Phase II A is comprised of312 condominium units and 33,240 square feet of retail/restaurant space on 7.75 acres in the Winter Springs Town Center, located in the northeast quadrant ofTuskawilla Road and S. R. 434. PURPOSE: The purpose of this Agenda Item is for the Commission to consider and approve the final engineering/subdivision plan for 312 condominium units and 33,240 square feet of retail/restaurant space on 7.75 acres in the Winter Springs Town Center. APPLICABLE REGULATIONS: Comprehensive Plan Chapter 5, City Code Chapter 9, City Code. Town Center District Code (sections 20-320 thru 20-327). CONSIDERATIONS: Overview The 7.75 acre site is vacant land with a mixture of forested and open pasture areas. It is located within the Winter Springs Town Center on the east side ofTuskawilla Road, in the northeast quadrant of Tuskawilla Road and S.R.434. The subject parcel does not include the existing McDonald's site at the northeast corner of Tuskawilla Road and S.R. 434. The applicant proposes 312 condominium units and 33,240 square feet of retail/restaurant space along with two structured parking garages. The site plan includes a total of755 parking spaces. There are 670 structured parking spaces and 85 surface spaces internal to the project (along alleys, Town Center Street, and Tree Swallow Drive). In addition to the 755 permanent spaces provided, there are 123 temporary grassed spaces provided on the parcel ofland located immediately east of the McDonald's site, adjacent to S.R.434. July 10, 2006 Regular Item 301 Page 2 of 4 A traffic study has been submitted and approved by the City. This traffic study is consistent with the City's Town Center/S.R. 434 Corridor Master Plan and has been reviewed and approved by City staff. The traffic study and the associated improvements are consistent with the City's FDOT -approved corridor study. The Spine Road will be constructed as a part of Phase II A under a separate set of drawings that are subject to City review and approval. The S.R. 434 intersection of the Town Center Street and the access road east ofMcDonald'.s will remain right in/right out access points with no median openings. Three points of access to the Cross Seminole Trail are proposed as part of the final engineering plans. The Aesthetic Review submittal for this project was reviewed with views to and from the trail as an important factor in the final design of the buildings and site. The final engineering for Phase II A incorporates the extension of Tree Swallow Drive east of Tuskawilla Road and the construction of a town center street along the eastern boundary of Phase II A. Both of these roadways are in accordance with Section 20-325 of the City's Code of Ordinances (the Town Center Code) except as noted later in this report. The site has central water and sewer available, with adequate capacity. Stormwater capacity will be provided through the construction of a new stormwater pond east of the proposed Phase II B of the Town Center, adjacent to the Cross Seminole Trail bridge. This pond is shown as part of the final engineering documents for Phase II A and will be constructed as part of Phase II A. The approved mitigation for this pond is indicated on the attached Wetland Mitigation Plan (Exhibit B). A master lift station is being constructed as part of Phase II A that will have the capacity to serve Phase II A, Phase II B, Sonesta Point (fka Sonoma Pointe), and additional developable lands north of Phase II B that are not currently planned for development but have an assigned residential capacity of 200 units. The lift station will be secured and screened in accordance with the Town Center Code. Conditions for Approval of the Final Engineering 1. Remove the tree indicated in a handicapped parking space on Sheets A-I 00 and A-I 02 of the plans. 2. The fence shown around the lift station must comply with Section 20-327 of the City's Code of Ordinances. 3. All back-flow preventers and other utility items (e.g. utility boxes) must be shielded/screened to the satisfaction of the City. Staff remains concerned about the back flow preventers shown in the raised planters along Tuskawilla Road and Tree Swallow Drive. The landscape installation in these areas will be monitored by City Staffto insure adequate screening from the adjacent public areas. 4. All references to "Tree Swallow Road" need to be changed to read "Tree Swallow Drive". 5. All street lights, bollards, fixtures, and street signage are subject to staff review to ensure compliance with the Town Center Code. 2 July 10, 2006 Regular Item 301 Page 3 of 4 6. The raised planters along Tuskawilla Road near the intersection of Tree Swallow Drive shall be relocated to areas of the sidewalk that are not proposed for outdoor seating. 7. The Spine Road and the extension of Tree Swallow Drive to the Spine Road shall be constructed and accepted by the City prior to the issuance of any Certificates of Occupancy for any Phase II A buildings. 8. All aspects ofthe final engineering for Phase II A of the Winter Springs Town Center are subject to the stipulations contained in the Development Agreement approved in October, 2005 and the proposed Implementation Agreement. 9. The lift station design shall be subject to further staff review and approval. 10. The stormwater pond and/or its slopes shall be modified to allow for the provision of a 25' upland buffer from the landward extent of the FDEP, SJRWMD, or the ACOE delineation (whichever extends most landward) ofthe unmitigated wetlands. These buffers shall be dedicated in a conservation easement to the City (per the City's Comprehensive Plan). The applicant shall maintain the native plant material and remove the invasive species in this buffer area. City staff shall be consulted on the determination of the invasive species. Deviations from Code: (to be addressed through revisions to the Development Agreement) 1. Depth and width of buildings exceed code (Sec. 20-325) 2. Build-to lines have been exceeded (Sec. 20-325) 3. Not alII st floor residential units in east end of Building 2 have exterior access (entrance to face primary space - Sec. 20-325). This deviation was approved as part of the aesthetic review but needs to be documented in the Development Agreement (DA). 4. The proposed temporary grassed and light duty pavement parking area needs to be included as part of the revisions to the DA since the use of these materials is not specifically addressed in the City's Code. 5. Owners to pay the delta between cost of maintaining and replacing the upgraded lighting and street signage 6. Five hundred ($500) dollars shall be donated to the City's Tree Bank for each specimen tree (24" or greater trunk diameter at 12" above grade) to be removed from the site. The proposed development is located within the City of Winter Springs Town Center. 2. The attached final engineering/subdivision plan is consistent with the Comprehensive Plan, subject to subject to the items outlined above. 3. Any deviations from the Code must be addressed through a development agreement, special exception, or some other appropriate mechanism. 4. Street names on the plans are tentative and subject to approval by the County's 911 committee, to avoid duplication. RECOMMENDATION: Staff recommends the City Commission approve the attached final engineering/subdivision plans for Phase II A of the Winter Springs Town Center, subject to the conditions of approval enumerated above, inclusion of the above detailed deviations into the Development Agreement, and completion of the proposed Implementation Agreement.
