J~!DEPT Authorizatio REQUEST: The Community Development Department- Planning Division requests the City Commission hold a Public Hearing for a Modification to the Aesthetic Review approval for Tuscawilla Square, located at 1301 Winter Springs Blvd. at Northern Way and Gary Hillery Drive. PURPOSE: To consider whether the Applicants request for changes to the previously approved Aesthetic Review submittal is consistent with the intent and purpose of Article XI - Minimum Community Appearance and Aesthetic Review Standards. APPLICABLE LAW AND PUBLIC POLICY: Ordinance 2003-43, Aesthetic Review Standards, City of Winter Springs Section 9-601. Approval prerequisite for permits. Section 9-605. Submittal requirements. Development Agreement- approved on December 13,2004 CHRONOLOGY: Jan. 26, 2004- City Commission adopted Ordinance 2003-43, establishing minimum community appearance and aesthetic review. Nov. 22, 2004- Concept Plan Approved by the City Commission Dec. 13,2004- Development Agreement approved by the City Commission Feb. 28, 2005- City Commission approved the Tuscawilla Square Final Engineering plans. May 9,2005- City Commission approved the Tuscawilla Square Aesthetic Review submittal. CONSIDERATIONS: The site is currently under construction. Several deviations from the approved Aesthetic Review submittal have taken place during construction. As a result, City Staff has requested that the applicant identify the deviations and submit documentation as to why the change is needed and to request the necessary Commission approval. The Applicant is requesting four deviations as identified in the following correspondence: ~ Ranaldi Planning and Architecture Inc .It= 25 May 06 @ Randy Stevenson, ASLA Community Development Director 1126 State Road 434 Winter Springs, Florida 32708 RECEIVED MAY 2 6 2006 CITY Of- WINT U~ SPRINGS PermIttIng - KIm Re: DRC Aesthetic Approval Tuscawilla Square Randy Although we have not received anything in writing, we have been verbally informed by Eloise Sahlstrom of your office, that a few deviations from the approved aesthetic rendering, for the above referenced project, have taken place during construction, requiring City approval. Please accept this letter as explanation of these deviations as well as an official written request to be scheduled for the 12 lun 06 regularly scheduled City Commission meeting for approval. Deviation 1: There is only one cupola on building 2 where the rendering shows two. Response: There literally was no room for a second cupola to be placed on the roof without interference with complicated valley and ridge flashing, creating the potential for damaging water intrusion into the building. In our opinion two cupolas may have been too crowded or busy looking and the single cupola looks fine and does not change the style or character of the building. See attached sketches labeled "Exhibit 1" and "Exhibit 2" Deviation 2: An ASI (architectural supplemental instruction) was issued to the contractor clarifying the gable end details changing material from stucco to wood. Response: This change was made to simplify and expedite the gable beam and latticework detailing. In our opinion this is an acceptable modification because there is no difference in appearance since it is all painted out in off white you cannot tell what the material is made of. See attached ASI No. 10 labeled "Exhibit 3". Deviation 3: The same ASI provided clarification for the planter area as you enter the parking lot off the driveway from Winter Springs Boulevard. 890 Northern Way ph 407 977 1080 Suite E 1 Fx 407977 1019 Winter Springs, Florida 32708 www.srlarch.com AA-002984 Response: There was no definition of this planter on the site plan, landscape plan or archite~turaJ I?l~&, so a,~jmple paving design with potted plants was_ . chosen for this area. In our opinion this design modification provides a very clean uncluttered walkway and certainly does dot detract from the overall ambiance of the project. See attached ASI No. 10 labeled "Exhibit 3". Deviation 4: Weare requesting approval of the use of dark shutters in lieu of the light colored shutters as shown on the approved rendering. Response: After review of the shutter color with the manufacturer and current trends in color selection we believe the darker color provides a very nice contrast to the building color and will in fact look better than the lighter color which will tend to disappear in the similarly colored light building colors. See attached rendering labeled "Exhibit 4". L() I I I- Zo ~ ~ 0:: 0:: a Of: a z z June 12, 2006 PUBLIC HEARING ITEM 203 The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following six (6) criteria have been satisfied: (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area. (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: (A) Front or side elevations, (B) Size and arrangement of elevation facing the street, including reverse arrangement, (C) Other significant features of design such as, but not limited to: materials, roofline, hardscape improvements, and height or design elements. (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. (5) The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Towne Center guidelines, SR 434 design specifications) and other applicable federal state or local laws. (6) The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite-resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. FINDINGS & STAFF RECOMMENDATIONS: Deviation 1) Although the single cupola proposed for Building Two is not in harmony with the double cupola on Building One and is not as attractive, the applicant has provided documented factual evidence substantiating the need for the requested change. The single cupola is more attractive than if it were to be removed altogether. Therefore, Staff supports the requested change. Deviation 2) The change in materials to the gable end does not affect the appearance of the building. Therefore, Staff supports the requested change. Deviation 3) The Aesthetic Review Plans approved May 9,2005 included a