PURPOSE: The purpose of this agenda item is to approve and authorize recordation of the Atcher plat for 4.28 acres, located at the northwest comer of the intersection of Bahama Road and Shore Road APPLICABLE CODE: Section 9-3. Dividing platted property. Section 9-4. Waiver to subdivision requirements. Section 9-75. Final Plat, contents and recording procedures. Section 9.77. Approval of final plat. Code Section 9-78. Recording/distribution of the final plat. Chapter 177, Florida Statutes. Chapter 197, Florida Statutes (Section 197.333 When taxes due; delinquent). CONSIDERATIONS: The site has a Rural Residential Future Land Use designation and R-lAA zoning. The site is are-plat of Lot 10 and a portion of Lot 9 of Block 2, of North Orlando Ranches, Section 5. The site contains an existing single family residence and accessory structures and a wetland. The applicant has depicted the wetland and its 25 foot wide upland buffer in a conservation easement. The proposed lots appear consistent and compatible with adjacent lots. FINDINGS: 1. The plat is consistent with the Comprehensive Plan and City Code. 2. The City's surveying consultant has reviewed the plat and has certified that it meets the platting requirements of Chapter 177, Florida Statutes. September 12,2005 Regular Agenda Item 502 Page 2 3. The on-site wetlands and a 25 foot wide upland buffer are depicted on the plat in a conservation easement. 4. The DRC has reviewed the plat and recommends approval, subject to the City Attorney's review and approval of the plat and title certification - applicant to make any changes or provide any additional information required by the City Attorney, prior to execution and recordation. The applicant pays for recordation and the City's copies of the plat. RECOMMENDATION: Staff recommends that the City Commission approve and record the Atcher plat, subject to the City Attorney's review and comments. ATTACHMENTS: A Atcher Plat.
