COMMISSION AGENDA ITEM B Consent Information Public Hearine: Ree:ular X MGR.IL- /Dert. /~ December 9.2002 Regular Meeting REQUEST: Community Development Department presents to the City Commission, the preliminary and final engineering site plan for the State Road 434 Retail Center located on the west side of the Stone Gable mixed use community and the south side of SR 434. PURPOSE: The purpose of this agenda item is to present to the Commission the preliminary and final engineering site plan for a 50,439 square foot shopping center, on 9.15 acres. The shopping center square footage 'is proposed to be broken into 35,439 square feet of retail, 6,000 square feet of restaurant, and 9,000 square feet of office (on the second floor). APPLICABLE LAW: Sec. 9 - 26. Maps, engineering plans and plats to be submitted in preliminary and final form. Sec. 9 - 71. When final development plan is to be filed; extension~ Sec. 9 - 72. Processing of final plans. Sec. 9 - 73. Form and contents of final development plan. Sec. 9 - 74. Action on final development plan; expiration of approval. CONSIDERATIONS: The site is depicted as Commercial on the Future Land Use map, The SR 434 corridor is developing (e,g. Parkstone, the Town Center, Wagner's Curve, and the Baptist Church). The site is located adjacent to the Stone Gable PUD. Tract "A" of Stone Gable, at the 1 t .- , Regular Item A December 9,2002 Page 2 northeast corner of Stone Gable Circle and SR 434 is dedicated for commercial development (the Stone Gable property had a Commercial FLU designation before it was amended to Mixed Use in 1996 to allow rezoning to the Stone Gable PUD with residential and commercial uses). There is a commercial tract at the front of the Parkstone PUD, on the opposite (north) side of SR 434, The Stone Gable Master Plan depicts the subject property as having C-l zoning, demonstrating the commercial designation preceded the existing adjacent Stone Gable mixed use community, Utilities will be available to the site and require connection by the developer. The site is located on busy SR 434. Staff required a traffic study, which was subsequently reviewed by the City's traffic consultant. Both professionals determined that adequate capacity exists on SR 434 and that no additional features (e.g. turn lanes or intersection improvements) were required to accommodate this development. The existing directional median cut in the SR 434 ROW was relocated to its present location to accommodate the development of Stone Gable. It had been located in front of the proposed SR 434 Retail Center site. Due to its proximity (it does not meet the minimum separation requirements) to the nearest traffic signals (i,e. the bus barn and Winding Hollow), it does not qualify for either a traffic light or a full median cut. One of the conditions for allowing Cambridge Homes to move the directional median cut to accommodate Stone Gable was that Cambridge Homes provide cross access to this site. Although Cambridge Homes retains ownership of the narrow strip of land just west of Stone Gable Circle, it (the narrow strip of land) is controlled by the Stone Gable Home-Owners' Association, which will not grant access to the subject property, The Florida Department of Transportation stated in an 8/30/02 letter to the developer that: "...In regards to the directional median opening access issue, three (3) options are available and include: 1 Use the present median opening access which also currently serves the Stone Gable residential community. Cross access will need to be provided from Stone Gable Circle to the SR 434 Retail Center site. 2 Provide for a relocated directional median opening west of Stone Gable to the proposed easterly access connection of the SR 434 Retail Center. Cross access would need to be provided from the SR 434 Retail Center to Stone Gable Circle. 