A petition has been submitted to the City of Winter Springs requesting that the City transfer property along the east side of the pond adjacent to Sam Smith Children's Park to the current property owners, located at 1638,1640,1642,1644 and 1648 Eagle Nest Circle. . Since the time the subdivision was built in 1990, the city has been maintaining approximately 12-15 feet around the perimeter of the pond. The petitioning property owners have been providing maintenance and upkeep to the city-owned property beyond this perimeter. . For the past 15 years, the City has not used this land and appears unlikely to do so in the future. . A City water treatment facility is located along the west side of the pond. Forested land is located along most of the south side of the pond. Therefore, the pond and the land west and south of the pond would remain the property of the City. . In addition, approximately 12-15 feet along the eastern edge of the pond would also be remaindered to the City to be used as public access. This access area is currently used on a daily basis by the general public. . If the transfer is approved by the City, the property owners would pay the fees associated with re-surveying the land and filing the revised plats with the required local governments. Benefits to City . Officially released from liability and maintenance responsibility for the transferred property . Additional income from increased property taxes that will be assessed on the larger lots . Retains public access to area surrounding the pond, allowing the general public to continue to enjoy that area for walking, fishing, etc. Benefits to Property Owners . Increased lot size, increasing the market value of their properties .
