future subdivision and
recombination of the subject properties into Lots 729 through 741 of Oak Forest Unit
7 as herein presented.
FINDINGS:
A. The request is consistent with all applicable goals, objectives and policies of the
City's adopted comprehensive plan.
B. Considering the type and location of uses involved and the general character of
the area, the request would not result in any incompatible land uses, including
such factors as height, bulk, scale, intensity, traffic, noise, drainage, dust, lighting,
appearance, and other similar applicable factors.
STAFF RECOMMENDATION:
Staff recommends the City Commission adopt Ordinance 2002-12, which would change
the zoning designation of the subject properties from (Seminole County) A-I Agricultural
to (City of Winter Springs) PUD, subject to the following condition:
A. Prior to the FLUM and zoning map amendments becoming effective, the owners
of the subject properties must obtain approval for the alteration of the final
subdivision plan as stated in City Code Section 20-386, in order to combine the
subject properties with Lots 729 through 741 of Oak Forest Unit 7 and legally
record the same.

CITY OF WINTER SPRINGS, FLORIDA REZONING A
PARCEL OF LAND CONTAINING TWO TRACTS
TOTALING 1.24 ACRES MORE OR LESS, WHICH IS

DESIGNA TION TO CITY OF WINTER SPRINGS "PLANNED
UNIT DEVELOPMENT" ZONING DESIGNATION;
PROVIDING FOR REPEAL OF PRIOR INCONSISTENT
ORDINANCES AND RESOLUTIONS; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on March 6, 2002, the Planning and Zoning Board recommended approval of
this rezoning based on the testimony and information presented before the Board; and
WHEREAS, based on the recommendation of City staff, the Planning and Zoning Board, and
review of the competent substantial evidence presented to the City Commission on t~s rezoning
application, the City Commission hereby finds that the rezoning complies with the City Code, is
consistent with the City's Comprehensive Plan and law, and that the rezoning constitutes a legitimate
public purpose; and
WHEREAS, the City Commission hereby finds that this Ordinance is in the best interests of
the public health, safety, and welfare of the citizens of Winter Springs.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS AS FOLLOWS:
Section 1, Zoning Designation Amended. The zoning designation of the real property legally
described and depicted on Exhibit "A", which is attached hereto and incorporated herein by this
reference, is hereby amended from Seminole County "A-I Agricultural" to City of Winter Springs
"Planned Unit Development." Upon the effective date of this Ordinance, City Staff is hereby
instructed to amend the Official Zoning Map of the City of Winter Springs to fully reflect this
amendment.
Section 2, Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent
ordinances and resolutions adopted by the City Commission, or parts of ordinances and resolutions
in conflict herewith, are hereby repealed to the extent of the conflict.

Section 3. Severability, If any section, subsection, sentence, clause, phrase, word or provision
of this ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed
a separate, distinct and independent provision, and such holding shall not affect the validity of the
remaining portions of this ordinance.
Section 4. Effective Date. This Ordinance shall become effective immediately upon Ordinance
No. 2002-11 becoming effective. If Ordinance No. 2002-11 does not become effective, then this
Ordinance shall be deemed null and void.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular

I. APPliCABLE lAW AND PUBliC POliCY
Section 15-34 of the City Code states, "The city may approve proposed small scale
amendments to the comprehensive pl<Ul without regard to statutOl1' limits on lhe frequency
of consideration of amendment., to the comprehensive plan...."
Section 20-57 of the City Code states, "'T'he pl<Ulning and zoning bmrrd shall serve as the
planning and zoning commission....to recommend to the city commission the boundaries
of the vcu;ous oribrinal zoning districts....culd any proposed cunendments lhereto....culd act
on measures affecting the present cuu} fi.lture movement of trafTic, the segregation of
residential culd business districts culd the convenience cuul safety of persons cuul properly in
any way dependent on city planning cuul zoning....it shall serve as the locallcuu} planning
agency pursuant to the comprehensive pl<Ulning act of the slate...."
Section 20-359 of the City Code states, "Any request lor <U1 alteration, revision, addition or
deletion to the final development pICUl shall be submitted to the city clerk for review by lhe
planning cuul zoning board....the board shall review the proposal cuul the staff
recommendations to determine whether or not the proposed chculge is substantially
consistent with the approved final development plan. If the proposal is determined to be
consistent, the plcu1l1ing cuu} zoning board may approve or approve with modifications the
proposed chculge."
II. SUMMARY OF APPliCATION