3 Construct an additional directional median opening to provide access to the proposed western access connection of the SR 434 Retail Center. The present directional median opening to Stone Gable Circle 2 ~ Regular Item A December 9, 2002 Page 3 would remain with or without cross access between the two developments. The Department prefers that only one (1) directional median opening to be used between both developments. McGaba LLC and the Stone Gable Homeowners Association must work out which option is agreeable to each and submit final plans based on the above options listed.... " The parties met and were unable to agree. The developer is proposing option two without the cross access to Stone Gable which is shown on the plans, Both proposed curb-cuts shown on the proposed plan meet City Code requirements, The traffic analysis has been modified to incorporate these changes and has been reviewed and found satisfactory by the City's traffic consultant. However, staff recommelIlds that the plans be revised to reflect the third option ae:reed to bv FDOT which would keep the existine: directional openine: to Stone Gable and provide a second directional median openine: to the western entrance to the proiect. This would reduce the amount of conflicting turning movements to Stone Gable while still providing direct access to the project. Staff is requiring cross access easements for this project for easterly and westerly access, CHRONOLOGY: . January 11, 2002 - Preliminary Engineering Plan submitted to City · April 8, 2002 - Final Engineering Plan submitted to City . November 20, 2002 - P & Z Board recommended approval FINDINGS: 1) The site is zoned General Retail (C-1) and has a Commercial future land use designation, which allow the types of uses requested, 2) The site is located within the SR 434 New Development Overlay District and all regulations of the overlay are applicable, 3) The Stone Gable HOA and developer were unable to agree to a cross access easement between the properties. 4) The developer is proposing the 2nd FDOT option without the cross access which closes the Stone Gable median opening and relocates it to the west. Staff and our consultants have reviewed the associated portions of the preliminary site plan and found them to be in conformance with standard engineering practice and acceptable for approval from a transportation/traffic point of view. Additional on-site or off-site traffic mitigation measures (e.g. auxiliary turn lanes) are not deemed necessary by either the applicant's traffic consultant or the City's traffic consultant. 5) The Developer has already received an FDOT permit for the proposed modifications and relocation of the median opening, 6) The existing directional median cut was moved from in front of the proposed SR 434 Retail Center site to the present location to accommodate the development of Stone Gable 3 Regular Item A December 9, 2002 Page 4 and does not meet the FDOT separation requirements from the 2 nearest existing tranic lights (at the school bus barn and Winding Hollow) for either a traffic light or a full median cut. 7) FDOT Option 3 provides directional median openings for Stone Gable and the project. This is the option preferred by staff. 8) The stormwater pond location adjacent to the existing Stone Gable storm water pond is a City requirement. 9) The applicant will grant a cross-access utility easement to the City at the southeast corner of the site to accommodate an existing drain-pipe serving the Stone Gable stonnwater pond. 10) The SR 434 Retail Center preliminary and final engineering site plan is consistent with the City Comprehensive Plan and City Code of Ordinances, subject to the following conditions: a) No construction may commence until all pertinent determinations, permits and/or approvals are obtained from the SJRWMD ( FOOT permit before any work done in FDOT SR 434 ROW; FDEP permit before water and sewer line construction/installation) ; b) A drainage easement shall be granted to the City for the triangular-shaped area located at the southeast comer of the site (as depicted on sheet 4 of the plans submitted 4/24/02), south of the storm water pond, prior to issuance of any certificate of occupancy for the site; c) A vehicular cross-access easement, centered approximately 160 feet south of the northeast comer of the site (depicted on sheet 4 of the plans submitted 4/24/02) shall be granted to the City and/or the adjacent property owner or as determined by the City Attorney, pursuant to Section 20-472 of the Code, prior to issuance of the first certi ficate of occupancy for the site; d) A vehicular cross-access easement, centered approximately 150 feet south of the northwest comer of the site shall be granted to the City and/or adjacent property owner or as detennined by the City Attorney, pursuant to Section 20- 472 of the Code and the recommendation of the City's traffic consultant. prior to the issuance of the first certificate of occupancy for the site (plans to be modified by the applicant to depict this easement prior to a pre-construction conference or commencing site