PURPOSE: The purpose of this agenda item is to request authorization from the City Commission to appropriate funding in the amount of$249,454 for the design and construction of the City's portion of Gary Hillery Drive in conjunction with the Tuskawilla Square project. CONSIDERATIONS: ~ This agenda item is needed to authorize the City's portion of the cost to design and construct Gary Hillery Drive. This funding would reimburse Bryce Foster Corporation, the Developer of the Tuskawilla Square project, for the reasonable costs for the design and construction of the City's portion of Gary Hillery Drive in accordance with the terms of the Commission-approved Developer's Agreement. ~ On December 13, 2004, the City Commission approved a Developer's Agreement with Bryce Foster Corporation for the development of the Tuskawilla Square project, located at the northeast corner ofthe intersection of Winter Springs Blvd. and Northern Way. ~ Under the terms of the Developer's Agreement, the City agreed to reimburse Bryce Foster for the reasonable costs to design and reconstruct Gary Hillery Drive. The costs eligible for reimbursement consist of design (surveying, engineering, landscape architecture, etc.) and construction (clearing, grubbing, stormwater management facilities, pavement, striping, curb, gutter, sidewalks, etc.). ~ At the February 28, 2005 City Commission meeting, the Commission approved the Final Engineering for the Tuskawilla Square project, which included the proposed improvements to Gary Hillery Drive. The $249,454 requested in this agenda item provides for the City's portion ofthe construction of Gary Hillery Drive. June 13,2005 Regular Agenda Item 503 Page 2 };> $174,454 of the requested appropriation is for the complete roadway construction as depicted on the approved Final Engineering plans, including paving, sidewalks, on-street parking, curb and gutter, stormwater management facilities, and landscaping. };> $75,000 of the requested appropriation is an allowance for the design and construction of the four (4) decorative brick entrance features as depicted on the Gary Hillery Drive Concept Plan that was included in the approved Developer's Agreement (see Exhibit A). };> Bryce Foster has provided documentation to verify that the proposed roadway construction was subject to a competitive bidding process. };> A cost breakdown ofthe City's portion of Gary Hillery Drive is shown in Exhibit B. FUNDING: The funding source for this project is Fund 115 - Roadway Improvement Fund (one-cent sales tax for roadway reconstruction projects). A total of$150,000 was initially budgeted for this project as a part ofthe 2005/06 tentative budget. ALTERNATIVES: The City Commission has several alternatives: 1. Approve the full $249,454 for construction of the roadway and the entrance features. 2. Approve $174,454 for the roadway construction and defer or deny the $75,000 allowance for the entrance features. 3. Deny the funding request entirely. RECOMMENDATION: Staff recommends approval to authorize funding in the amount of $249,454 for the design and construction of the City's portion of Gary Hillery Drive, including the brick entrance features. IMPLEMENTATION: Project construction is set to begin in June 2005, with an estimated project completion in late 2005 (after 9/30/05) or early 2006 for the Gary Hillery Drive improvements.