The subject properties are individually owned by the owners of Lots 729 through
741 of Oak Forest Unit 7 of Tuscawilla PIcu1l1ed Unit Development (PUD).
C. Requests:
1. Small-scale comprehensive plCUl cunendment, from (Seminole County)

2. Zoning map amendment, from (Seminole County) A-I Agricultural to (City

3. PUD development plan amendment, which would incorporate the subject
property into the Tuscawilla PUD (Attachment H)
D. Purpose:
The purpose of this request is to adopt City-initiated Future Land Use Map
(FLUM) and zoning designations lor two (2) tracts totaling 1.24 acres and tl1US
incorporate them into tlle "Tuscawilla PUD.
E. Site Information:
1. Parcels and PIN: Following tlle amendment of the FLUM, zoning map and
PUD development plan, dIe subject properties would be combined witll
Lots 729 tllrough 741 of Oak Forest Unit 7, as shown on Attachment G, in
a separate application lor subdivision. Even tllOugh tlle properties have
never been ollicially subdivided, they are cun-ently recorded by deed in tlle

2. Acreage: As shown in Attachment C, tlle properties complise
approximately 1.24 acres, including 0.81 acres I()f tlle tracts tlmt directly
abut Lots 729 through 741 of Oak Forest Unit 7 and a 0.43 acre vacated
right-of-way.
3. Location: The subject properties are generally located west of Tuscawilla
Road, between Milky Way and Trotwood Boulevard.

5. Existing Land Use. L..oning. and FLUM: Existing land use, zoning and
FLUM are depicted in detail on Attachments D through F. The following
table depicts existing leUld uses, FLUM designations and zoning for the
subject properties and adjacent properties.