work). e) Dumpster pad enclosures shall be permitted and constructed consistent with the requirements of the new 'dumpster enclosure regulations (Ordinance No. 2002-13 ); f) All signage shall be consistent with the requirements of Section 20-470 and/or Chapter 16 of the City Code, as pertinent; g) Off-site light spillage shall not exceed 0.5 foot-candle power (this may require adjustment, shielding, or other modi fications) after field veri fication after installation; h) Before a pre-construction conference is held or construction may commence, the applicant shall amend the plans to accommodate all of the changes 4 ~ Regular Item A December 9, 2002 Page 5 required by the City Fire Marshal, the City Engineer, and/or City Public Works Director, as may be pertinent; i) A six foot tall masonry wan will be constructed across the southern portion of the site, where the developed portion of the site will abut residential zoning, This will extend generally from the eastern property boundary to the upland buffer depicted on sheet 4 (a literal reading of the Wall Ordinance - Ordinance No, 2000-07 - would require the wall to be constructed across the existing creek and through the wetl,Uld); and, j) The FDOT permit shall be modified to reflect option 3 which allows both SR 434 Retail Center and Stone Gable to have a median opening. The Stone Gable median opening would need to be relocated to the western entrance for adequate spacing between the median openings, k) All City-owned trees and/or other landscape material located in the median, that may need to be relocatc~d, shall be relocated and maintained by the developer for a time period reasonable for the plants to become re-established. RECOMMENDATION: Staff recommends approval of the SR 434 Retail Center preliminary and final engineering site plans, subject to conditions 10 (a) through (k) set forth in the Findings section above. PLEASE NOTE: Staff will provide a detailed discussion paper along with the plans, no later than Friday, December 6, 2002 ATTACHMENTS: A. This development is estimated to generate a daily traffic volume of2, 157 vehicles and a P.M. peak hour of 192 vehicles (88 ep.tering and 104 exiting). This trip generation represents access "Category D". The proposed development will be served by one access connection to be located at the median opening which will be moved from Stone Gables Circle. This will bea directional opening with a separate left turn lane having a minimum length of315 feet. This turn lane will also serve U-turns for the Stone Gables Subdivision. Additionally for Stone Gables, provisions will be made to allow the construction of cross access from the SR 434 Retail Center site. CALL TO ORDER The Planning And Zoning Board/Local Planning Agency Special Meeting was called to order Wednesday, November 20, 2002" at 7:00 p.m. by Chairman Bill Fernandez in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairman Bill Fernandez, present Vice Chairman Tom Brown, present Board Member Rosanne Karr, present Board Member Joanne Krebs, absent Board Member Sally McGinnis, absent The Pledge of Allegiance was recited. II. REGULAR REGULAR A. State Road 434 Retail Center PreHiminary & Final Site Plan. Ms. Tracy Crowe, Principal Planner, Land Design Innovations, 140 North Orlando Avenue, Winter Park, Florida: presented a report and recommendations on behalf of City Staff, and distributed a letter from some Stone 'Gable residents which requests that an eight foot (8') wall be constructed behind the four (4) residences abutting the State Road 434 Retail Center. Mr. Hal Kantor, Attorney, Lowndes Drosdick Doster Kantor & Reed, 215 North Eola Drive, Orlando, Florida: presented his presentation to the Board and spoke on behalf of the Developer. Chairman Fernandez opened the "Public Input" portion of the Meeting to the public. Mr. Tom Kearney, 159 Stone Gable Circle, Winter Springs, Florida: President of the Stone Gable Homeowner's Association, stated "We are not opposed to their center lane cut, we are just opposed to them taking ours away". Mr. Kearney also stated concerns with the thirty-foot (30') buffer, the potential future expansion of the facility, and the desire for no second story. ..