J/j/' REQUEST: The Public Works Department requests the City Commission validate the staff recommendation finding Nursery Road Warehouses Phase DB-I to be built in substantial accordance with the Final Engineering plans. PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding Nursery Road Warehouses Phase IIB-1 to be built in substantial accordance with the Final Engineering per Section 9-178 in order for Certificates of Occupancy to be issued. This site is located on the northeast corner of Nursery Road and 17-92. APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. ( c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city comnusslon. FINDINGS: 1) All City agencies have found the work to be acceptable. 2) The Final Engineering for Phase II was approved by the City Commission at the March 8, 2004 Commission meeting. 071006_ COMM _ Consent_ 403_ Nursery_Road _ Warehouses_Phase _ lIB _Acceptance July 10, 2006 Consent Agenda Item 403 Page 2 3) Project Summary: a. The overall project consists of the construction of three new buildings (warehouse / retail) on a 6.628-acre site. Two existing buildings on the site will remain. Please refer to Exhibit 1 for an overall site plan. b. The project was approved to be built in three phases: i. Phase I is complete and consisted of some preliminary site development work per the Developer's Agreement. 11. Phase IIA is complete and consists of one 24,000 square foot warehouse building, along with the associated site and utility work. 111. Phase Iffi consists of the construction of two new buildings (#4 and #5) and the completion of the associated site and utility work. 4) The developer has requested that Phase Iffi be separated into two sub-phases (IIB-1 and IIB- 2) to coincide with the planned construction of Buildings 4 and 5. Building 5 is substantially complete, and the sitework associated with Building 5 has been constructed in accordance with the final engineering plans as Phase Iffi-1 (see Exhibit 1). Building 4 is scheduled to begin construction within the next 30-60 days. 5) The conditions of the Developer Agreement applicable to the Phase Iffi-1 construction have been met. RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding Nursery Road Warehouses Phase Iffi-1 built in substantial accordance with the Final Engineering per Section 9- 178. IMPLEMENTATION: Certificate of Occupancies for those units eligible can be issued after Commission approval. ATTACHMENTS: 1.