6. Development Trends: 'The subject properties, including both the 0.81 acre
parcel and the 0.43 acre vacated right-of~way, are undeveloped. With U1e
exception of single-f~ullily development to U1e south, UIe surrounding area is
eiUIer undeveloped or developed for agricultural uses. WiUI U1e recent
adoption of the nearby Town Center future lemd use and zoning
classifications, properties in and around UIe area are expected to experience
greater development activity as supporting infi-astructure lor the Town
Center is constructed.
7. Petitions of Opposition and/or SUPJ)ort: A petition by UIe property owners
of LoL" 729 through 741 of Oak Forest Unit 7 was filed in UIe City Clerk's
ollice supporting UIe application.
F. Considerations:
1. The sul~ject properties are comrnised of a 0.81 acre tract that direcUy abuts
Lots 729 through 741 of Oak Forest Unit 7 to UIe norU1 and a 0.43 acre
vacated right-of-way which direcuy abuts the 0.81 acre tract to the norUI.
2. BOUI tracts were annexed into the City in August 2000 but were never
assib'lled City FLUM or zoning designations.
3. Following the vacation of the 0.43 acre right~of~way in April 2001, half of it
reverted to the owner of UIe property north of its location (Tuscawilla
Office Park) and UIe other half reverted to UIe owners of UIe 0.81 acre tract,
which abuts T'uscawilla Unit 7.
4. BOUl tracts were acquired in May 2001 by the abutting property owners of
Tuscawilla Unit 7 cUld recorded by deed in UIe Seminole County Registry.
5. Following annexation into UIe City and acquisition by the Oak Forest Unit 7
property owners, the subject properties were never ollicially subdivided or
recombined with Lots 729 through 741.
6. The Seminole County Property Appraiser's Ollice has assigned individual
property identification numbers for each portion of UIe 0.81 acre tract UIat
has been partitioned by deed, as shown in Exhibit G and described under
lIE. Site Infom1c1.tioIJ.
7. The incorporation of the subject property into the Tuscawilla PUD would
be pursuant to the future subdivision and recombination of the subject
properties into Lots 729 through 741 of Oak Forest Unit 7 as herein
described.
In. ANALYSIS
A. Justification for Amendments:
The subject properties adjoin Lots 729 through 741 of Oak Forest Unit 7, which
are developed for low density residential uses (approximately 1.2 to 3.5 units per
acre) and zoned PUD. The subject properties are depicted as Medium Density
Residential on Seminole County's FLUM and zoned A-I Agricultural District.
Now that both properties are within the City of Winter Springs, the zoning and
future land use maps should be amended to City designations to eliminate the
inconsistency between adopted hlture land use cUld zoning.
The subject properties would bendit fi'om the FLUM and zoning anlenclments.
The linear configuration of both properties is currently preemptive to development.
The adoption of a low density residential future land use for these properties, along
Witll their combination witll tlle adjoining lots of Oak Forest Unit 7, would not
lower tile density beyond tllat which is established for low density residential and
would tllerefore be consistent witll the FLUM established by tile comprehensive
plan.
B. Public Facilities and Services:
The subject properties would eventually be combined with Lots 729 tilrough 741 of
Oak Forest, which are already developed for low density residential use. Since no
other changes arc being proposed to those existing single-l~ul1ily developments, the
proposed amendments would have no impact on public facilities and/or services.
C. Nuisance Potential of Proposed Use to Surrounding Land Uses:
The proposed amendments would not alter the character nor create tlle potential
for nuisances to surrounding land uses, since no additional land uses would be
created.
D. Consistency with the Comprehensive Plan:
The proposed amendments would make tlle FLUM and zoning map designations
consistent for tlle subject properties, while allowing fDr tlle continuation of tlle low
density residential future land use established by the comprehensive plan fDr Oak
Forest Unit 7 of tlle Tuscawilla pun.
IV. FINDINGS
A. The request is consistent with all applicable goals, ol~jectives and policies of the
City's adopted comprehensive plan.
B. Considering the type and location of uses involved and the general character of the
area, the request would not result in any incompatible land uses, including such
factors as height, bulk, scale, intensity, traIlic, noise, drainage, dust, lighting,
appearance, cmd other similar applicable factors.
v. STAFF RECOMMENDATIONS
Staff believes the proposed amendment to the PUD development plan is substantially
consistent with the approved final development phm and recommends that the planning
and zoning board approve the proposed change, in accordance with City Code Section 20-
359.
Stair further recommends UIat UIe planning and zoning board approve the amendment of
UIe FLUM from (Seminole County) Medium Density Residential to (City of Winter
Springs) Low Density Residential and the amendment of UIe oHicial zoning map from
(Seminole County) A-I Agricultural to (City of Winter Springs) PUD, subject to UIe
following condition:
A. Prior to the FLUM and zoning map amendments becoming eHcctive, UIe owners of
the subject properties must obtain approval for the alteration of UIe final
subdivision plan as stated in City Code Section 20-386, in order to combine UIe
subject properties with Lots 729 ulrough 741 of Oak Forest Unit 7 and leg-ally
record UIe same.

We, the members of the North Cheoy Lee Circle Group, purchased extensions to our
property in May 2001. Shortly afterwards, a right of way was vacated by the City of
Winter Springs, giving each propeI1y owner an additional fifteen feet along the northern
boundary, We the property owners would like to request:
1, That the City of Winter Springs annex into the city our property extensions,
including the vacated right of way, if it has not been done so to date. I
2. That the City of Winter Springs change the zoning of this property, including
the vacated right of way, from agricultural to residential.
