PURPOSE: The purpose ofthis agenda item is for the City Commission, acting in its capacity as the DRC, to determine that hair care facilities and tanning salons, although omitted from the specific list of permitted uses in the Town Center, are consistent with the listed permitted uses and are in harmony with the spirit of the Winter Springs Town Center Master Plan. CONSIDERATIONS: The staffDRC met with representatives of the James Doran Company and discussed what appears to have been a mere over-sight in the Town Center Code. Hair care facilities are certainly a part of traditional down-town areas. Tanning salons are a more recent phenomenon, but appear to be of similar use - grooming. Although not included in the request, nail shops are a similar use (especially similar to tanning salons) that should also be addressed. This appears pertinent since some beauty shops incorporate both tanning and nail grooming. APPLICABLE LAW AND PUBLIC POLICY: Section 20 - 323, Permitted Uses. 1 September 9,2002 Regular Item L Page 2 FINDINGS: The request is consistent with the Town Center concept, the other permitted uses, and in harmony with the spirit of the Winter Springs Town Center Master Plan. RECOMMENDATIONS: The staffDRC recommends that the City Commission, in its capacity as the DRC, determine that the proposed hair care and tanning facilities are consistent with the other permitted uses for the Town Center and are in harmony with the spirit of the Winter Springs Town Center Master Plan. Staff further recommends that nail salons be given this same consideration.
