REQUEST: Community Development Department is advising the City Commission of the
current City policy for temporary structures/canopies/portable carports.
PURPOSE: This agenda item is to provide current information to the Commission related
to the issuance of permits for temporary structures/canopies/portable carports.
CONSIDERATION:
The Building Official is has determined that the carport structures made from aluminum,
plastic, or similar materials (as defined below) do not and cannot meet the structural
requirements of the Florida Building Code - 2004 edition. Therefore, the Building Official
cannot regulate these structures as permanent structures. It is Staff s policy that we do not
issue a permit for these structures because they cannot meet the Building Code requirements
for a permanent structure and the applicants desire to treat them as permanent structures. If a
permit were issued for a temporary structure, said permit would expire after 180 days and the
carport structures would then become a Code violation.
The following information details the Building Official's narrative and the applicable Building
Code sections:
CANOPIES: Historical Policy of the Building Official
CANOPIES: (Pipe frame with plastic or other coverings typically attached by a bungee
type chord). The Florida Building Code addresses this type of structure as a temporary
structure which can be installed for a specific period of time. Most of these canopies are
erected to cover boats and cars etc. throughout our City and are not intended to be
temporary in nature. Therefore it is the Building Official's interpretation that since the
Building Department cannot permit these canopies for temporary use and there is no way
that they can meet the standard set forth in the Florida Building Code as a permanent
structure, they will not be regulated by the Building Division at this time. This interpretation
is subject to the wishes of the City Commission's desire to provide more restrictions on
their use within the City.

Note: Most of the above temporary structures may not meet zoning regulations,
especially setbacks.
TEMPORARY STRUCTURES: Florida Building Code 2004
107.1 -The Building Official is authorized to issue a permit for temporary structures and
temporary use. Such permits shall be limited as to time of service, but shall not exceed
180 days. The Building Official is authorized to grant extensions for demonstrated cause.
3103.3-The provisions of this code shall apply to structures erected for a period of less
than 180 days. Tents and other membrane structures erected for less than 180 days shall
comply with Florida Fire Prevention Code. Those erected for a longer period of time
shall comply with the applicable sections of this code.
3103.1.1 Permit required. Temporary structures that cover an area in excess
of 120 square feet (11.16 m2), including connecting areas or spaces with a
common means of egress or entrance which are used or intended to be used
for the gathering together of 10 or more persons, shall not be erected, operated
or maintained for any purpose without obtaining a permit from the Building
Official.
3103.2 Construction documents. A permit application and construction
documents shall be submitted for each installation of a temporary structure.
The construction documents shall include a site plan indicating the location of
the temporary structure and information delineating the means of egress and
the occupant load.
3103.3 Location. Temporary structures shall be located in accordance with the
requirements of Table 602 based on the fire resistance rating of the exterior
walls for the proposed type of construction.
3103.4 Means of egress. Temporary structures shall conform to the means of
egress requirements of Chapter 10 and shall have a maximum exit access
travel distance of 100 feet (30,480 mm).

6-35 (b) Permit is required which shall be limited to a specific address for a maximum of 72
consecutive hours.
RECO MMEND A TI 0 N: Staff recommends that the Commission accept this information
as a description of the current status of the portable carport structures in the City. Staffwill
draft proposed code language that will allow the Building Department and the Code
Enforcement Division to limit the use ofthese structures as a permanent facility and will bring
this proposed language back to the City Commission within 60 days. Staff will also include
language as to how the existing structures are to be dealt with.
