Authorization REQUEST: Information Services requests Commission approval of the Internet Web Site Posting Policy. PURPOSE: To obtain Commission approval uftbe Internet Web Site Posting Policy. CONSIDERATIONS: Information Services receives regular requests for items and links to be posted on the City's Internet web site. Tn addition to requests for links on the website, other requests for postings include event-related items which could include parades, Boy Scout events, Rotary Events, Cancer Society events, American Heart Association events, and others. The WebMaster needs to have a policy or set of guidelines to use in deciding what can and cannot be posted to the City's Internet web site. The City Attorney's office has drafted the attached policy for approval by the Commission. ATTACHMENTS: City of Winter Springs Web Site Posting Policy (draft) COMMISSION ACTION: City of Winter Sprin~ Web Site Postinl! Policy I. Purpose and Goal. The purpose of the City of Winter Springs's web site 1S to provide information about the City's government services, functions, activities, issues, operations, projects, as well as city- sponsored or co-sponsored local events. In establishing and maintaining its official web site, the City does not intend in any manner to create a public forum or other means by which public discourse, exchange of opinions, or discussion on issues of any nature may occur. Rather, the sole and limited purpose of the City's web site and permitted extemallinks is to provide information of a factual nature about the City of Winter Springs, including, hut not limited to, various services and resources available within and around the City, or as may be available from other governmental agencies. The goals of the web site are to encourage increased citizen participation in City goverrunent by making public information more readily available to them, to provide electronic access to City information through a logical single point of entry, and to keep the public informed of city services, functions, activities, issues, operations, projects, and events. II, Confidentiality, The Florida Public Records Act, codified at Chapter 119, Florida Statutes, applies to information processed, sent, and stored on the internet. Confidential information should not be posted on the City's web site. While the City of Winter Springs' web site may track overall site traffic, it doesn't collect individual user details unless a user voluntarily submits such information. It does not share that information with outside sources, and is committed to keeping such information confidential. If at any time, a user believes that the City of Winter Springs' web site is 110t protecting his or her privacy, the person should email the Webmaster, who will attempt to assess, and, if necessary, correct the problem. III. W ehmastcr. The Webmaster shall be responsible for maintaining the City's web site. All information prepared for posting on the City's web site shall be routed through the W ebmaster. The Webmaster is responsible for establishing maintenance procedures and style guidelines. The City Manager, or the City Manager's designee, is the ultimate authority regarding policy govemingthe City's web site. The Webmaster aims to carry out the City's web site posting policies day-to-day, but is subject to the authority of the City Manager or the City Manager's designee. These policies should include defining the look and feel of the web site or deciding who may post information on the site. Complaints about any aspect of the web site posting policy should be brought tirst to the attention of the Webmaster. If a complainant is unsatisfied, he or she may appeal to the City Manager or the City Manager's designee. The City Manager or the City Manager's designee reserves the right to make changes to the web site posting policy at any time. IV. Copvriehted Material The City web site shall not include copyrighted materials without the express, written consent of the owner of the copyright, unless such material is included as an express exemption to the Copyright Act, codified at 17 U.S.C. S 101 ef 'eq. V, Links, The City's web site may provide links to web sites for government and public educational institutions, homeowners' associations for communities within thejurisdietional boundaries of the City of Winter Springs, and recreational organizations under contract with the City of Winter Springs. If a particular request does not fit this criteria, the City Manager or the City Manager's designee shall have the discretion to decide whether to approve the request. The City Manager or the City Manager's designee may approve the requested web site link ifit serves the general purpose of the City's web site. The City of Winter Springs reserves the right to remove a link to content deemed obscene or inappropriate. The City is not responsible for and does not endorse the information on any linked web site unless the City's web site states otherwise. Under no circumstances will the City's web site provide links to web sites for candidates for local, state, or federal offices; political organizations or other organizations advocating a position on local, state, or federal issues; corporate or other for-profit organizations; and individual or personal home pages. 2