- "I r;~, :::: -- .. rr=: ,.... . ,... . ~ ~. ; . Chairman Fernandez stated, "This property lies within the New Development Overlay District, is that correct?" Ms. Crowe stated, "Yes." Chairman Fernandez then said, "That is the City Ordinance. In your 'Findings', when it says - number 7), 'Preliminary Site Plan is consistent with the City Comprehensive Plan and City Code of Ordinances', does that refer to the New Development District Overlay, 434 New Development District Overlay?" Ms. Crowe stated, "Yes, sir." Chairman Fernandez inquired about "Number 8), when it says 'The Final Engineering and Site Plan is consistent with the City Comprehensive Plan and Code of Ordinances subject to the following conditions', does that also reference the New District Overlay Zoning?" Ms. Crowe answered, "Yes sir." Mr. Robert Johnston, 104 Stone Gable Circle, Winter Springs, Florida: discussed the three (3) entranceway options for the Retail Center; requested a "Brick wall instead of a Masonry wall" be constructed behind the affected properties; and that the wall be. constructed "On the other side ofthe trees". Brief discussion developed regarding the wall that will separate Stone Gable from the Retail Center. Mr. Robert Keilh, 106 Stone Gable Circle, Winter Springs, Florida: advised the Board that the Stone Gable residents "Have had a difference of opinion on the wall and the trees" and stated in regards to the wall height, "I think we can live with six feet (6') - we do not want a Variance on the issue ofthe wall." Ms. Katherine Snodgrass, 112 Stone Gable Circle, Winter Springs, Florida: addressed the Board and explained that her residence was built on Lot 7 and stated, "I want a wall, I do not want a Variance issued" because of the lack of trees behind her residence. Ms. Maria Vargas, 110 Stone Gable Circle, Winter Springs, Florida: did not verbally address the Board, but Chairman Fernandez stated that Ms. Vargas was in favor of a buffer wall. Mr. Anthony Edwards, 100 Stone Gable Circle, Winter Springs, Florida: stated, "My family - we would like to have a natural tree buffer and then a wall after that." When asked for his preference on the Stone Gable entrance median cut, Mr. Edwards replied, "I would like to - keep our median cut." Ms. Kasey Edwards, 100 Stone Gable Circle, Winter Springs, Florida: addressed the "Drop-off' in her backyard and questioned how a wall would provide privacy when it would sit so low. Mr. Kantor replied, "'We have to fill part of the land." ,...., r-, ::= -- ~ ~ ,.... Chairman Fernandez closed the "Public Input" portion of the Meeting to the public. Tape 2/Side A Mr. Kantor advised the Board that "I would ask [for] the approval of the project consistent with the plans, consistent with the Staffs Recommendation, and consistent with the DOT [Department of Transportation] approval." Chairman Fernandez asked Mr. Kantor in regards to 8) a) of the Staff "Findings", "Do you agree to that on behalf of the Developer?" Mr. Kantor stated, "If that is the standard City condition, we agree to it." Under 8) b) regarding drainage easement, Chairman Fernandez inquired, "Developer have any problems?" Mr. Kantor stated, "No, we are aware of that. There is unapproved drainage that crosses his property." Chairman Fernandez asked, "And you are going to go along with an easement?" Mr. Kantor answered, "Yes." Chairman Fernandez then asked, "Cross access on the west, cross access on the east, the Developer is willing to go along with that?" Mr. Kantor said, "Yes sir, and it is not shown on this drawing but we do show on the plan, a place that provides cross access on the east. I do not know if we show it on the west." In regards to dumpster pad enclosures and referencing Ordinance 2002-13, Chairman Fernandez asked, "You are going to comply with that, and the plan shows at least fifty foot (50') clearance?" Mr. Kantor said, "Yes, sir." "Signage consistent with - Section 20-470. and [Chapter] 16 of the City Code - the Developer has no problem?" Mr. Kantor responded, "That is correct." In regards to "Off-site light spillage not exceeding .5 - candle power", Mr. Kantor stated, "We agree with that." Chairman Fernandez read 8) h) of the "Findings" and asked Mr. Kantor, "Does the Developer have any problems with that?" Mr. Kantor answered, "No sir." Regarding 8) i), addressing a six-foot (6') masonry wall that will be constructed across the southern portion ofthe site, Mr. Kantor advised the Board, "We agree to that." MOTION BY VICE CHAIRMAN BROWN. "I WOULD LIKE TO MAKE A RECOMMENDATION, THE STAF'F'S RECOMMENDATIONS INCLUDE THE FINDINGS WHICH MR. FERNANDEZ DISCUSSED. I MAKE A MOTION THAT WE RECOMMEND TO WE TAKE THE STAFF'S RECOMMENDATION THAT PLANNING AND ZONING BOARD RECOMMEND APPROVAL OF THE S.R.
