REQUEST: Community Development Department requests that the CommissIon approve the Wallace final subdivision plat, and authorize its recordation. PURPOSE: The purpose of this agenda item is to approve and authorize recordation of the Wallace plat. The applicant wishes to sell the front 0.95 acre of the 1.58 acre site to Apex Transmission (final engineering approved October 25,2004; revised final engineering plans incorporating the division were approved June 25, 2005). APPLICABLE CODE: Section 9-3. Dividing platted property. Section 9-4. Waiver to subdivision requirements. Section 9-75. Final Plat, contents and recording procedures. Section 9.77. Approval of final plat. Code Section 9-78. Recording/distribution of the final plat. Chapter 177, Florida Statutes. Chapter 197, Florida Statutes (Section 197.333 When taxes due; delinquent). CONSIDERATIONS: The 1.58 acre site is located on the east side of US 17-92, just south of Five Points Motors and 2 lots north of Cycle Riders. The site has undergone 2 iterations of final engineering approval for the Apex Transmission shop. The property shares a retention pond and a cross access easement is provided to the 0.63 acre vacant commercial lot in the rear. The site has an Industrial Future Land Use designation and C-2 Commercial zoning. FINDINGS: 1. The plat is consistent with the Comprehensive Plan and City Code. 2. The City's surveying consultant has reviewed the plat and has certified that it meets the platting requirements of Chapter 177, Florida Statutes. August 8,2005 Regular Agenda Item 502 Page 2 3. The City Commission approved the Apex Transmission final site plan for the front 0.95 acre of the site on June 25, 2005.. 4. The DRC has reviewed the plat and recommends approval, subject to the City Attorney's review and approval of the plat and title certification - applicant to make any changes or provide any additional information required by the City Attorney, prior to execution and recordation. The applicant pays for recordation and the City's copies of the plat. RECOMMENDATION: Staff recommends that the City Commission approve and record the Wallace plat, subject to the City Attorney's review and comments. ATTACHMENTS: A Wallace Plat. COMMISSION ACTION: 2
