REQUEST: The Public Works Department requests the City Commission validate the staff
recommendation finding Nursery Road Warehouses Phase IIA to be built in
substantial accordance with the Final Engineering plans and to accept the potable
water and sanitary sewer infrastructure for ownership and maintenance.
PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff
recommendation finding Nursery Road Warehouses Phase IIA to be built in substantial
accordance with the Final Engineering per Section 9-178 and to accept the potable water
and sanitary sewer infrastructure for ownership and maintenance in order for Certificates
of Occupancy to be issued. This site is located on the northeast corner of Nursery Road
and 17-92.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on lots;
exceptions.
(c) Where the building official has an authoritative method of assurance that the improvements
will be completed in accordance with approved plans, such as withholding occupancy, the
building official may issue building permits upon advising the developer that all or partial
occupancy will be restricted until satisfactory completion of the improvements has be
accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city
commISSIon.
FINDINGS:
1) All City agencies have found the work to be acceptable.

2) The Final Engineering for Phase II was approved by the City Commission at the March 8,
2004 Commission meeting. The work has been determined to be constructed in accordance
with the approved final engineering plans.
3) Project Summary:
a. The overall project consists of the construction of three new buildings (warehouse /
retail) on a 6.628-acre site. Two existing buildings on the site will remain.
b. The project is being built in three phases.
i. Phase I is complete and consisted of some preliminary site development work
per the Developer's Agreement.
11. Phase lIA consists of the construction of one 24,000 square foot warehouse
building, along with the associated site and utility work.
111. Phase lIB consists of the construction of two new buildings and the completion
of the associated site and utility work. Construction has not started on the
Phase lIB buildings, although the developer has indicated that he intends to
proceed with Phase lIB in the near future.
4) The conditions of the Developer Agreement applicable to the Phase lIA construction have
been met.
5) The potable water and sanitary sewer improvements are to be dedicated to the City for
ownership and maintenance and separate 2-year maintenance bond.
6) The location of the phase line between Phases IIA and liB was adjusted at the request of the
developer's engineer because the existing septic system serving the existing buildings needed
to remain operational until the new sanitary sewer system was approved by the City and
cleared by FDEP. The phase line adjustment shifts 14 parking spaces from Phase lIA to Phase
liB; however, the number of parking spaces constructed to support Phase lIA (80) meets the
City Code for this type of facility, and the total number of parking spaces planned at build-out
is unchanged.
RECOMMENDA TION:
Staff recommends that the City Commission validate the staff recommendation finding
Nursery Road Warehouses Phase IIA built in substantial accordance with the Final Engineering
per Section 9-178, and accept the potable water and sanitary sewer infrastructure for ownership
and maintenance, subject to the following conditions:
1. The existing perimeter masonry wall completed in Phase I (per the Developer's
Agreement) shall be painted before the completion of Phase lIB.

IMPLEMENTATION:
Certificate of Occupancies for those units eligible can be issued after Commission
approval. Phase lIB will be brought back for approval when completed in the future.
