REQUEST:
Mayor John F. Bush requests that the City Commission discuss a possible
"expense allowance"/compensation/pay/funding increase for those that hold the
title of Mayor and City Commissioners for the City of Winter Springs.
PURPOSE:
This Agenda Item was requested by Mayor Bush and Members of the City
Commission for discussion of a possible increase to their "expense
allowance" / compensation/pay/funding.
CONSIDERATIONS:
The following is an excerpt from the June 9, 2005 Budget Workshop in which this
issue was discussed:
City Commission:
Discussion ensued on what the Commissioners with the City of Kissimmee are
paid.
With further discussion on what other Commissioners are paid, and a possible
increase for this City Commission, Commissioner Krebs said, "When was the last
time the Commission got any kind of increase?" Commissioner Krebs added, "I
think we should look into that." Manager McLemore spoke of information that
the Florida League of Cities has related to this issue. Commissioner Krebs noted,
"Please include Kissimmee." Deputy Mayor Blake added, "Please include
Kissimmee - and Apopka."

With further discussion, Mayor Bush remarked, "I think the Commission is
considering an increase - for the Commissioners and the Mayor would be
appropriate to be considered - something within reason. And, I don't know if we
need a Survey of the other cities."
Commissioner McGinnis said, "I do think an increase is relevant." Manager
McLemore stated, "The question is whether you want - someone to give you an
opinion that would - settle this issue, or do you want to leave it alone."
Commissioner McGinnis remarked, "I am happy to leave it alone - on the tax"
issue."
Furthermore, Deputy Mayor Blake noted, "Why don't we just bring this up - at
Monday night's Meeting." Commissioner McGinnis commented, "Okay." Mayor
Bush also stated, "Okay." Regarding the next Budget discussion, Deputy Mayor
Blake said, "Monday, we will have to set the next Budget Meeting."
Additionally, Mayor Bush suggested to the City Commission "Why doesn't
everybody look at their calendars, before - Monday night."
Commissioner Krebs then said, "When you talked about bringing up this - the
Commission's Budget, Non-Salary Expense - do we have it on as an Item, or do
you want it to just be brought up under a Seat?" Deputy Mayor Blake noted,
"Ideally, I would like to bring it up earlier than later." Commissioner Krebs said,
"Exactly." Deputy Mayor Blake then said, "Since the Mayor runs the Agenda, if
the Mayor wants to bring it up at anytime, I suppose it probably could be." Mayor
Bush stated, "Okay, I will do that."
The following is an excerpt from the (unapproved) June 13, 2005 City
Commission Meeting in which this issue was also discussed.

Next, Mayor Bush remarked, "At our Budget Meeting, we did talk about -
reviewing the Commission and the Mayor's expense information and we even
talked about bringing it up tonight, but - I think it should be an agended item."
Mayor Bush then stated, "I would like to have this as an Agenda Item for the next
Meeting, and make sure it is advertised, and people know about it, etcetera."
Deputy Mayor Blake noted, "I think that sounds like a good idea." Commissioner
McGinnis stated, "Good." Commissioner Krebs remarked, "I think that is an
excellent idea." Mayor Bush summarized that "I think we ought to have it
addressed at the next Meeting."

The following is an excerpt from the City of Winter Springs' Charter:
Section 4.04. Compensation; expenses.
The city commission may determine the annual salary of mayor and
commissioners by ordinance, but no ordinance increasing such salary shall
become effective until the date of commencement of the terms of mayor and
commissioners elected at the next regular election, provided that such election
follows the adoption of such ordinance by at least six (6) months. The mayor and
each commissioner of the city shall be reimbursed from the city treasury to cover
the expenditures naturally and necessarily incurred in the performance of their
duties of office and said reimbursement for expenses shall be established by
resolution.
Other Information:
Included as an Attachment is an excerpt from a recent email sent to the City
Commission from the City Clerk, who checked with the City of Kissimmee on
what their Commission is paid.
The City Manager has information from the Florida League of Cities on all other
municipalities that they have surveyed.

REQUEST: City Manager requests the City Commission adopt Resolution 853
establishing the monthly expenditure allowance for the Mayor and City Commissioners.
PURPOSE: The Purpose of this Agenda Item is to have the City Commission adopt
Resolution 853 establishing the monthly expense allowance for the Mayor and City
Commissioners.
CONSIDERATION: At the July 8, 1998 Special City Commission Meeting, the
Commission discussed their reimbursement allowance relative to elected officials in other
comparable Cities in Florida.
The Commission discussed an increase to the Mayor's and Commission's monthly
expense allowance for expenditures naturally and necessarily incurred by the Mayor and
Commission by virtue of their offices.
The Commission directed the City Manager to prepare a Resolution reflecting the
increased monthly expense allowance for the Mayor and Commission as discussed b the
Commission.
Resolution 853 complies with the City Commission's directive.
FUNDING: none
RECOMMENDATION: It is recommended that the City Commission review
Resolution 853 establishing the monthly expense allowance for the Mayor and City
Commission and make whatever decision it deems appropriate.

