REQUEST: The Public Works Department requests the City Commission validate the staff recommendation finding the Highlands Apartments to be built in substantial accordance with the Final Engineering plans and to accept the potable water and sanitary sewer infrastructure for ownership and maintenance. PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding the Highlands Apartments to be built in substantial accordance with the Final Engineering plans per Section 9-178 and to accept the potable water and sanitary sewer infrastructure for ownership and maintenance in order for Certificates of Occupancy to be issued. Highlands Apartments consists of 42 apartments on 2.069 acres, located within the Highlands Planned Unit Development (PUD), along the west side of Sheoah Boulevard and immediately north of the existing Seville on the Green Apartments. The project is now known as "GolfPointe Villas @ Highlands." APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. 091106_ COMM _ Consent_ 402_ Highlands Apartments_Acceptance September 11, 2006 Consent Agenda Item 402 Page 2 FINDINGS: l) The site has been constructed in substantial accordance with the final engineering plans approved by the City Commission at the March 8, 2004 City Commission meeting. 2) All City agencies have found the work to be acceptable, except as noted in the recommended conditions of approval below. 3) The developer, MNH Enterprises, Inc., has provided a two-year, 10% maintenance letter of credit to the City for the water and sewer facilities that are being turned over to the City for ownership and maintenance. RECOMMENDED CONDITIONS OF APPROVAL: l) Finish swale grading along the south side of the entrance driveway 2) Repair the cracked sidewalk along Sheoah Boulevard at the south end ofthe site 3) Remove the two dead trees identified by the City's landscape inspector 4) Repair the irrigation system at the row of hedges in front of the retaining wall RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding Highlands Apartments (GolfPointe Villas @ Highlands) to be built in substantial accordance with the Final Engineering plans, subject to the four conditions listed above, and accept the potable water and sanitary sewer infrastructure for ownership and maintenance. IMPLEMENTATION: Certificate of Occupancies for those units eligible can be issued after Commission approval and completion of the items listed in the conditions of approval.