courtyard fountain feature aligned with the brick entrance drive flanked by planters and landscaping. Staff prefers the Site Plan (upper drawing) version. Staff does not support the removal of the planters as it will increase the area of pavement and reduce the plant material flanking the entrance drive. Deviation 4) The Key West architectural style as approved in the Developer's Agreement and Aesthetic Review submittal includes features such as standing seam metal roofs, roof cupolas, covered porches with white railings wrapping around the building, and bahama shutters. Key West detailing is typically white on a light colored fayade. The Applicant is requesting to change the bahama shutters from white to black. In addition, the applicant's graphic, appears to illustrate the shutters as well as the railings in black. This is not in character with the Key West theme. Staff does not support. Staff would however, support changing the bahama shutters to an aluminum material to match the standing seam roof color, should the Applicant desire this alternative over the white. Other 1) Electrical Panels on the north side of Building 1 are very visible from Gary Hillery Drive. Staff proposes that this area be screened from view by placing a trellis structure between the building wall and the sidewalk. This trellis would have the same lattice pattern as is used in the gable end of the buildings and would be painted the same color as the building trim. Final design drawings for this structure will be approved by Staff. Other 2) To date, no plans have been submitted for the renovation of Tuscany's Restaurant. At time of Approval, the Applicant indicated that renovations to Tuscany's would be within the same time frame as the construction of the new buildings and that plans would be submitted within the next six (6) to twelve (12) months. The Applicant has been notified that he will need to update the Commission on the status of the renovation to Tuscany's Restaurant. Discussion ensued on externalities and Deputy Mayor Blake suggested, "There may be some types of externalities that are so egregious that we really need to at least point out, just like we did the outside storage, is listed. That is one of those types of externalities that we have listed here. Noise, the air quality, pollution control devices - maybe we should not list them in the Ordinance, but we ought to at least go back to some administrative section somewhere that says, here are the different externalities that the City of Winter Springs is very concerned about and these must be tended to prior to coming forward." Ms. Eloise Sahlstrom, A1CP, ASLA, Senior Planner, Community Development Department opened the discussion on this Agenda Item. Mayor Bush opened the "Public Input" portion of the Agenda Item. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - MAY 9, 2005 PAGE 10 OF 35 Mr. Bill Starmer, Architect, Starmer Ranaldi Planning and Architecture (sri), 890 Northern Way. Winter Springs. Florida: representing the Mr. Alec String the Developer for this project, Mr. Starmer stated that in regards to this Agenda Item, "The restaurant in question, Tuscany's is going to undergo some renovation to bring it in line with the aesthetic style of the buildings that are built there." Mr. Starmer noted that Mr. String's "Intent - is to make the renovations to this facility within the same timeframe that the new building is being built. And, what that tells you is that probably within the next six (6) to twelve (12) months, hopefully the new buildings will be under construction and at that time, we will have a design for the renovation of that building into the City for submi ttal." Regarding issues mentioned about the restaurant in question, Manager McLemore suggested to the City Commission, "All you need to do is put it in the Public Record that you will not issue a Building Permit until they resolve this to your satisfaction." Commissioner Krebs said, "Okay." Commissioner Gilmore remarked, "Sounds good." Commissioner Krebs stated, "It sounds good." Mayor Bush remarked, "On page 3 of the information that we have; it says 'No upgrades to the existing Tuscany's restaurant building are proposed, except for the addition of some decking.' Is that still true?" Mr. Starmer stated, "I think that statement in context is true and basically that's the Staff telling you that nothing, no improvements to Tuscany's has been proposed. And we didn't include it. Now we are trying to get the building permit and we're trying to get the process going for Buildings 1 and 2. We're standing here telling you - publicly now that we will be improving that and we will bring that forward to the Staff and Commission for approval." Regarding the proposed style of this project, Mr. Starmer noted, "I'm not sure I support the statement that it won't be in line with the Key West - I think it will be. We're changing the roof to match what the new buildings are; we're going to change the exterior material and color to match what the new buildings are going to be; so I think it will be very much in keeping with that Key West theme." Furthermore, Mayor Bush commented that "Staff had made the comment here that it says Tuscany's restaurant currently has a green asphalt roof, stucco and wood siding and that was very much in contrast to the proposed development." Mr. Starmer stated, "We would concur. We are going to try and solve that." "I WOULD MAKE A MOTION WE APPROVE ITEM '401' AND THE MANAGER WILL CONTINUE TO KEEP HIS EYE ON WHAT IS HAPPENING WITH SHIELDING OF THE MOPS AND THAT AT TUSCANY'S RESTAURANT." (d) (7) Of The City Code Of Ordinances, To Allow An Addition To An Existing Residence At 688 Saranac Drive, Tuscawilla Unit 14A, Lot 104. Mr. Baker introduced this Agenda Item. Deputy Mayor Blake commented on advocacy and whether this request should have been a 'Variance' rather than a 'Waiver'." Deputy Mayor Blake spoke on Staff's Recommendations, to which Manager McLemore, stated, "I think your point is well taken; we will certainly have that discussion."