RESOLUTION NO. 853
A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA, ESTABLISHING THE AMOUNT TO BE
PAID BY THE CITY TO THE MAYOR AND CITY
COMMISSIONERS ON A MONTHLY BASIS AS AN
EXPENSE ALLOWANCE FOR EXPENDITURES
NATURALLY AND NECESSARILY INCURRED BY
THEM PURSUANT TO SECTION 4.04 OF THE CITY
CHARTER; CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the Charter allows the City Council of the City of Winter Springs, Florida, to
provide for expense reimbursement for the Mayor and Commission of the City from the
City Treasury for expenditures naturally and necessarily incurred by them by virtue of
their offices; and
WHEREAS, the Charter provides that said reimbursement for their expenses is to be
established by Resolution; and
WHEREAS, the fees set forth herein are comparable to reimbursement allowances of
elected officials in other cities in Central Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSIONERS OF THE
CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
Section I - That the Mayor of the City of Winter Springs, Florida shall be paid the sum of
Seven Hundred Dollars ($700.00) per month from the City Treasury for an expense
allowance for expenditures naturally and necessarily incurred by the Mayor.
Section II - That each City Commissioner for the City of Winter Springs, Florida, shall be
paid the sum of Six Hundred Dollars ($600.00) per month from the City Treasury for an
expense allowance for expenditures naturally and necessarily incurred by each
Commissioner.
Section III - This Resolution shall remain in force and effect until supplemented,
amended, repealed or otherwise altered.
Section IV - All Resolutions or parts of Resolutions in conflict with this Resolution are
hereby repealed.

Reading at the next Commission Meeting. Seconded by Commissioner Gennell.

C. Requesting direction relative to the creation of an Assessment District for street
and drainage improvements to Colt Drive:
Manager McLemore stated he would like to hold a workshop with the property owners on
a Staff level. Discussion.

the property owners and hold a workshop at the Staff level with regards to an
Assessment District for street and drainage improvements to Colt Drive. Seconded
by Commissioner Blake. Discussion. V ote: Commissioner Gennell: aye;

Commissioner Gennell asked about the cost of a title search. Attorney Guthrie
stated it should cost approximately $350.00.

D. Requesting the Commission set an appropriate number of workshop dates in August
to discuss the East-side Reclaimed Water Master Plan, the Arbor and Flood Plain
Ordinances, the Community Pool and the Evaluation and Appraisal Report for the
Comprehensive Plan:

Commissioner Gennell asked about information regarding construction signs.
The Commission determined that they will have a workshop on August 3, 1998 to discuss
the EAR and the community pool and a workshop on August 17, 1998 to discuss the
Arbor and Flood Plain Ordinances and the East-side Reclaimed Water Master Plan~ the
workshops will start at 6:30 p.m.

Motion was made by Commissioner Gennell to adopt Resolution 853 and the
effective date to be October 1, 1998. Seconded by Commissioner Blake. Discussion.

passes.

These salaries are noted in their Charter, and changes with their population. I went onto
their Website and copied the following excerpt (noted in green ink) related to this issue:
SECTION 6 COMPENSATION OF COMMISSIONERS.
(a) Each member of the city commission shall receive as an annual salary the amount
indicated below, based upon the population of the City of Kissimmee. In addition, to the
base salary shown, compensation shall be made for population increments over the
minimum for each population group at a rate of $0.40 per resident.

City of Kissimmee Information
(c) Annual compensation shall be automatically adjusted within thirty (30) days
after receipt of the annual population figures, as compiled by the Executive Office of the
Governor, in accordance with the Florida Statutes No. 186.901. This annual
compensation shall be prorated over the subsequent twelve-month period.
(d) Definition. "Population" means the population according to the latest annual
determination of population of local governments produced by the Florida Department of
Administration in accordance with Florida Statutes chapter 23.019.
(e) The formula set out in subsections (a) through (d) shall not be amended except
after passage of a duly authorized ordinance and submission for referendum as authorized
under Florida Statutes chapter 166. (Ord. No. 896, S 1, 11-1-77; Ord. No. 926, S 1,5-30-
