PURPOSE: Applications for signage within the Town Center are not drawing upon the creativity allowed for and encouraged by the Town Center Code. Some applicants that would be interested in pursuing more creative signage are dissuaded by the current Code. APPLICABLE LAW AND PUBLIC POLICY: Florida Municipal Home Rule Powers Act. Section 166.041 (3)( c), Florida Statutes. Comprehensive Plan, Future Land Use Element- Policy 5.2.9 Sign age. Winter Springs Charter Section 4.15- Ordinances in General. City of Winter Springs Code of Ordinances Sec. 20-327. Architectural guidelines. (I) Sign age CHRONOLOGY: June 13,2005- June 30, 2005- The City Commission directed Staff to proceed with an update to the Town Center Signage Code. The City Commission approved First Reading of Ordinance 2005-24 amending the Town Center Signage Code. Public Noticing in Orlando Sentinel June 27,2005- CONSIDERATIONS: Two years ago, the Community Development Department prepared Visuals for the purpose of better illustrating design concepts contained in the Town Center Signage Code. The Commission responded favorably and directed these to be included in a future update to the Code. In January (2005) the Commission adopted new Comprehensive Plan Future Land Use @) July 11, 2005 Public Hearing Agenda Item 402 Element language for the Urban Central Business District, which requires creativity in slgnage: Policy 5.2.9: Signage. Commercial shop front signage shall include a variety of creative signage types (including projecting signage and fin signs) and may include the use of exposed neon for building fayade signage as set forth in the Town Center District Code. Directional (wayfinding) signage shall be utilized to direct pedestrians to businesses and streets. The current Town Center Code does not address some aspects of signage encouraged in the new language of Policy 5.2.9. Those that would be interested in pursuing more creative signage are dissuaded by the Code. For example, Dover-Kohl has indicated that Fin Signs are appropriate in character for the Town Center, but that their size is not permitted by right within the Code, as they exceed the maximum 10 square feet allowed for a projecting sign. According to Dover-Kohl, Fin Signs are intended to be approved on a case by case basis by the DRC. However, given the language which stipulating a maximum size, an applicant would be required to get a special exception. This additional process, expense, and time delay is at odds with our Comprehensive Plan language. The attached ordinance addresses these concerns. A powerpoint presentation was shown on June 27, 2005 to illustrate examples of each of these sign types. FINDINGS: The current Town Center Code does not address some aspects of signage encouraged in the Comprehensive Plan. Those that would be interested in pursuing more creative signage are dissuaded by the existing Code. Dover-Kohl has sent a memo supporting the proposed code change. (see Attachment A) RECOMMENDATION: Staff recommends that the City Commission hold a Public Hearing for Final Reading! Adoption of Ordinance 2005-24 which revises the "Town Center" zoning district's signage regulations. Wavfiodioe; Sie;os The proposed code language amendment states "Wayfinding Signage is encouraged, but must maintain the uniform design standards adopted by the DRC for the Town Center." It is the intent of this language to allow Wayfinding Signage. . As stated, Design Guidelines will be adopted by the DRC. To date, there are no Design Guidelines. In the near future, Staff will prepare Design Guidelines that will guide the design and placement of Way finding Signage. The development of these Guidelines will be prepared with input from our consultants and representatives of the James Doran Company. Once the Design Guidelines are compiled they will come before the City Commission (who acts as the Town Center DRC) for review, comment and approval. Design Guidelines from the Colorado Springs Downtown Action Plan are attached for your reference. It is anticipated that the City of Winter Springs' Town Center Wayfinding Signage would address as a minimum the material included here. The Guidelines are to become standardized and official for uniform incorporation throughout the Town Center. Although Wayfinding Signage Design Guidelines have not been prepared or adopted, Ordinance 2005-24 can be adopted with the given language and therefore should not be delayed. The implementation of Wayfinding Signs in the Town Center will reduce code violations from people placing "snipe signs". (Section 16-51 defines Snipe Signs as "any sign of any material whatsoever that is attached in any way to a utility pole, tree or any object located or situated on a public road right-of-way.") WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City of Winter Springs, Comprehensive Plan, Future Land Use Policy 5.2.9 requires creativity in signage in the City's Urban Central Business District including projecting signage and fin signs; and WHEREAS, the City's Town Center Consultant has advised the City that high quality signage with a great deal of variety is a hallmark of authentic town centers; and WHEREAS, the City Commission hereby finds that it is in the best interests of the City to amend the Town Center District Code to implement said policy; and WHEREAS, the City Commission ofthe City of Winter Springs, Florida, hereby finds this Ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. reference. Recitals. The foregoing recitals are hereby incorporated herein by this Section 2. Code Amendment. The City of Winter Springs Code, Section 20-327(f) is hereby amended as follows: (underlined type indicates additions and strikeout type indicates City of Winter Springs Ordinance No. 2005-24 Page I of 4 deletions): Sec. 20-327. Architectural guidelines. (f) Signs: (1) General requirements. . All signs shall be subject to a discretionary aesthetic appropriateness review by the DRC in order that signs are consistent and in harmony with the Winter Springs Town Center. The DRC shall use graphics in this section as nonbinding guidelines, but