PURPOSE: This agenda item is to update the Commission on the status of current planning projects. CONSIDERATION: Avery Park - Construction continues. The parking study, required by Code for a special exception for Morrison Homes to install inoperable plastic shutters, has been provided - thus completing the requirements set forth in the Code for the special exception. per 9/23/02 agenda Belfaire(formerly Battle Ridge) - In May, all files and correspondence relating to the final engineering/subdivision plan and modification to the annexation and pre-development agreement were copied for Stenstrom, McIntosh, Colbert, Whigham and Simmons (the City of Oviedo's Attorney). Construction has been proceeding. A representative from both the Seminole County Planning Department and the Black Hammock citizens group inspected the approved plan and the First Addendum to the Annexation and Pre-development Agreement. Engle Homes is investigating the process for providing a sales trailer on-site. per 8/26/02 agenda Fox Run Preliminary Subdivision Plan- On March 26, staff received the application and plans for preliminary subdivision of a 5-10t residential subdivision on 1.28 acres at the west end of Panama Circle. This item was reviewed at the April 2, 2002, DRC. Staff awaits are-submittal per 4/22/02 agenda Garcia Driveway Re-locate. - Staff received an application from Manny Garcia to relocate a private drive/roadway from Tuscawilla Unit 5 onto an adjacent portion of Oak Forest Tract "A" that Mr. Garcia owns. The item was initially scheduled for the June 18, 2002, DRC, but was re-scheduled for the July 2, 2002, DRC. Staff received a partial response to the DRC October 28, 2002 Information Item A Page 2 comments and awaits a complete response. Due to the complexity of the issue, the partial response was addressed at the September 3,2002, DRC. Based on a clarification from the City Attorney, the applicant has provided additional information for staff to review. The necessary variance for the 12' wide roadway, without a sidewalk or curbing will be heard at the October 23, 2002, BOA meeting. per 10/28/02 agenda Highlands Apts., Phase II - The 42 unit apartment final site plan was approved on October 14, 2002. per 10/28/02 agenda JDC Calhoun - Construction continues. Buildings 9 and 11 are under construction. Buildings 13 and 14 are still in the permit stage. No solution for the Wendy's (Building No. 15) drive- thru access has been reached. Any modification of the approved site plan must be approved by the City Commission. Publix was issued a CO on Friday, October 18, 2002. The applicant has submitted plans depicting minor site plan changes and has spoken of receiving special approval for signage for a grand opening. per 10/28/02 agenda Miranda - Staff has inquired of Dover Kohl & Partners of specifics of the frontage roadway. This information was been forwarded to the applicant, who submitted a site plan on October 17, 2002. per 10/28/02 agenda Nursery Road (Phil Reece) - Staff awaits a building plan submittal for the walls and engineering plans for the storm-water pond. The City Manager sent Mr. Reeece a letter on August 23, reminding him of the requirements (improvements and park dedication) set forth in the development agreement that was approved on July 8 and executed August 1, 2002. per 8/26/02 agenda Oak Forest Unit 7 (Triangular-shaped O.86-Acre Tract between Oak Forest & Tuskawilla Office Park) Trees that the homeowners removed without a permit have not been replaced. BJM Associates has submitted 2 draft plats and 1 boundary survey for preliminary review. No application or title certifications have yet been provided. per 10/28/02 agenda Parkstone - Construction continues. Since the City Commission accepted those potable water and sewer improvements that were to be dedicated to the City, the applicant has requested that the performance bonds (guaranteeing their installation) for units 3 and 4 be returned. A letter was sent to the bonding company clarifying this and that the City is ready to return the bonds. per 8/26/02 agenda SR 434 Retail(a.k.a. Villagio) - The applicant resubmitted revised plans on October 2,2002. Staff is still reviewing the plans and the engineer is correcting some minor code discrepancies that have been brought to his attention. per 10/28/02 agenda SR 434 Roadway Improvements Project - No additional information. per 4/22/02 agenda Torcaso Park Improvements- On March 27, staff received the final engineering/site plan for the City's Torcaso Park improvements. This item was reviewed at the April 2, 2002, DRC meeting. The City Engineer is working on plans for the park. per 8/26/02 agenda October 28, 2002 Information Item A Page 3 Tuskawilla Office Park - Construction is proceeding. per 10/28/02 agenda Tuskawilla Trails. - The preliminary subdivision plan (36 lots and a storm-water pond on 8.64 acres) was approved at the June 10, 2002, City Commission meeting. The final engineering plans have been resubmitted for staff review at the November 5, 2002, ORC. per 10/28/02 agenda Wagner's Curve - The final subdivision plan was submitted May 24, 2002, and reviewed at the June 4, 2002, ORC meeting. Staff awaits a re-submittal of the final subdivision plans. A variance application was submitted on August 22, 2002, requesting relief from the City's Subsection 9-241 ( e) storm-water management requirements. This variance will be heard by the BOA on October 23, 2002. A final subdivision plat was submitted on August 22, 2002, proposing to split the commercial from the residential portions of the site. The plat was reviewed at the September 3, 2002, ORC. Staff received additional information/material on October 2 and 3. per 10/28/02 agenda Winter Springs Elementary. - A memo has been sent to the City Attorney requesting verification of the applicability of the City's sign and dumpster pad enclosure regulations on school sites. The City Attorney has verbally opined that sign age is subject to the City's regulations. per 9/23/02 agenda Winter Springs Elementary (New - located on SR 419) - A preliminary site plan for a new elementary school, located generally northwest of the intersection of SR 434 and SR 419, was submitted August 21 and reviewed at the September 3, 2002, ORC. Staff awaits a re- submittal. per 9/09/02 agenda Board of Adjustment - The Board of Adjustment (BOA) will hear an application by Centex for relief from the City's Subsection 9-241 (e) storm-water management requirements, an application by M. A. Garcia from the City's roadway standards requirements to allow a 12' wide roadway without sidewalks or curbs, and an application by Thomas Binford to allow an existing non-conforming sign in the SR 434 Redevelopment District to remain.