shall make a determination of appropriateness on a case by case basis. . Signs shall be flat against the facade, mounted projecting from the facade, or mounted above the top of the facade.. Free standing monument signs are permitted by special exception along State Road 434 frontage. Temporary menu board signs are permitted subiect to the restrictions and uniform design standards set forth in this Town Center Code. Wayfinding signage is encouraged. but must maintain the uniform design standards adopted by the DRC for the Town Center. . Signs shall be externally lit. Individual letters and symbols may be internally lit or back-lit and may proiect no more than twelve (12) inches from the facade. (2) Finish materials . Wood: painted or natural . Metal: copper, brass, galvanized steel, aluminum . Painted canvas . Neon . Paint/engraved directly on facade surface (3) Configurations. . Maximum gross area of signs on a given facade shall not exceed ten (10) percent of the applicant's facade area. City of Winter Springs Ordinance No. 2005-24 Page 2 of 4 . Maximum area of any single sign mounted perpendicular to a given facade shall not exceed 10 square feet, except for FIN signs. All proiecting signs shall be installed in such a manner that there shall be no visible angle iron support structure above a roof. building face or walL unless such brackets are incorporated into the signage as decorative elements ofthe slgnage. . Signs shall maintain a minimum clear height above sidewalks of eight (8) feet. . All signs shall be designed to be compatible with the respective storefront and subiect building in scale. proportion. and color and should be visually interesting and compatible in the context of the town center guidelines. . Marquee signs shall be mounted substantially parallel with the face ofthe canopy or marquee but shall not be located in such a way as to cause a reduction in the minimum clearance standards set forth in Section 20-326. In addition. marquee signs shall not extend more than two (2) feet above the canopv or marquee to which it is attached. .! Menu Board signs are temporary accessory signs which display information about the goods and services of adiacent business that customarily have frequent walk in traffic such as eating and drinking establishments and light retail businesses. A maximum of one menu board sign shall be allowed per street address. .! Menu signs shall be utilized only during regular business hours and shall be removed during non-business hours and during serious incidents of inclement weather that may destabilize the menu board. Menu Boards may be placed on private property or within the public right-of-way. provided thev do not interfere with vehicle access. pedestrian movement. or wheel chair access to. through. and around the site. At least six (6) feet of clear sidewalk width must remain for pedestrian traffic. The total sign area per face shall not exceed six (6) square feet. Maximum height shall be four and one-half(4 1/2) feet. . FIN signs are vertically oriented projecting signs. that are uniquely situated and customized for high visibility. Fin signs shall not exceed twenty-eight (28) feet in height above the ground and shall be placed at least 12 feet above the public sidewalk. Fin signs shall be between fifteen (15) square feet and twenty-five (25) square feet in area. but shall not extend more than five (5) feet from the building wall. All fin signs shall be installed in such a manner that there shall be no visible angle iron support structure above a roof. building face or wall unless such brackets are incorporated into the signage as decorative elements of the signage. City of Winter Springs Ordinance No. 2005-24 Page 3 of 4 Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions . All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent ofthe conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to City Charter. Signs shall maintain a minimum clear height above sidewalks of eight (8) feet. . All signs shall be designed to be compatible with the respective storefront and subiect building in scale, proportion, and color and should be visually interesting and compatible in the context of the town center guidelines. . Marquee signs shall be mounted substantially parallel with the face of the canopy or marquee but shall not be located in such a way as to cause a reduction in the minimum clearance standards set forth in Section 20-326. In addition, marquee signs shall not extend more than two (2) feet above the canopy or marquee to which it is attached. !. Menu Board signs are temporary accessory signs which display information about the goods and services of adiacent business that customarily have frequent walk in traffic such as eating and drinking establishments and light retail businesses. A maximum of one menu board sign shall be allowed per street address. !. Menu signs shall be utilized only during regular business hours and shall be removed during non-business hours and during serious incidents of inclement weather that may destabilize the menu board. Menu Boards may be placed on private property or within the public right-of-way, provided they do not interfere with vehicle access, pedestrian movement, or wheel chair access to, through, and around the site. At least six (6) feet of clear sidewalk width must remain for pedestrian traffic. The total sign area per face shall not exceed six (6) square feet. Maximum height shall be four and one-half (4 112) feet. . FIN signs are vertically oriented proiecting signs, that are uniquely situated and customized for high visibility. Fin signs shall not exceed twenty-eight (28) feet in height above the ground and shall be placed at least 12 feet above the public sidewalk. Fin signs shall be between fifteen (15) square feet and twenty-five (25) square feet in area, but shall not extend more than five (5) feet from the building wall. City of Winter Springs Ordinance No. 2005-24 Page 3 of 4 Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent ofthe conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to City Charter.
